Director Division of Water Quality September 26, 2006 Mr. Donald Escobal 1032 Randolph Court Cary, NC 27511 Subject Property: 105 Rosenberry Hills Drive, Wake County, NC UT to Crabtree Creek [030402, 27-33-(10), C NSW] DWQ # 06-1516 Wake County AUTHORIZATION of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0233(9)(b)] with ADDITIONAL CONDITIONS Dear Mr. Escobal, You have our authorization, in accordance with the conditions listed below, to impact 375 (ft) of Zone 2 of the protected buffers to construct the proposed home on the subject property as described within your variance request dated September 13, 2006 and received by the Division of Water Quality (DWQ) on September 18, 2006. This letter shall act as your Minor Variance authorization as described within 15A NCAC 213 .0233(9)(b). In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control. This authorization is only valid for the purpose and design that you described in your Minor Variance Request dated September 13, 2006. If you change your project, you must notify us and you may be required to send us a new request for authorization. If the property is sold, the new owner must be given a copy of this authorization and is thereby responsible for complying with all conditions. For this authorization to be valid, you must follow the conditions listed below. No impacts (except for "exempt" uses as identified within 15A NCAC 213 .0233) shall occur to Zone 1 of the protected riparian buffers. 2. Stormwater (final plan needed) The final, written bio-retention plans must be submitted and approved by DWQ prior to construction. The plans should be submitted to 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Your plans must be implemented and the stormwater management facilities shall be constructed and operational before any permanent building is occupied at the subject site. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Authorization Certificate. 4. Certificate of Completion Upon completion of all work approved within this Buffer Authorization, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 5. Buffer Mitigation (On-site Restoration/Enhancement) - You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 375 square feet as required under this variance and 15A NCAC 2B .0233. The DWQ has determined that the plantings of trees you propose will satisfy this mitigation requirement as long as you plant at least 3 trees within the retained portions of the protected buffers. You must ensure their survival for a period of at least five (5) years. You are required to replace any of these trees that die within this five (5) year period. You are required to provide proof in writing that the trees have been planted within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit. If this mitigation is not acceptable or practicable, then you may choose to make a payment in to the Riparian Buffer Restoration Fund to compensate for 42 square feet of mitigation as allowed under 15A NCAC 02B .0233. If you choose to make this payment, please contact the Wetlands/401 Unit at 919-733-1786 for additional information. If you do not' accept any of the conditions of this authorization, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This authorization and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules [15A NCAC 2B.0233(9)(b)]. The home that I intend to build following all boundary specifications will use approximately 375 square feet of zone 2 (see PDF document) 3. Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): Only minimal clearing will be used enough to build the home and provide for a backyard. will use a bioretention area or a rain garden to control the storm water. I will also arrange for at least four native trees to be planted immediately after the home is constructed, before a certificate of occupancy is issued. 4. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. No home can be built on the lot if the rule is strictly applied since the entire lot sits on a riparian buffer where approximately 35% is on a zone 1 and the rest on zone 2 and 3 (2) How these difficulties or hardships result from conditions that are unique to the property involved. If we don't build part of the home in zone 2, 1 will need to use home plans that is either too narrow or too unconventional. The home will need to be in a concave shape to avoid encroaching into zone 2. It will be cost prohibitive to customize a concave design home. Also, this shape of home will most likely not be approved by the Home Owner's Association since all of the homes in the neighborhood are rectangular in shape. Part 3: Deed Restrictions By your signature in Part 5 of this application, you certify that all structural stormwater best management practices required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot. I will consult with the land surveyor as to where to best place the retention area after he or she has thoroughly evaluated the land. I will also arrange for at least four native trees to be planted and fertilized within the land after the home is constructed. The tree type will be maple, and will most likely be located near the vicinity of the bioretention area. I will consult with the land surveyor as well as where to best plant the trees. I've temporarily marked proposed tree planting areas in the attached map subject to finalization. If the minor variance is approved, I will submit to the NC Department of Water Quality the plans for both the bioretention area, as well as the tree planting requirement prior to any clearing activity.
