Dear Ms. Lutheran:
On June 15, 2009 the Division of Water Quality(DWQ)received correspondence dated JNune 14,
2009 for the above referenced project. In addition,we received additional information and a plan
modification dated July 22, 2009 (received July 24, 2009). Please provide the following so that we may
continue to review your project. Your request is to modify the 401 Certification to allow 300 feet of bank
stabilization along one section of the northeastern bank from the existing powerhouse upstream into the
reservoir due to concerns about bank stability during water lowering of the reservoir.
Additional Information Requested:
1. A request for a modification of an issued 401 approval permit requires submission of the appropriate
fee($570 in this case) based on impacts.
2. Please submit five(5)copies of the final modified application on the most recent version of the
Preconstruction Notification form available on the Corps of Engineers website.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received
this letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact this office in writing. If we
do not hear from you within three weeks, we will assume that you no longer want to pursue this project
and we will consider the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not authorized
(at this time)by the DWQ. Please call Mr. John Dorney or me at 919-733-1786 if you have any questions
regarding or would like to set up a meeting to discuss this matter.
