PROJECT DESCRIPTION: The applicant proposes the addition of an

The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will not require a 401 Water Quality
certification.
2. The proposed project should be done in such a way as to not

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.

9 CERTIFICATION AND PERMISSION

The project will be subject to conditions and restrictions
contained in the permit.
I certify that to the best of my knowledge, the proposed
activity complies with the State of North Carolina's ap-
proved Coastal Management Program and will be con-
ducted in a manner consistent with such program.
I further certify that I am authorized to grant, and do in
fact, grant permission to representatives of state and
federal review agencies to enter on the aforementioned
lands in connection with evaluating information related
to this permit application and follow-up monitoring of
project.

dock to his previously permitted 312 square foot fixed dock. The project will
extend past the 4' mlw contour.

9. PROJECT DESCRIPTION
The project site is located in Swann Plantation, at Lot 5, Section 4, West
Gooseneck Road in Pender County, North Carolina. This is a new residential
subdivision adjacent to the Northeast Cape Fear River. The size of the lot is
1.38 acres. The upland portion of the lot is 25' above mean sea level, and
vegetated with typical upland species. The applicant plans to put a house on
this portion at some future date. The property drops rapidly to a very healthy
"404" wetland area vegetated with Taxodium distichum, Saururus cernuus,
Peltandra virginica, Pontederia cordata, Acer rubrum, Liquidambar styraciflua,
Nyssa sylvatica, Decodon verticillatus, Boehmeria cylindrica, and various other;
"404" type wetland species. At the edge of the swamp, the property joins the
Northeast Cape Fear River. At this point, the river is approximately 600'
wide. There is no shellfish resource in the area. The river is designated a
Primary Nursery Area by the Division of Marine Fisheries. The waters are
classified C-swamp by the Division of Environmental Management. The
classification of the area is Transitional according to the Pender County Land
Use Plan.
The only structure presently existing on the site is a previously permitted
elevated walkway from the high ground, through the "404" area, adjoining a 312
square foot dock.
The proposal is to add an 80 square foot floating dock (10' x 8') to the fixed
dock connected by a 10' x 5.5' ramp. The total square footage of both docks
will be 392 square feet. The structure sits entirely within the applicant's
riparian corridor, and more than 15' from the neighboring corridors. The
farthest waterward point of the structure will be 33', well short of 1/3 the
distance across. The depth of the water at this point varies from 6'-8' deep
at mean low water. It is for this reason that a major permit is required. The
project is for private residential use.
10. ANTICIPATED IMPACTS
The project will incorporate an additional 80 square feet of Public Trust
waters to the already existing 312 square foot structure.
