Accivity Located in Beaufort
County, North Carolina
To Whom It May Concern:
The North Carolina Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 22 February 1994 pursuant
to Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon
our review, we have determined that the proposed activity is consistent with the
North Carolina Coastal Management Program provided the following conditions are
met.
1. The activity described in the above application qualifies to receive
one of the Nationwide Permits described in 33 CRF Part 330 with the
exception of Numbers 17, 21, 24 and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from
the North Carolina Division of Environmental Management.
This letter does not relieve you of the responsibility to ensure that all
other State authorization and/or permit requirements are met prior to
implementation of the project. Please feel free to contact me at (919) 946-6481
if you have any questions or need further assistance.

PUBLIC NOTICE
WEYERHAEUSER REAL ESTATE COMPANY, Post Office Box 1391, New Bern, North
Carolina 28563, has applied for renenwal and modification of a Department of
the Army (DA) permit TO CONSTRUCT MARINA FACILITIES AND CONSTRUCT AND BACKFILL
A BULKHEAD ON CHOCOWINITY BAY, CYPRESS LANDING, NEAR CHOCOWINITY, Beaufort
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during a site visit by a representative
of the U.S. Army Corps of Engineers. Plans submitted with the application
show the proposed installation of a floating marina system with 252 boatslips.
The system is to consist primarily of five (5) floating piers located in a
deep water, open basin area. Neither channel nor basin excavation is to be
necessary. Fueling and wastewater pump out facilities are to be installed. A
bulkhead, to be constructed in the marina area, is not to be aligned farther
waterward that two (2) feet from the normal water elevation contour. No
vegetated wetlands are to be excavated or filled. The purpose of the work is
to provide marina facilities for the residents of Cypress Landing Subdivision.
Plans showing the work are included with this public notice.
On September 11, 1989, the North Carolina Division of Coastal Management
(NCDCM) provided Slate authorization, a Coastal Area Management Act (LAMA)
permit, for the construction of a 302-boatslip, fixed pier residential marina.
On October 23, 1989, the Corps of Engineers (COE) agreed that this specific
work, authorized by the State, was consistent with the provisions and
objectives of general permit No. CESAW-CO80-N-000-0291. On August 31, 1992,
State authorization was renewed, and on February 8, 1994, the proposal was
modified and renewed authorization was provided by the State. The
modification provided for floating docks in lieu of fixed docks and reduced
the number of boatslips from 302 to 252. The permittee did not request
renewal or modification of DA authorization, which expired December 31, 1992.
The North Carolina Division of Coastal Management (NCDCM) has concurred
with the applicant's determination that the proposed work is consistent with
the North Carolina Coastal Zone Management Plan. The NCDCM has renewed and
modified a permit under the North Carolina Coastal Area Management Act (CAMA).
The North Carolina Division of Environmental Management (NCDEM) has
issued a Water Quality Certification pursuant to Section 401 of the Clean
Water Act.
I
-2-
The.applicant has applied to the North Carolina Department of
Administration (NCDA) and the North Carolina Council of State, for an easement
to occupy State-owned submerged land and applied to the Land Quality Section,
North Carolina Division of Land Resources (NCDLR), for approval of an Erosion
and Sedimentation Control Plan, pursuant to the State Sedimentation Pollution
Control Act of 1973 (NC G.S. 113 A-50-66). Renewal/modification of the
Department of the Army (DA) permit will be denied if any required State or
local authorization and/or certification is denied.
This application is being considered pursuant to Section 10 of the River
and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act
(33 U.S.C. 1344). Any person may request, in writing within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this site is not registered property or property listed as being eligible for
inclusion in the Register. Consultation of the National Register constitutes
the extent of cultural resource investigations by the District Engineer, and
he is otherwise unaware of the presence of such resources. Presently, unknown
archeological, scientific, prehistorical, or historical data may be lost or
destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
-3-
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.
The COE is soliciting comments from the public; Federal, State and local
agencies and officials; Indian Tribes and other interested parties in order to
consider and evaluate the impacts of this proposed activity. Any comments
received will be considered by the COE to determine whether to issue, modify,
condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water
quality, general environmental effects and the other public interest factors
listed above. Comments are used in the preparation of an Environmental
Assessment (EA) ,and/or an Environmental Impact Statement (EIS) pursuant to the
National Environmental Policy Act (NEPA). Comments are also used to determine
the need for a public hearing and to determine the overall public interest of
the proposed activity.
Written comments pertinent to the proposed work, as outlined above, will
be received in this office, Attention: Mr. Norm Sanders, until 4:15 p.m.,
March 4, 1994, or telephone (919) 975-3025.

Dear Mr. White:
Subject: Proposed fill in Wetlands or Waters
Road crossing
Brunswick County
DEM Project #94183
We have reviewed your request for 401 Water Quality Certification to
place fill material in 0.22 acres of wetlands or waters which are tributary to
Shallotte River for road crossing located at SR 1191 in Brunswick County as
described in your submittal dated 23 February 1994. Based on this review, we
have determined that the proposed fill is covered by General Water Quality
Certification No.2732. A copy of the General Certification is attached. This
Certification is necessary for coverage under Corps of Engineers' Nationwide
Permit No. 14. This action completes DEM's review under Section 401 of the
Clean Water Act. No lot fill shall be done from lots in this subdivision.
Deed restrictions shall be placed on all lots with jurisdictional wetlands
(draft copy enclosed).
If this Certification is unacceptable to you, you have the right to an
adjudi.catory hearing upon written request within thirty (30) days following
receipt of this Certification. This request must be in the form of a written
petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh,

Enclosed is a Nationwide Permit request by Weyerhaeuser Real
Estate Company in the Richlands Township, N.C. to fill .32 acres
of wetlands. A NWP 14 is proposed for crossing in the indicated
areas to gain access for a residential development. The land
planners have looked at the possibility of shifting the roadway
alignment to make use of the existing fill, however subdivision
plans call for a 55 foot wide vegetative buffer along this
property line.Planning in the remaining areas of the tract did
well to stay out of the reserved 404 areas considering the
dissection of the property.
Thank you for your timely response and should you have any
further questions, please feel free to contact me at your
convenience.
Sincerly,
