attached conditions and your submitted plans, and those conditions outlined in the attached December 4, 2006
NC Wildlife Resources Commission letter. Any violation of the attached conditions or deviation from your
submitted plans may subject the pemrittec to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide autlorization
is modified, suspended ur revoked. If, prior to the expiration date identified below, the nationwide permit
authorization is reissued and~or modified, this vet7ficatior. will remain valid until the expiration date identified
below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with
the teens and conditions of the nationwide permit, activities which have conunenced (i.c., are under construction) or
are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity
is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation,
unless discretionary authority has been exercised on a t:ase-by-case basis to modify, suspend or revoke the
authorization.

John and Sue Gouse requested a 404 Permit from the U.S. Army Corps of Engineers. I reviewed the
application and am familiar with the project area. Comments from the North Carolina Wildlife Resources
Commission (Commission) are provided under provisions of the Clean Water Act of 1977 (33 U.S.C. 466
et seq.j and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d},

T11e Commission is concerned about the adverse effects of some shoreline stabilization on aquatic and
:akeshore habitats. Therefore, the permit should be conditioned as follows to help conserve resources:
1. The project must address an active and appreciable shoreline erosion problem; relatively stable
shoreline areas should not be altered.
2. The proposed project must comply with Duke Energy's Shoreline Management Guidelines and
receive approval from Duke Energy Lake Management.
3. If practical, the stabilization work should be completed ir. a dy work area while the lake is drawn-
down.
4. Adequate sedimentation and erosion control measures must be used to minimize the loss of disturbed
soils into the lake. "temporary or permanent herbaceous vegetation should be panted on all bare soil
within fifteen. (15) days of ground disturbance.

5. Excavation of the lakebed is not authorized except for the explicit purpose of placing and anchoring
the rock in the lakebed. This permit dues not authorize disturbance of the shoreline or the lakebed
outside ol'the stabilization limits for access or staging of materials.

7. Filter fabric should be installed behind the rock to minimize wash-out.
8. The rock used shoul;i be large quarry (class 1T or Iargerj ur simiIar angular stone that is free of
sediment and other contaminants.
9. If a vertical wall is part of the,stabilization, additional rock should be placed at the base or toe of the
lakeward side of the wall to prevent undercutting and to enhance fish habitat.
10. The spaces between the racks should not be filled with concrete or other types of grout, but should be
left open to allow native plants to grow and to provide cover for fish and wildlife. Uncured concrete
is toxic to fish and other aquaric life and is not authorized by this permit.
11. If temporary access across the shoreline buffer is granted, the vegetation should be cut oti at the
ground and the stumps and roots left intact to sprout or the arcs should be replanted with native
vegetation. Areas altmg the shoreline without woody vegetation or where ii must be removed for the
project s}rould be platlted with native trees (e.g., hemlock, *ulip poplar, and sycamore) and shrubs
(e.g., silky dogwood, rhododendron, mountain laurel or dog hobble).
12. The height of rock stabilization should typically be no more than a few inches above the normal pool
elevation. However, a greater height maybe acceptable, as determined by a Uuke Energy
representative, if the erosion extends above the normal pool elevation. in these cases, backfrlling
should be minimized (e.g. rock placed as close to eroded shore~ine as possible j and mimic the nariuai
shoreline slope, If a stacked wall is used, the rock should beset slightly Iakeward to minimize
disturbance of vegetation on the bank. Voids around trees with exposed roots should be backfiIled
with soil.
