James Street, Lillington, NC 27546 Authorizing development in Carteret County at Bogue Sound, 318 Easy Street, Cape Carteret , as requested in the permittee's application dated 3/10/06 (NIP-1), 3/31/06 (MP-2), & 3/27/06 (MP-4) including the attached workplan drawing (1), dated revised 3/31/06 This permit, issued on July 11, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) Excavation shall not exceed =3.5 feet below the normal low water level. In'no case shall the depth of excavation exceed the depth of connecting waters. 2) No excavation shall take place outside of the area indicated on the attached workplan drawing. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4) An earthen plug shall be left between the inland basin and the man made canal until all excavation activities landward of the plug has been completed. In order to prevent sedimentation in adjacent waters, 24 hours should be allowed to elapse before the plug is removed. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on Signed by the authority of the Secretary of DENR and the Chairman of the Coastal Resources Commission. Cha s . Signature of Permittee ^- l Tim Stephens ADDITIONAL CONDITIONS Shoreline Stabilization Permit #108-06 Page 2 of 4 5) The alignment of the permitted bulkhead shall be staked by the permittee and approved on-site by a representative of the Division of Coastal Management. 6) The bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 8) A silt fence shall be properly installed immediately landward of the bulkhead cap immediately following -completiorrof backfilling activities.-- 9) The bulkheads shall be solid and constructed of treated wood, concrete slabs, metal.sheet piles or other suitable materials approved by Department personnel. 10) 'No backfill material shall be placed within 30 feet of the normal high water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 12) The fill material shall be clean and free of any pollutants except in trace quantities Spoil Disposal 13) Any change in the location of the spoil disposal area shall be approved by a representative of the Division of Coastal Management prior to the initiation of any excavation.activities. 14) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 15) No spoil material shall be placed within 30 feet of the normal high water line. Docking Facility 16) The boat lift pilings shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 17) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. f -"ii, Tim Stephens Permit #108-06 Page 3 of 4 ADDITIONAL CONDITIONS 18) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 20) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of.this permit. The permittee is not relieved of this requirement if he abandons the permitted activity -.without having it transferred to a third party. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. General 22) All disturbed areas, including, the disposal area, shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 23) All material resulting from the removal of the existing pier shall be placed on an approved upland disposal site. 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 25) The West Indian Manatee (Trichectts rnnriatus), which is listed as a federally endangered species, has been reported in North Carolina waters. In order to protect the `'Vest Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which may Be Used by the West Indian Manatee in North Carolina" shall be followed. fflilk. 1. Director Division of Water Quality DWQ Project # 060648 Carteret County You have our approval, in accordance with the attached conditions and those listed below, to excavate 140 square feet of Coastal Wetlands and to maintenance dredge 600 square feet of open water for the purpose of constructing a 130' bulkhead, a 18' x 28' boat basin and a boat lift at the subject property, as described within your application dated March 27, 2006 and received by the N.C. Division of Water Quality (DWQ) on April 13, 2006. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number 3400 (WQC 3400). The Certification allows you to use the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CANIA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the --Certification-occur.-Tharnitigation plan must be tmptemented-andfor constructed-- - - before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 5. Compensatory stream mitigation shall be required at a 1:1 ratio for not only perennial but also intermittent stream impacts that require application to DWQ in watersheds classified as ORW, HOW, Tr, WS-I and WS-II unless the project is a linear, publicly- funded transportation project, which has a 150-foot per-stream impact allowance; 6. Impacts to any stream length in the Neuse and Tar-Pamlico River Basins (or any other major river basins with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) requires written concurrence from DWQ in accordance with 15A NCAC 2B.0200. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar- Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; 7. All sediment and erosion control measures placed in wetlands or waters shall be removed and the original grade restored after the Division of Land Resources has released the project; 8. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 9. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 10. Measures shall be taken to prevent live or fresh concrete from coming into contact with freshwaters of the state until the concrete has hardened; 11. Additional site-specific conditions may be added to projects which have applied for CAMA major permits which are proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 12. When written concurrence is required, the applicant is required to use the most recent version of the Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 13. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding General Permit 198000291, whichever is sooner. Narrative Description: The project is located at 318 Easy St. located in the Town of Cape Carteret, Carteret County. Easy St. is located by turning onto Bayshore Dr. off of W.B. McLean Rd.(Hwy. 24). A left is then taken onto Edgewater Ct. which dead ends into Easy St. A man made canal off of Bogue Sound borders the property to the west. Mr. Stephens lot is 13,178ft2 in size and averages 4' above mean sea level. Currently there is a single family home on site with all utilities existing. Currently there is no shoreline stabilization. A small dock extends off of the shoreline but will be removed. The high ground is landscaped with various shrubs and. upland grasses. North of this lot is a single family home. To'the south is a single family home with a basin and boatlift in place. There is a 3'-5' fringe of Smooth Cordgrass(Spartina alterniflora) present along the shoreline of the subject property. The canal js ±30 ft wide at this location. The substrate of the canal is sand and mud. The Town of Cape Carteret's Land Use Plan classes this area as Urban Transitional and all associated AEC's as Conservation. The N.C. Division of Water Quality designates Bogue Sound as SA Waters, with the subcategory of Outstanding Resource Waters. This canal is not a primary nursery area as designated by the NC Division of Marine Fisheries. The canal is closed to the taking of shellfish for consumption. There are no disclosed archaeological sites on the property. 10. Proiect Description: The applicant has applied to excavate an 18'X28' boat basin from high ground and maintance excavate an area 21'X30' from a man made canal. This would involve cutting through a thin fringe of Coastal Wetlands. The shoreline would be stabilized with a 130' bulkhead. A 13'X13' boatlift would be placed in the basin The excavation of the 18'X28' basin would involve the removal of 75 yd3 from high ground. Maintance excavation in the canal would involve the removal of 35 yd3 from below NHW. Current soundings within the canal range from -.1' to -3.6' at NLW. The boat basin would be excavated down to the connecting water depth -3.5'NLW. This would be accomplished with an excavator from shoreline. Spoils will be deposited onsite at a distance of 30' landward of NHW. The area available for spoils is 1,528 ft. The applicant proposes to stabilize the shoreline with a 130' bulkhead. The bulkhead would be built landward of all remaining Coastal Wetlands. Once the shoreline has been stabilized a 13'X13' boatlift would be placed in the basin 11. Anticipated Impacts The proposed maintance excavation would disturb 600 ft' of shallow bottom habitat and cause a temporary increase in turbidity. The proposed basin would involve the removal of 140ft2 of coastal wetlands and 336ft, of high ground. A silt fence would be placed around the spoils to prevent runoff to adjacent Coastal Wetlands and Estuarine Waters. The boadift would incorporate 169ft2.
