Wildlife Resources should address boating safety aspects of additional activity, i.e., fuel dispensing, in this AIWW turn. The COE, having chosen to go to Notice, will do likewise. Unfortunately, this office has caused for some loss of time, so a response ASAP is requested. However, please give this important matter careful attention. Accordingly, should authorization be provided, it will be understood and agreed that the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the Corps of Engineers acting on behalf of the United States, said lands are needed at any time for any purpose within the scope of said easement. No DA Permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of i concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 10 of the Rivet and Harbor Act of 1899 (33 U.S.C. 403). Any person may request, in writings within the comment period specified in the notice, that a public hearing bei held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of they National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the Districts Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical! data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order i 11988), land use, navigation, shore erosion and accretion, recreation, wa er supply and conservation, water quality, energy needs, safety, food and fifer production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. Attached is the request, stating the changes, a site map, and scale sketches indicating the changes. The most pertinent attachment is that labeled E1. The request is to make three changes to the existing permit; relocation of the proposed restaurant/shop, addition of service docks, and the addition of fuel. The project area originally was classified as conservation but is now classified developed in the updated Land Use Plan. The proposed changes should pose no problems within this classification. Page 1 of 2 t * The new docking system incorporates approximately 5,600 square footage of public trust waters. There is to be a main dock approximately 185' in length, 8' wide. There will be seven fingers off of these of varying lengths -165' 1001, 551, 601, 501, 351, 501. These will serve as temporary dockage only to provide services to area boaters. On this dock there will be two fuel dispensers with automatic cutoff. One will carry gasoline, the other diesel fuel. The fuel storage tanks will be located in the south corner of the basin, more than 75' from mean high water. There will be three 4,000 gallon tanks with built in containment, meeting all Federal, State, and Local regulations.
