Preston Howard, Jr., P,E„ Director APPROVAL of 401 Water Quality Certification Mr. Michael Moore Roche Biochemical Labs. 348 South Main Street Burlington, N.C. 27215 Dear Mr. Moore: FILE COPY You have our approval to place fill material in 0.27 acres of wetlands or waters for the purpose of commercial development at York Court extension, as you described in your application dated 7 July 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. After reviewing the options for resolving the wetlands impact issue (see letter to your office dated March 22, 1994), we have decided to realign the proposed York Court extension to lessen the impact on the adjacent wetlands. The new alignment reduces the impact on the wetlands from 0.86 acres to 0.29 acres. It is our understanding that a submittal to your office will no longer be required as result of the wetlands impact being reduced to less than one third of an acre. It is our understanding that the following three options exist in order for this project to be approved. 1) To realign the proposed York Court extension so that the impact on the wetlands is 0.3 acres or less. 2) To leave the York Court extension alignment as originally proposed and construct a wet detention pond near the base of the delineated wetlands. 3) To realign the proposed York Court extension to lessen the impact on the wetlands from that of the original design and construct berms and check dams as necessary to ensure proper functioning of the wetlands. We have reviewed these options with the owner. They have requested that Piedmont Olsen Hensley meet with North Carolina Department of Transportation and review possible relocation of the proposed York Court extension so not to impact the wetlands. After this meeting we will notify you of the owner's decision on this matter and proceed as necessary. If you have any questions concerning the above, please let us known. Vice President Facilities Planning Roche Biomedical Laboratories 348 South Main Street Elizabethtown, N.C. 28337 Project # 94125 Dear Mr. Moore The Division of Environmental Management, Water Quality Section has reviewed your plans for wetland fill for 0.86 acres of wetlands at Roche Biomedical Labs in Alamance County for road access and stormwater drainage. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, streambank stabilization and pollutant removal. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to fill of these wetlands. Specifically can you construct your road by shifting it to the west to minimize impact. Piping of the stream through the wetland would not allow the wetland to filter runoff. Therefore this alteration would probably not be acceptable. Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to our Mr. Ron Linville at the Winston-Salem Regional Office at 8025 North Point Boulevard, Suite 100 Winston-Salem, N.C. 27106.
