8. PROJECT SUMMARY:
The applicants propose the development of 358-linear feet of bulkhead to connect to 500-linear feet of
bulkhead currently being constructed under a CAMA general permit and a 6-slip "L" shape pier structure
extending 234 linear feet into Perquimans River, Durant's Neck community of Perquimans County.
PROJECT SETTING
The location of the proposed development site is along approximately 868 linear feet of Perquimans River
shoreline off Hoyle Jones Rd. (SR 1322), Durants Neck community of Perquimans County. The Moorings
at Albemarle, LLC is afive-member limited liability company (LLC), which owns a total of approximately
100 acres including a residential lot with two mobile homes and four agricultural fields separated by Hoyle
Jones Rd. (SR 1322), Cross Neck Rd. (SR 1321), and Muddy Creek Rd. (SR 1321). The co-applicants,
Woodie and Freda Walker, at 174 Long Beach Drive, Long Beach Estates Subdivision, are located
immediately west of The Mooring's at Albemarle, LLC's 12.37-acre farm field.
The Walker's property is less than one acre in size and has an existing wood bulkhead, pier structure, single-
family dwelling, garage, and deck. A community/roadway drainpipe outflows into the Perquimans River
from a 5-foot tall bank in close proximity to the Walker's property line with The Moorings at Albemarle,
LLC property, and has been maintained and stabilized with rock riprap since the 1960's, when the
subdivision was created. The Shores at Albemarle, LLC were issued CAMA General Permit #A46333 on
October 18, 2006, and a complete reissue General Permit #A46845 on January 19, 2007 for the construction
of a wood bulkhead average 2-feet, maximum 5-feet waterward normal water level (NWL), to tie into the
Jones' bulkhead wingwall to the southeast and extend SOO linear feet down the shoreline. The entire 858-
feet of The Moorings at Albemarle, LLC shoreline has an approximate 4-feet to 5-feet tall escarpment
leading down to a 5-feet to 15-foot wide sandy beach to Perquimans River. The Moorings at Albemarle,
LLC property at the development site consists of a woods adjacent the Walker property, a 12.37-acre
cultivated soybean field, a small woods along the shoreline, and a yard with two mobile homes, septic
system, well, and outbuilding. The woods consist of a variety of native trees and shrubs such as Loblolly
Pine (Pinus taeda), Sweetgum (Liquidambar styracijlua), Red Maple (Ater rubrum), Mimosa (Albizia
julibrissin), and Wax Myrtle (Myrica cerifera). There are several decaying trees in approximate 1-foot
water depth scattered from the woods to the Walker property. There are no Section 404 or coastal wetlands
located in the proposed development areas of the properties.
Currently, both riparian properties to the east and west have bulkhead shorelines with piers and single-
family dwellings with outbuildings. The Moorings at Albemarle, LLC sandy beach shoreline is
approximately 100 feet landward of the bulkhead riparian shoreline to the east and approximately 150 feet
landward of the bulkhead riparian shoreline to the west. Since the 1980's, the Moorings at Albemarle, LLC
property has most likely experienced accelerated erosion due to its location between two long stretches of
bulkhead shoreline and approximate 10 mile fetch at the mouth of the Perquimans River across Albemarle
Sound.
The erosion along the shoreline has created a hard, sandy shallow water bottom, reaching approximately
-2-feet water depth 100 feet waterward of NWL. Water depths at the waterward end of the proposed pier
structure and in the slip areas is approximately -2.5 feet during normal water level conditions. The bottom
remains hard and sandy in the slip areas. The water depth in the bulkhead backfill area is approximately
-1.5 feet. The shallow water shoreline was sparsely populated with Rangia clams on January 11, 2007, and
no rooted submerged aquatic vegetation (SAV) was observed. There were, however, a sparse amount of

uprooted plants, Southern naiad (Najas guadalupensis) and Redhead grass (Potamogeton perfoliatus),
floating along the western portion of the shoreline lying in a thin rack line on the western portion of sandy
beach. The site visit in January was not the ideal time to inspect for SAV's. It appears from the May, 2006
Aerial photograph, several small patches of SAV were present. None were present in the bulkhead backfill
area, but an apparent bed existed in the proposed pier walkway location immediately north of the proposed
platform and slip areas. According to the aerial photography, 1995 was a year that moderate patches of SAV
beds existed off the shoreline of the applicants' property. It appears a much more dense population of SAV
beds exist to the northwest of a point along Long Beach Estates Subdivision and adjacent wetlands to the far
east.
Reviews of available information suggest that there are no known archeological sites or geologic formations
associated with the applicant's property. The waters of Perquimans River in this area are classified as SB by
the Division of Environmental Management and are closed to shellfish harvesting. Soil type on the property
is Roanoke silt loam (Ro). The proposed development is less than one-acre disturbance; therefore, a
sedimentation and erosion control plan by the Division of Land Resources may not be required for this
project.
DEVELOPMENT PROPOSAL
There is currently no upland development proposed at this time. In order to provide water access for each of
the five owners in The Shores at Albemarle, LLC, and an additional guest slip, the applicants have proposed
a 6-slip pier structure in the Perquimans River. The applicants propose a 15-foot long by 6-foot wide
elevated, slatted walkway over uplands to a 228-foot long by 6-foot wide pier. The pier structure is
proposed to "L" to the west with a 78-foot long by 6-foot wide finger, which will have three 15-foot long by
2.5-foot wide mooring fingers on the north side of the "L" platform. Nine 20-foot long by 1-foot wide
mooring pilings are proposed adjacent the mooring fingers, creating a mooring area of 72-foot long by 30-
foot wide (2,160 square feet). The pier structure will be setback 85-feet from the Jones' property, riparian
owner to the southeast, and extend 234-feet into Perquimans River. There is no request for restrooms,
gasoline, sewage pumpout, or dredging with this development proposal.
The 500-linear feet of wood bulkhead is currently under construction connecting to the Jones' bulkhead
wingwall to the southeast and terminating approximately 170 feet west of the woods at the shoreline
separating the farm field from the residential lawn of The Shores at Albemarle, LLC property. The
applicants have proposed extending the wood bulkhead another 358 feet to tie into the Walker's existing
wood bulkhead. The proposed bulkhead will continue at 2-foot waterward NWL from the terminus of the
500-foot bulkhead currently under construction for approximately 200 feet, then curve out maximum 45-feet
waterward NWL for an additional 158-feet to tie into the easterly most portion of the Walker's bulkhead.
The average distance waterward NWL in the proposed corner adjacent the Walker's property for the
bulkhead alignment is approximately 35-feet. The applicants are requesting this alignment in order to
stabilize the shoreline with a design to withstand a long fetch from southeasterly winds, reduce a trash trap
corner, and create a grassy lawn area for the drainpipe to overflow. The proposed bulkhead will be installed
prior to any backfill activity, and the backfill will be brought in of similar soil type from an upland pit. The
erosion rate of the property to be stabilized is approximately 5-feet to 7-feet per year, increasing in erosion
rate in a northwesterly direction along The Shores at Albemarle, LLC property.

ANTICIPATED IMPACTS
The proposed 6-slip dock will project 234-feet into Perquimans River, and will shade 1,948.5 square feet of
Public Trust Area (PTA), Estuarine Waters (EW), and 96 square feet of uplands in the Estuarine Shoreline
(ES) Area of Environmental Concern (AEC) in the form of a wooden, elevated slatted walkway. Each boat
slip will be 30-feet long by approximately 12-feet wide and located in -2.5-foot water depth at normal water
level (NWL). The total area occupied by the entire pier structure with mooring area is approximately 4,000
square feet. The Division of Environmental Management classifies waters of Perquimans River in this area
as SB, and a low pressure of Rangia clams were observed out to at least -2.5-foot water depth on January 11,
2007. There are no expected navigational impacts due to the proposed pier structure due to the nearly 2-
mile wide mouth of Perquimans River adjacent the applicants' property. Boating activity will increase in
this area resulting in a possible increase in water turbidity due to shallow water in mooring area, and may
result in toxicants from hull paint and maintenance products to accumulate in the sediment near the boat
slips. This will be the first multi-slip pier along this shoreline.
The 500 linear feet of bulkhead currently under construction through the complete reissue of CAMA
General Permit #A46845 will result in the filling of approximately 1,000 square feet (18 cubic yards below
NWL and 148 cubic yards vertically above NWL) of PTA, EW and approximately 2;500 square feet (370
cubic yards) of ES AEC. The proposed 3581inear feet of new wood bulkhead will result in the filling of
3,899 square feet (195 cubic yards below NWL and 687 cubic yards vertically above NWL) of PTA, EW
and approximately 1,920 square feet (427 cubic yards) of ES AEC. The bulkhead backfill will be of similar
soil type and trucked in from an upland pit. It is anticipated that 3,580 square feet of uplands in the ES AEC
will be disturbed for the bulkhead tieback area.
There will be no wetland impacts due to the bulkhead being installed adjacent to high ground. No upland
development was proposed, so there are no impervious impacts. Temporary water turbidity will occur
during construction of the pier structure and bulkhead.

SITE LOCATION - the Subject property covers 100.0 acres and is located at the
convergence of Cross Neck RD., Muddy Creek Rd., and Hoyle Jones Rd. in an area
southeast of Hertford, NC known as Durants Neck.
The Applicant holds title to the existing property. The property is currently improved
with two mobile homes and a barn. The shoreline on Albemarle Sound is approximately
868 LF. The shorefront area of the subject property has a measured current erosion rate
___ of7-feet peryear. 'Fhe extensive-fetch-acres the-Albemar~e._Snund_ad~s to the erosive _ _ _
force of the wind-seas during storm events. The distance over which the wind builds the
erosive waves is measured as 11 miles to the southwest (to Lauren Point) and 8.9 miles to
the south/southeast (to River Neck). Please see the attached chart of the area for detail.
The underwater substrate along the shoreline, in the area of the proposed bulkhead, and
in the area surrounding the pier, is firm, sandy bottom with no SAV's or shellfish beds.
The general character and depth in this area of the Albemarle Sound will not
accommodate large vessels. The six boat slips and the pier will be for private use by the
five `Moorings at Albemarle, LLC' landowners and one guest slip.
In order to:
• promote and provide increased recreational opportunities
• protect and preserve the rapidly eroding shoreline area
• provide small boat (average to 22ft length) access to adjacent waters
The applicant was granted a CAMA General Permit (GP) for 500 LF of bulkhead
(#A46333) to stabilize the highly eroded shoreline. The permit, issued on October 17,
2006, authorized construction of a bulkhead adjacent to the southern boundary of the
property, to connect to the Jones property. The applicant proposes the following within
the AEC:
• construct and backfill the remaining 358 LF of bulkhead, connecting to the 500
LF bulkhead structure allowed under the CAMA General Permit. The other end of the
358 LF structure will connect to the existing bulkhead on the Walker property (co-
applicant) to the west.
• construct a 15 ft X Eft wood walkway over uplands to connect to a 228 ft. X 6 ft.
wooden pier, with a 78ft. X Eft. "L-head" section connected at the end, off the western
side of the pier. Pier will be perpendicular to shoreline on southeastern boundary of
subject site.
• construct 3, 2.5 ft. X 15 ft. finger piers to allow for individual boat access
• Set 9, 20-foot mooring piles 6 feet into the bottom substrate, allowing
approximately 10 to 12 feet above water, available to the 6 boat slips along the inside of
the "L" section of the pier.
