We wrote to you on November 15, 2004 discussing concerns that we have regarding the design of the project and stating that it would be placed on hold for three weeks giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's earlier concerns are addressed. Once you have collected sufficient information to have a complete application (please see our November 15, 2004 letter for the missing information), you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. This information is in regar?,to your application dated September 20, 2004 to impact 148.9 feet of streams to construct the proposed residential subdivision. The DWQ has determined that this response was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested (3 copies): 1. Storm Water Management Plan Because this project lies within the Critical Area of a water supply watershed a complete storm water management plan is required (reference GC 3402, Condition 4 located for your convenience at http://h2o.enr.state.ne.us/ncwetlands/GC3402.pdf). This shall include extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed according to latest version of the NC DENR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan. While you may have met the City of High Point requirements, you must still meet the State's requirements. For example, the plant material you are proposing for the bioretention area must be a minimum of 2.5" caliper for trees and 3-4' height, 18-24" spread for shrub material (DENR 1999, p. 53). a. Please provide all calculations and a completed BMP worksheet for each storm water management device. b. Please enclose a signed and notarized Operation and Maintenance Agreement for the stormwater management BMPs (one original and two copies). You're letter looks fine. The only thing that I would add is that they appear to be reworking the existing pond as a stormwater pond. I think that GC3402 and the buffer rules would require them to convert this pond to a constructed wetland, bioretention or pond followed by a vegetative filter strip if they plan to incorporate it within their stormwater management plan and directly discharge through the buffer. It's also not clear to me why the pond is not buffered. We'll need to send this to the WSRO and possibly Scott Carpenter (DWQ Planning) once we have a complete application and before we send out any final approval. Generally the plan and buffer avoidance (except for one road crossing) looks good. Keep in mind that the locals should be doing the primary buffer review under their ordinance. - Bob Cynthia Van Der Wiele wrote: Bob, This one slipped thru. We received more info. on Oct. 15. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. The 254 units consist of 177 single family homes and 77 town homes. The impacts are due to stream crossinus for roadwavs, sewer lines and BMP outlet protection. 11. Explain the purpose of the proposed work: The purpose is to construct the roadways and utilities necessarv for a 254 Unit Subdivision IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. We have attempted to minimize the impacts as much as local development ordinance allows. The -Trades at the roadway crossing are as steep as allowed to minimize this crossing. We would have liked to have less impact by the Rip-Rap outlet protections but thev are attain required by the City for all pipe outlets. VIII. Mitigation Page 9 of 12 DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed.
