On April 6, 1994, you requested a 401 Water Quality Certification from the Division
of Environmental Management for your project (lot fill) located near SR 1766 in Beaufort
County. We wrote to you on 22 April 1994, discussing concerns that we have regarding the
design of the project and placing it on hold until those concerns are addressed. As of today,
we have not received a response to our earlier letter. Unless we receive a response from you
by 25 July 1994, we will consider that you have withdrawn this application and are not
interested in pursuing the project at this time.

On 5 April 1994, you wrote to the Division of Environmental
Management requesting a 401 Water Quality Certification for your
project to fill wetlands for lot fill at SR 1766 in Beaufort County.
We have been informed by the N.C. Division of Coastal Management that
this project will require a Permit from the N.C. Division of Coastal
Management. We cannot continue to process your application until the
Division of Coastal Management (DCM) begins the permitting process.
Therefore I must hereby place this project on indefinite hold until
you and the Division of Coastal Management gather the necessary
information to develop an acceptable DCM permit application. Also by
copy of this letter, I am also notifying the U.S. Army Corps of
Engineers that this project will need processing by the Division of
Coastal Management.
If you believe that this decision is in error, please call me at
919-733-1786 to discuss the matter.

The following comments by the North Carolina Division of Marine Fisheries (DMF) are
offered pursuant to G. S. 113-131. The applicant proposes to fill .10 acres of wetlands for a
wood deck. This activity is within CAMA jurisdiction and will require a CAMA major permit,
not a Nationwide Permit #18. The wetlands to be filled are contiguous to wetlands adjacent to
the canal. The wood deck is not a water dependent activity and the applicant should position it
in an upland area.

Nationwide Permit for an
Activity Located in Beaufort

Dear Mr. Miller:
The North Carolina Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 5 April 1994 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon
our review, we have determined that the proposed activity is located within the
Estuarine Shoreline, a designated Area of Environmental Concern (AEC).
Therefore, a Coastal Area Management Major Development Permit will be required
for the proposed filling of wetlands within this AEC.
Please contact this office reference permit application forms and
procedures. Thank you for your time and cooperation in this matter.
