Dear Sir or Madam: 1?_)' , 1911H 12,09 SUBJECT; 401 WATER QUALITY CERTIFICATION County, COE Project # ?C 1(o?i The Division of Environmental Management (DEM) received a letter from the Corps of Engineers (COE) stating that your project qualified for a Nationwide Permit. Please be advised that the Nationwide Permit is not valid until a 401 Water Quality Certification has been issued by the Division. General Certifications have been issue by the Division for most of the Nationwide Permits, however, several of the General Certifications require written concurrence from the Division before the Nationwide Permit is valid. Your utility line (Nationwide Permit # 12) requires written concurrence from DEM. Therefore, please complete the attached form (except for conditions 15 and 16) and send six additional copies (a total of seven copies) so that the review of your request can be initiated. If you have any questions, please call me or Mr. John Dorney at 919-733-1786. Sincerely, X? Eric Galamb Applic.12 cc: 0A'e_ ti DEM Regional Office Mr. John R.,Dorney P.O. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Northeast Creek Parkway NM 26 Project N . 92197 Wake County ?? 2. Craig Davis Properties NW 12 Project No. 92198 Wake County Item 1. This project has an existing nationwide permit which will expire before the project can be completed. This request is essentially for a new permit to extend the deadline for fill. The fill is to complete the road extension which has been started to Cornwallis Road. Approximately 1.1 acres of wetlands is to be filled. The wetlands have moderate value (rating by Howard Partner enclosed- rating numbers generally concurred with). The toe of fill will remain about 300 feet away from the channel of Northeast Creek. The fill is to be on a broad floodplain, nearly level. The main impacts are loss of wetland acreage and loss of flood volume storage during flooding stages. Water quality impacts should be minimal. There will be a large buffer of wetlands remaining between the new road and the stream channel. This area is characterized by level soils with dense cutover type vegetation. There are no meandering channels through here, so sediment and pollutant removal should be adequate. The RRO recommends issuance of the general certification with standard conditions. Item 2. This request is for general certification along with NW 12 for a sewer line about 200 feet long with a 25 foot wide easement, to tie into the existing sewer line adjacent to Northeast Creek. The soils in the area are moderately well drained floodplain soils adjacent to the stream channel and would not be considered "hydric". However, no impacts appear to be associated with this sewer line extension. The "wetlands" were not rated, but the floodplain has moderate value in pollutant removal. This value will remain. No other unique or outstanding features were noted with the site. The RRO recommends issuance of the general certification for the sewer line. „aANEo State of North Carolina Department of Environment, Health, and Natural Resources Division of Environmental Management 512 North Salisbury Street • Raleigh, North Carolina 27604 James G. If the proposed project will be removing pines greater than or equal to 30 years of age in pine or pine/hardwood habitat, surveys should be conducted for active red-cockaded woodpecker cavity trees in appropriate-habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees found, the project has the potential to adversely-affect the red-cockaded woodpecker, and you should contact this office for further information. The Service concurs that the proposed project is not likely to adversely affect Federally-listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for Federal listing under the Endangered Species Act, as amended. Staffing limitations prevent us from conducting a field inspection of the project site. Therefore, we are unable to provide you with site specific recommendations at this time. Questions regarding the enclosed information should be directed to the Corps of Engineers, regulatory staff member who is handling this project. 6LA?L 4rile- Al 13 Biolog t Date CONCUR: ( T L_ Endangered Spe Date Coordinator
