The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project is apparently not considered
a marina since more than 10 boats are not be
docked. Should the proposed project become a
marina, it will be necessary to review the project
again for consideration of Antidegradation Policy
violations.
b. In no case should any discharge of sewage be
allowed overboard from boats docked in the area.
The applicant should be required to post signs on
the docks advising that overboard discharges are
prohibited. There should be no live-aboards
allowed at this dockage.
C. Our records indicate that the stream, Clubfoot
Creek, is classified "SA" and currently closed to
shellfishing.
d. The proposed modifications will not require a 401
Water Quality Certification.

Review of the subject CAMA application shows the applicant's proposal to
construct a pier with a 10-slip capacity at end. Please emphasize to this
applicant that the addition of even one slip must be reapplied for and reviewed
by the respective agencies. Any addition could result in anti-degradation
regulations being violated, and this office would recommend that the application
be denied.
Please emphasize also to the applicant that good operational modes should be
employed such as pump out facilities and no live-aboards. The receiving stream
for this project is classified as SA waters and poor operational modes may
contravene water quality.

8. PROJECT SUMMARY: The applicant proposes to increase the length of
the 50' permitted pier by 100' with a T-head latform 46'x6' and
construct 10 slips at Plantation Harbor S/D, in Clubfoot Creek,
Craven County -

9. NARRATIVE DESCRIPTION: Mr. Jerry Jackson was issued State
Permit #243-88 in December of 1988. The permit authorized
the development of a community access site within Plantation
Harbor Subdivision, located near the Town of Harlowe, off
Hwy. 101 and SR 1700 (the Adam Creek Road), on Clubfoot
Creek, in Craven County. The permit allowed for the
construction of a concrete boat ramp and an access pier
measuring 6' wide x 50' long.
Mr. Jackson now proposes to modify the permitted pier by
extending the overall length by 100' which includes a T-head
platform measuring 46' x 6' wide. The modification plans
also call for the construction of 10 boat slips, 7 on the
south side of the pier, and 3 on the north side. The
prevailing water depths in this area of Clubfoot Creek are
shown to be a constant -4' on MLT. The applicant has also
indicated that the opposite shoreline is some 500' west of
the proposed 150' long pier.
10. ANTICIPATED IMPACTS: As the review agencies are aware, 10
Boats, or boat slips, are significant since the LAMA 7H Use
Standards define a marina as any place with more than 10
boats. The observation is also made that the size and
configuration of the proposed pier and slips would allow the
construction of at least 3 more slips on the north side of
the pier. Although 13 boat slips would make the project
technically a marina, it is doubtful that the impacts would
be appreciably greater than the potential problems of the
proposed 10 slips.
The proposed pier and slips will occupy a footprint print
value of 1,293 sq. ft. over the public trust surface waters
of Clubfoot Creek. The shoreline length of the community
access site has approximately 100 ln. ft.. If necessary,
the proposed pier can comply with the 27 sq. ft. formula for
marina pier construction as found in Subchapter 7H. The
attached map shows that the surface waters of Clubfoot Creek
are classified as 'SC', and are closed to the harvesting of
shellfish.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a. copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project. -:An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 Y2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7j.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application -to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).
