HomeMy WebLinkAbout19890235 Ver 1_Complete File_19890101NOTICE OF FILING OF APPLICATION FOR CAMA MAJOR DEVELOPMENT PERMIT AND WATER QUALITY CERTIFICATION The Department of Natural Resources and Community Development hereby gives public notice as required by NCGS 113A-119(b) and 143-21'5 3(a)(1)(c) that PHILIP OLEAR of Salvo, N.C., filed an application on May 15, 1989, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According .to said application, PHILIP OLEAR proposes to construct 250' of bulkhead, a 15' X 20' boat ramp and a 5' X 10' pier with mooring piles located ,on lots 373, 374, 375 Snug Harbor Drive,-Brigands Bay, Buxton, Dare County, N.C. A copy of. the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Robert Abernethy, Division of Coastal Management, located at Route 6, Box 203, Elizabeth City, N.C., (919) 264-3901, and/or the office of Deborah Sawyer, Division of Environmental Management, NRCD Regional Field Office, Washington, N.C., 27889. The Division of Environmental Management proposes to take final action on this water quality certification on or before July 4, 1989. The issuance of the LAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted, and subsequent hearings that,may result. All persons desiring .to make comments should do so in writing to Mr. George T. Everett, Director, Division of Coastal Management, P.O. Box 27681, Raleigh, N.C., 27611, prior to June 24, 1989 for consideration in the CAMA permit decision,.ahd to Mr. Bill Mills, Division of Environmental Management, P.O. OLEAR BIO REPORT PAGE 2 BIO REPORT, The applicant currently owns 3 lots in Brigands Bay subdivision, Dare County. These lots are entirely upland and dominated by yard grasses and live oaks. A thin fringe of marsh is found along portions of the shoreline. This fringe, up to 3' wide at one point, totals 10 sq. ft. of Juncus roemerianus, 4 sq. ft. of Distichlis spicata and 10 sq. ft. of Spartina alternif lora. The ;applicant proposes to bulkhead 250' of estuarine shoreline an average of 1' waterward of NWL and construct a 15' X 20' boat ramp and a 5' X 10' pier and mooring piles. ANTICIPATED IMPACTS This project will result in the filling of 24 sq. ft.: of coastal marsh scattered along 250' of shoreline in a fringe up to 3' wide. The project will also result in the dredging or filling of 550 sq. ft. of shallow water habitat. Some localized short-term turbidity will result from this construction.
