The attached materials describe additions proposed at this facility which
has been developing since 1981. The enclosed photo copies may be of some
help.
I am requesting that DEM review this request for any stormwater
management adjustments and fuel storage safety. Wildlife Resources should
address boating safety aspects of additional activity, i.e., fuel dispensing,
in this AIWW turn. The COE, having chosen to go to Notice, will do likewise.
Unfortunately, this office has caused for some loss of time, so a
response ASAP is requested. However, please give this important matter
careful attention. Your recommendations by February 14 would be appreciated.

Reference your application for Department of the Army authorization to
install floating boat docks and a marine fuel station at the intersection of
Carolina Beach Harbor, Snow's Cut and the Atlantic Intracoastal Waterway
(AIWW), north of Carolina Beach, New Hanover County, North Carolina.
My staff has completed public interest review of your plan, and I have
determined that issuance of a Federal permit, for your work as proposed, would
be contrary to the best interests of the general public. Your proposed
construction of a fueling dock on a rather sharp turn of the AIWW, in an area
of the AIWW which requires frequent dredging, and at the junction of three
heavily traveled channels, would constitute an undue hazard to safe
navigation. Accordingly, your Department of the Army application is hereby
denied, and your file has been retired.

answer any questions you may have or to assist you fn developing a revised

The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the proposed installation of approximately 685 linear feet of
docks, extending about 170 feet offshore. The docks are designed to reach to
within 85 feet of the near edge of the AIWW channel. The fuel facility is to
consist of three 4,000 gallon above-ground, pre-fab tanks, with built-in
containment, located on high ground approximately 450 feet from the AIWW, and
two dispensers with automatic cutoffs located on the proposed floating docks.
The purpose of the work is to provide a commercial fueling facility. Plans
showing the work are included with this public notice.
The work includes structures and their attendant utilities, on lands
subject to an easement in favor of the United States for the operation,
maintenance, improvement, and enlargement of the Atlantic Intracoastal
Waterway (AIWW). Accordingly, should authorization be provided, it will be
understood and agreed that the permittee will be required to remove such
structures and improvements at his own expense in the event that, in the
judgment of the Corps of Engineers acting on behalf of the United States, said
lands are needed at any time for any purpose within the scope of said
easement. Permanent buildings will not be constructed on lands subject to the
easement.

would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable

The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed

to determine whether to issue, modify, condition, or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment and/or an Environmental
Impact Statement pursuant to the National Environmental Policy Act. Comments
are also used to determine the need for a public hearing and to determine the
overall public interest of the proposed activity.

The requested DA permit will be denied if an required state or local
authorization and/or certification is denied. No DA Permit will be issued
until a State coordinated viewpoint is received and reviewed by this agency.
Recipients of this notice are encouraged to furnish comments on factors of i
concern represented by the above agencies directly to the respective agency,
with a copy furnished to the Corps of Engineers.
This application is being considered pursuant to Section 10 of the Rivet
and Harbor Act of 1899 (33 U.S.C. 403). Any person may request, in writings
within the comment period specified in the notice, that a public hearing bei
held to consider this application. Requests for public hearing shall state,
with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of they
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the Districts
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical!
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order i
11988), land use, navigation, shore erosion and accretion, recreation, wa er
supply and conservation, water quality, energy needs, safety, food and fifer
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the

This memo is regarding the enclosed request from Randall Bray,
representing Coquina Harbor, to modify State permit #13-81. This
project can be seen on 89 photo 178-13.
Attached is the request, stating the changes, a site map, and
scale sketches indicating the changes. The most pertinent attachment
is that labeled E1.
The request is to make three changes to the existing permit;
relocation of the proposed restaurant/shop, addition of service docks,
and the addition of fuel.

breakwater was permitted approximately 300' from the AIWW. The
floating dock structure will extend approximately 150' from this, and
as such should be greater than 85' from the AIWW.
The project area originally was classified as conservation but is
now classified developed in the updated Land Use Plan. The proposed
changes should pose no problems within this classification.

The new docking system incorporates approximately 5,600 square
footage of public trust waters. There is to be a main dock
approximately 185' in length, 8' wide. There will be seven fingers off
of these of varying lengths -165' 1001, 551, 601, 501, 351, 501. These
will serve as temporary dockage only to provide services to area
boaters.
On this dock there will be two fuel dispensers with automatic
cutoff. One will carry gasoline, the other diesel fuel.
The fuel storage tanks will be located in the south corner of the
basin, more than 75' from mean high water. There will be three 4,000
gallon tanks with built in containment, meeting all Federal, State, and
Local regulations.

The modifications we are requesting are as follows : ---• _ - --...- _
1. Relocation of restaurant, ships store, harbor master, and
visitor toilets to the north west corner of the existing
boat basin as shown on Drawing "E-1" dated 11-11-91, scale:
1"=60'.
2. No installation of additional stone rip rap (approximately
300 linear feet), as shown on Drawing "E-111, adjacent to the
existing stone rip rap to reclaim approximately fifty (50%)
to sixty (60%) of shoreline lost to recent erosion is
requested at this time.
3. Installation of new floating boat docks as shown on RBA
Drawing "E-1" (approximately 685 linear feet).
4. Installation of a marine fuel station consisting of the
following major components as per governing code and as
shown on RBA Drawing "E-1" :
a. Three(3) 4000 gallon above ground prefabricated tanks
with built-in containment, located approximately 450
feet + from AIWW as shown at an approximate grade of
12' above mean high water.
b. Two(2) dispensers with automatic cutoffs located on the
new proposed floating docks as shown at an approximate
grade of 1' above mean high water. One (1) dispenser
for marine grade gasoline and one (1) dispenser for
marine grade diesel fuel.
C. Two(2) automatic hose reels for each dispenser with 50'
of hose as shown.

The SC-Serles Storage Systems combine round or obround
tanks with rectangular secondary containment tanks. The
containment tanks are designed to contain 110% of the storage
tank capacity and Include a weather-proof flashing to keep
rainwater and debris out of the containment sections. Each
tank Is manufactured to Underwriter's Lab Standard UL-142'

. The SCP-Serles Includes'the same basic tanks as the
SC-Serles with the addition of an Integral pump stand. The
bolt-on stand will accept any standard dispensing pump and
features a removable front access panel for convenient pump
installation and maintenance. A 1 112" threaded pipe termina-
tion within the pump stand permits simple Interconnection to the
storage tank. These tanks are Ideal for storing and dispensing
a variety of liquids including kerosene and motor fuels.
