After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PAUL SORKO-RAM Beaufort County Environmental setting The applicant owns a 171.7 acre tract of land in Beaufort County off of SR 1115 adjacent to Blounts Creek near Cotten Patch Landing. The property is heavily wooded and is vegetated with mixed hardwoods, pines with an open understory. Areas vegetated with wetlands protrude into the property at several places along Blounts Creek. These areas are vegetated with both coastal wetlands (marsh) and wooded wetlands. Existing access into the property is presently by unimproved woods roads which connect to SR 1115. The project which is being proposed at this time is located near the northwest corner of the property where a narrow woods road connects an island to the mainland portion of the property. The crossing which has the public trust area of Blounts Creek on both sides, has a length of t 127' and an average width of f 14'. The crossing has an average elevation of less than 1 foot above the NWL of Blounts Creek. The crossing is vegetated with Spartin cynosuroides, Poison Ivy, Red Maple, and Wax Myrtle. It appears that the crossing has been historically utilized by vehicles to transverse from the mainland to the island, however, in it's deteriorated state, it has not been used for such in many years. Project prop The applicant is proposing to build two single family dwellings on the property. The main house will be constructed on the mainland and a guest house on the island. To provide access to the guest house, the existing access to the island must be upgraded. To accomplish this, the applicant is proposing the following: (1) The construction of two retaining walls, twelve feet apart, atop the existing access path. Once completed, the area between the two walls will be filled to provide a 12' wide road access to the island. A 10' long opening will be bridged approximately one half way across the length of the road to provide for water transfer on high tides. The total length of the crossing will be ±127'. Environmental impact If the project is conducted as proposed, the following environmen al impacts will occur: (1) Approximately ±1,524 sq. ft. of wetland area will be filled to upgrade the existing road. This area is randomly (sparsely) vegetated with Spartina cynosuroides and numerous other more woody plant species including a considerble amount of poison ivy. (2) Short term turbidity may exist within the public trust areas of Blounts Creek during project construction. Also, during upland road and dwelling construction, if proper sedimentation and erosion devices are not adhered to, then the potential exists for the erosion of sediments into Blounts Creek and or wetland areas. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 1 l white paper. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. PROJECT SUMMARY: The applicant is proposing to upgrade an existing road bed to obtain access to highground island to construct a single family dwelling. PAUL SORKO-RAM Beaufort County Environmental setting The applicant owns a 171.7 acre tract of land in Beaufort County off of SR 1115 adjacent to Blounts Creek near Cotten Patch Landing. The property is heavily wooded and is vegetated with mixed hardwoods, pines with an open understory. Areas vegetated with wetlands protrude into the property at several places along Blounts Creek. These areas are vegetated with both coastal wetlands (marsh) and wooded wetlands. Existing access into the property is presently by unimproved woods roads which connect to SR 1115. The project which is being proposed at this time is located near the northwest corner of the property where a narrow woods road connects an island to the mainland portion of the property. The crossing which has the public trust area of Blounts Creek on both sides, has a length of ± 127' and an average width of ± 14'. The crossing has an average elevation of less than 1 foot above the NWL of Blounts Creek. The crossing is vegetated with SSpartina cynosuroides, Poison Ivy, Red Maple, and Wax Myrtle. It appears that the crossing has been historically utilized by vehicles to transverse from the mainland to the island, however, in it's deteriorated state, it has not been used for such in many years. Project proposal The applicant is proposing to build two single family dwellings on the property. The main house will be constructed on the mainland and a guest house on the island. To provide access to the guest house, the existing access to the island must be upgraded. To accomplish this, the applicant is proposing the following: (1) The construction of two retaining walls, twelve feet apart, atop the existing access path. Once completed, the area between the two walls will be filled to provide a 12' wide road access to the island. A 10' long opening will be bridged approximately one half way across the length of the road to provide for water transfer on high tides. The total length of the crossing will be ±127'. Environmental impact If the project is conducted as proposed, the following environmerr:al impacts will occur: (1) Approximately ±1,524 sq. ft. of wetland area will be filled to upgrade the existing road. This area is randomly (sparsely) vegetated with SSpartina cynosuroides and numerous other more woody plant species including a considerble amount of poison ivy. (2) Short term turbidity may exist within the public trust areas of Blounts Creek during project construction. Also, during upland road and dwelling construction, if proper sedimentation and erosion devices are not adhered to, then the potential exists for the erosion of sediments into Blounts Creek and or wetland areas. Gossett - Washington Regional Office - 1 July 1994 PAUL SORK-RAM Beaufort County RECOMMENDATION The applicants project has been reviewed in regards to NCAC 7H guidelines as it relates to coastal wetlands AEC. Even though the applicant is proposing to fill ±1,524 sq. ft. of area which is partly vegetated with S_partina cynosuroides, it is this office's opinion that the proposal is consistent with the guidelines. The reason is that the area to be filled is sparsely vegetated with Spartina cynosuroides and no homogeneous stand is present. The marsh is growing atop an existing roadbed along with numerous other woody plant species which include upland species. The dominant overall species may well be poison ivy. Due to the character of the area, this office recommends that the permit be issued with the following conditions. CONDITIONS (1) The proposed retaining walls will be constructed as shown on plat sheet 5 of 6; that is entirely above the normal water line of Blounts Creek. (2) The retaining wall will be constructed prior to any backfilling activities. (3) The retaining wall must be structurally tight so as to prevent seepage of backfill materials through the structure. (4) The retaining wall must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the retaining wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. (5) All back fill material will be obtained from a highground source and confined behind the permitted retaining wall. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or otherlarger plats are acceptable only if 18 high quality copies are provided by applicant.
