Dear Mr. Schiener:
In response to Mr. Wright's letter of June 13th requesting additional information on
this project, I offer the following information:
1. All project elements, excluding the boat ramp, are located outside of wetland
areas.
2. The site location for the boat ramp was selected as the current site relief in
that area is similar to a cliff (very steep slopes) and would not impact a
jurisdictional wetland area.
3. Due to the tidal water elevation changes on the site and our desire to facilitate
maximum utilization of the boat ramp facility during all tidal stages, a longer
ramp providing deep water access has been proposed than that allowable
under a nationwide permit number 36.
4. With the above factors in mind, we are not aware of any component of the
project anticipated to create either a loss of waters or wetlands which would
require mitigation efforts.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Brunswick County,
filed an application on May 11, 1994, for a permit from the Division of Coastal Management
to develop in an Area of Environmental Concern and for certification from the Division of
Environmental Management that a discharge of fill material in project wetlands will not
violate applicable water quality standards.
According to said application Brunswick County is proposing to construct a public
water access park, to include 2 boat ramps, parking lot, rest room facilities, nature walk, and
handicap accessible deck on NC Highway 133, approximately 1 /2 mile south of Belville,
adjacent to the Brunswick River.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Environment, Health and Natural Resources, Division of Coastal
Management, and Division of Environmental Management, located at 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, 919/395-3900.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before June 27, 1994. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 22, 1994 for consideration in the CAMA permit decision, and to Mr. John Domey,
Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 17, 1994 for consideration in the water quality certification decision. Later comments
on the CAMA application will be accepted and considered up to the time of permit decision.
Project modifications may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided upon request.

Dear Mr. Tucker:
You have our approval to place fill material in 3000 square feet of waters for the purpose of
boat ramp construction at NC 133 at Brunswick River at the New County Park site, as you
described in your application dated 15 June, 1994. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2745. This
certification allows you to use Nationwide Permit Number 36 when it is issued by the Corps of
Engineers.
This approval is only valid for the purpose and design that you described in your application.
If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached
certification. An additional condition is that al wet concrete poured below MHW shall be poured at
low tide to prevent wet concrete from contacting the surface water. In addition, you should get
any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to
the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

9. PROTECT DESCRIPTION

The project is located adjacent to the Brunswick River on N.C. Highway 133, approximately
1 /2 mile south of the U. S. Highway 74/76 overpass in Belville. The east side of the 11.52 acre
tract consists of 836 feet of road frontage on N. C. Hyw 133, the property is approximately 634
feet deep and it is bordered to the north and south by wooded, State owned property. The
western property boundary consists of approximately 785 feet of water frontage along the river.
The northern third of the tract is cleared, an abandoned borrow pit used in years past by the
N.C.D.0.T. to obtain fill material for road maintenance and construction. Although the county
has recently graded and grassed this area, several of the sharp vertical cuts remain in the
topography, remnant of the previous excavation work. The remainder of the highground property
is wooded, including mature pine, oak, hickory, poplar, sweet gum, and pecan. The highground
elevation averages +20 feet MSL. A large cove, off the Brunswick River, indents into the center
of the western side of the property. The cove is approximately 320 feet long (east-west) and 150
feet wide (north-south). It is unclear as to the origin of the cove, but, judging from the almost
vertical side slope transition to highground and the 7 ft. water depth in the center of the cove,
it is probable that this feature was originally created by excavation, and was originally a liberty
ship mooring. Aerial photography review would seem to support this hypothesis.
The waters of the Brunswick River are classified SC by the N.C. Division of Environmental
Management, and designated as a Primary Nursery Area by the N.C. Division of Marine
Fisheries.
The applicant is proposing the development of a public recreational and regional estuarine access
facility. The project would consist of a double concrete boat ramp, 140 feet long and 40 feet
wide. The lower two-thirds of the ramp would be divided in half by a wooden walkway to
facilitate boat launching and pull-out. The walkway would be 65 feet long and 5 feet wide, and
step down in sections with the slope of the ramp. The ramp would extend into the cove to the
3 feet water depth at MLW, or approximately 50-60 feet. The applicant proposes to stabilize
both sides of the ramp, below MHW, with rip rap, and remove several large pieces of concrete
debris from the cove. The associated parking area would be approximately 350 feet long (east-
west), with an average width of 200 feet. A stormwater retention basin (140 ft. X 80 ft.) would
be located west of the parking area and boat ramp. Public/handicap rest room facilities (25 ft.
X 24 ft. bldg. size) would be located on the south side of the parking area. Wastewater disposal
would be accomplished by an approved septic tank/pump chamber system, which would pump
to an absorption field located in the southeastern corner of the tract. A nature walk is planned
for the park. The walkway would begin at the bath house and meander through the wooded area
and along the southern edge of the cove, terminating at an observation deck constructed on the
high bank of the Brunswick River, in the southwest corner of the property. The walkway would
consist of 950-1000 lineal feet of concrete walk, 5 feet wide. The observation deck would
consist of a 30 feet wide octagon, with rectangular platforms extending north (40 ft. X 12 ft.)
and south (70 ft. X 12 ft.) paralleling the river bank. The applicant has requested grant funding
from the N.C. Division of Coastal Management and N.C. Wildlife Commission. Additional
facilities listed in the grant application include, tennis courts, horse shoe and shuffle board
courts, and picnic shelters. These amenities will be sited as development of the park proceeds,
and all would be located outside of the CAMA Estuarine Shoreline Area of Environmental
Concern.

10. ANTICIPATED EMPACTS
The proposed boat ramp would incorporate 3000 square feet of Public Trust and Estuarine
waters. Bottom disturbance would be minimal, limited to the grading of the ramp slope and
concrete forms. The removal of the concrete debris in the cove (snag and drag) should not have
negative impacts provided no major excavation is required. The parking lot, boat ramp, bath
house, and walkway would create approximately 78,800 square feet of impervious surface area.
The stormwater sedimentation basin and observation deck construction would add an additional
13,420 square feet of disturbed area into the project's implementation.
The project would create a Regional Estuarine Access and Boating Facility for public use and
handicap accessible. There are currently no public access/boating sites on the Brunswick River,
or the west side of the Cape Fear River between Wilmington and Southport.

As previously discussed, the County does not have this site on
their updated Land Use Plan. Since Belville recently annexed
this area, their Land Use Plan update will not include this
property until fall.
ATTACHMENT F
This project is not specifically mentioned in any other docu-
ments, but in general falls in line with the Brunswick County
Parks and Recreation Master Plan and the State Comprehensive
Outdoor Recreation Plan (SCORP). It also will enhance and
improve the Cape Fear River Trail.

Both the Town Council of Belville and The Brunswick County Board
of County Commissioners have endorsed this project as shown by

9. PROJECT DESCRIPTION 5/20/94
The project is located adjacent to the Brunswick River on N. C. Highway 133, approximately
1/2 mile south of the U.S. Highway 74/76 overpass in Belville. The east side of the 11.52 acre
tract consists of 836 feet of road frontage on N.C. Hyw 133, the property is approximately 634
feet deep and it is bordered to the north and south by wooded, State owned property. The
western property boundary consists of approximately 785 feet of water frontage along the river.
The northern third of the tract is cleared, an abandoned borrow pit used in years past by the
N.C.D.O.T. to obtain fill material for road maintenance and construction. Although the county
has recently graded and grassed this area, several of the sharp vertical cuts remain in the
topography, remnant of the previous excavation work. The remainder of the highground property
is wooded, including mature pine, oak, hickory, poplar, sweet gum, and pecan. The highground
elevation averages +20 feet MSL. A large cove, off the Brunswick River, indents into the center
of the western side of the property. The cove is approximately 320 feet long (east-west) and 150
feet wide (north-south). It is unclear as to the origin of the cove, but, judging from the almost
vertical side slope transition to highground and the 7 ft. water depth in the center of the cove,
it is probable that this feature was originally created by excavation, and was originally a liberty
ship mooring. Aerial photography review would seem to support this hypothesis.
The waters of the Brunswick River are classified SC by the N.C. Division of Environmental
Management, and designated as a Primary Nursery Area by the N.C. Division of Marine
Fisheries.
The applicant is proposing the development of a public recreational and regional estuarine access
facility. The project would consist of a double concrete boat ramp, 140 feet long and 40 feet
wide. The lower two-thirds of the ramp would be divided in half by a wooden walkway to
facilitate boat launching and pull-out. The walkway would be 65 feet long and 5 feet wide, and
step down in sections with the slope of the ramp. The ramp would extend into the cove to the
3 feet water depth at MLW, or approximately 50-60 feet. The applicant proposes to stabilize
both sides of the ramp, below MHW, with rip rap, and remove several large pieces of concrete
debris from the cove. The associated parking area would be approximately 350 feet long (east-
west), with an average width of 200 feet. A stormwater retention basin (140 ft. X 80 ft.) would
be located west of the parking area and boat ramp. Public/handicap rest room facilities (25 ft.
X 24 ft. bldg. size) would be located on the south side of the parking area. Wastewater disposal
would be accomplished by an approved septic tank/pump chamber system, which would pump
to an absorption field located in the southeastern corner of the tract. A nature walk is planned
for the park. The walkway would begin at the bath house and meander through the wooded area
and along the southern edge of the cove, terminating at an observation deck constructed on the
high bank of the Brunswick River, in the southwest corner of the property. The walkway would
consist of 950-1000 lineal feet of concrete walk, 5 feet wide. The observation deck would
consist of a 30 feet wide octagon, with rectangular platforms extending north (40 ft. X 12 ft.)
and south (70 ft. X 12 ft.) paralleling the river bank. The applicant has requested grant funding
from the N.C. Division of Coastal Management and N.C. Wildlife Commission. Additional
facilities listed in the grant application include, tennis courts, horse shoe and shuffle board
courts, and picnic shelters. These amenities will be sited as development of the park proceeds,
and all would be located outside of the CAMA Estuarine Shoreline Area of Environmental
Concern.

10. ANTICIPATED E"PACTS
The proposed boat ramp would incorporate 3000 square feet of Public Trust and Estuarine
waters. Bottom disturbance would be minimal, limited to the grading of the ramp slope and
concrete forms. The removal of the concrete debris in the cove (snag and drag) should not have
negative impacts provided no major excavation is required. The parking lot, boat ramp, bath
house, and walkway would create approximately 78,800 square feet of impervious surface area.
The stormwater sedimentation basin and observation deck constriction would add an additional
13,420 square feet of disturbed area into the project's implementation.
The project would create a Regional Estuarine Access and Boating Facility for public use and
handicap accessible. There are currently no public access/boating sites on the Brunswick River,
or the west side of the Cape Fear River between Wilmington and Southport.
