Signature of Permittee River Bend Marina ADDITIONAL CONDITIONS Permit #23-05 Page 2 of 4 4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) This permit authorizes a maximum of 102 boat slips. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Boat Ramp 11) During the construction of the expanded boat ramp, protective measures shall be undertaken to ensure that live concrete does not contact waters of the State or waters that will enter waters of the State. 12) All materials resulting from the demolition of the old recreational facility building shall be properly disposed of at an approved upland disposal site. Upland Development 13) This permit authorizes only those upland development activities that are specifically referenced in the attached permit application and workplan drawings. Any proposed alterations to the approved upland development plan shall require additional authorization from the Division. River Bend Marina ADDITIONAL CONDITIONS Shoreline Stabilization Permit #23-05 Page 3 of 4 14) The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 15) The bulkhead shall not extend waterward more than 2 feet from the normal water level at any point along its alignment at the time of construction. .16), The bulkhead shall be constructed prior to any backfilling activities. 17) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 18) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or. other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 19) The fill material shall be clean and free of any pollutants except in trace quantities. 20): All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Stormwater Management 21) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW7040820, which was issued on 2/8/05. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Erosion & Sedimentation Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. If required, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, A) 943 Washington Square Mall, Washington, NC 27889. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading. River Bend Marina Permit #23-05 Page 4 of 4 ADDITIONAL CONDITIONS 23) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 24) The permitted activity shall be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. General 25) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 26) This permit does not authorize the excavation or filling of any vegetated wetlands. 27) This permit does not authorize the excavation of any open water area. 28) Prior to construction of any portion of the fuel dispensing system, the permittee shall obtain any and all required approvals for such facilities. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Any development or land disturbing activity that is considered non-water dependent is not authorized within 50 feet of the normal high water level unless specifically exempted by Environmental Management Commission (EMC) Neuse River buffer regulations in place at the time of such development. Contact the Division of Water Quality at 252-946-6481 prior to the commencement of any such activity to determine additional permit requirements. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. NOTE: The N.C. PROJECT SUMMARY: The applicant proposes to redevelop/expand the River Bend Marina docks, construct 500' of bulkhead, expand the boatramp and redevelop the high ground including construction of a new ship's store, asphalt drive and parking. FIELD INVESTIGATION REPORT: BERIT PECK/CRAVEN COUNTY PAGE #2 ------------------------------- 9. NARRATIVE DESCRIPTION Project Setting The applicant owns the 2.2-acre tract of land known as the River Bend Marina, off Marina Drive at Shoreline Drive, on Plantation Canal, in the Town of River Bend, Craven County, North Carolina. The property is a corner tract of land adjacent to Plantation Canal and Channel Run Canal, both man-altered systems. The property has approximately 500' of shoreline abutting Channel Run Canal. The current marina has some 80 slips based on a fixed dock that extends 136 feet out into Plantation Canal along the southeast side of the property and which extends southwest for approximately 408'. The docking facility actually extends out in front of the Pier Pointe Property Owners Association property (a condominium complex). The docks extend some 160' out into the water of the 202' to 214' wide Plantation Canal. It is my understanding that the marina and condominium complex were developed by the same owner in phases. There is an existing asphalt drive that leads to a 28'-wide boatramp out into Channel Run Canal along with a 6' wide dock that runs north for some 120'. Several small derelict piers extend out into the canal along this stretch of shoreline. There is also a graveled parking and two-story 3,277 ftZ building on the site. A wooden walkway leads from the building to the water where there is a derelict bulkhead. There is very little vegetation on the tract except for a few trees along the shoreline. Channel Run Canal is approximately 169' in width at its narrowest point along this stretch of canal. Water depths along the outside of the Plantation Canal docks are -6.5' below NWL while water depths inside the docks average -3.5' to -4'. The water depths along the docks on Channel Run Canal are between -2.5 to -5' below NWL. There are no wetlands on the site and the adjacent waters are classified as SC Sw NSW and are closed to shellfishing. There were no SAVs observed at the site and the area is not a designated Primary Nursery Area. Project Description The applicant proposes to redevelop/expand the River Bend Marina by replacing the old fixed docks with pre-fab floating docks creating 78 slips and by adding 400 linear foot of fixed docks (in two sections) along Channel Run Canal, creating another 24 small boat slips. The applicant also proposes to install/replace 500' linear feet of bulkhead at a distance of 2' waterward of the NWL, to demolish the old "Oar House" recreational facility, to build a new 28' tall 50' X 100' "Ships Store" and snack area with a 12' X 46' deck, and to widen the existing 28'-wide boatramp to 34' in width. The existing gravel drives are proposed to be resurfaced with asphalt and a new 6' X 38' concrete walkway is proposed to be constructed waterward of the new building. A 4'-wide wooden walkway would lead from the building to the boatramp. The application indicates some 39 asphalt parking places. The 8'X 540' "L" shaped floating dock along Plantation Canal would be installed within the same footprint as the old docks. There would be forty-one 4' X 20' finger piers creating the 78 slips along this dock. The 8' X 175' fixed dock north of the boatramp includes six 4' X 20' finger piers delineating 10 slips and includes an 8' X 40' platform with pumpout facility and signage. The 8' X 205' fixed dock to the south of the boatramp would include eight 4' X 20' finger piers delineating 14 additional slips. A total of 102 slips would be created by the development. INVESTIGATION REPORT: BERIT PECK/CRAVEN COUNTY PAGE ##3 Anticipated Impacts As proposed, the rebuilt floating docks and new fixed docks would usurp approximately 33,444 ft2 of Public Trust Waters with approximately 10,472 ft2 of that amount being shaded. The demolition of the old "Oar House", the grading and resurfacing of the gravel drives and parking would disturb another 24,052 ft2 of high ground. The percent imperviousness of the tract within 75' of the NWL would be approximately 16% or 6,115 ft. This would include the asphalt drive to the boatramp, a section of the parking area, the boatramp itself, the concrete walkway, and a concrete slab for the dumpster. It appears that the "Oar House" deck, walkways, and part of the asphalt drive encroach slightly into Zone 2 of the Neuse River Basin buffer rules. Approximately 90 ft2 of shallow Estuarine Waters would be lost as a result of the widening of the boatramp with another 1,000 ft2 lost with the construction of the 500' linear foot of bulkhead. Approximately 7,500 ft2 of high ground within the Coastal Shoreline would be disturbed as a result of the installation of the tie-backs for the bulkhead. Some trees along the shoreline would be removed during bulkhead cnstruction. The floating docks along Plantation Canal would usurp less of a footprint than the existing fixed docks - but would extend out the same distance some 3/4 the width of the canal. The fixed docks along Channel Run Canal would extend some 1 /6 the width of the canal. There would be some minor increases in turbidity during the construction of the docks. A makeshift coffer dam would be constructed to ensure that no raw concrete reaches the open water during construction. According to the application, stormwater issues would be treated using the "Best Management Practices" (BMPs). RIVERBEND MARINA UPGRADE NARK AnVE V In general this project is to renovate the existing structures. The existing marina boat slips are to be removed and replaced with floating docks. The existing access driveways will be asphalt paved. Stormwater will be treated wing the "Best Management Practices" (MV). The bulkheads are currently in very poor condition and will be replaced. Replacement of the bulkheads will necessitate the removal of a few trees at the water's edge near the existing boat-ramp. Trees will be planted in accordance with the Town Ordinance. The existing boat-ramp will be rel-xired and widened to 34 feet to allow two boats to launch or load. The existing building, formerly known as the "Oar House," served as a recreational facility for twenty years. It was constructed in June of 1982. It currently needs extensive repair and will be replaced. At present the total area, "footprint," for the existing marina docks (to be removed) is 24,670 ftz. The area of the new floating docks, "footprint," is 21,714 1 The area of the new slips along the fi•ont of the existing Oar House would be 9,236 fl. The new docks, as proposexi, would be constructed within the area, which is now occupied by the existing piles and finger 'piers. (i.e. as/the areas given above the new docks will occupy 2,956 ?2 less area.) The new bulk-heading will be approydntately 500 f3. in length. Some trees will be removed where necessary to place new bulk-heading. The amount of soil to be disturbed would be minimal, dependant upon the type of tic; backs used. The Oar House will be replaced with a building that will be a one story structure with a "Ships Store" and snack area. The existing Oar House is presently encroaching on the buffer zone by approximately 15 ft (1125 ft2). The new building will be located such that it will not encroach on the buffer zone.
