Battleship Memorial, Wilmington, New Hanover County, North
Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWCO80-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any

permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp and anadromous and non-anadromous fin
fish population, no excavation or filling will be permitted between February

of Coastal Management.

initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval
All work: -must cease when -the permit- expires on
- -December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(5) The disposal effluent will be contained by pipe, trough or similar device
to a point at or below the mean low water level to prevent gully erosion
and unnecessary siltation.
(6) The terminal end of the pipeline will be positioned at or greater than
fifty (50) feet from any part of the dike and a maximum distance from spill-
ways to allow settlement of suspended solids.
(7) A water control structure will be installed at the intake end of the effluent
pipe to assure compliance with water quality standards.
(8) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction of construction-related
discharge.
(9) This permit does not authorize interference with any existing or proposed
Federal project.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (copy enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received February 9, 1988, for
Department of the Army authorization to maintain a basin off the
Cape Fear River, USS North Carolina Battleship Memorial,
Wilmington, New Hanover County, North Carolina, indicates it to be
a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be informed regarding its further
management. If there are no unresolved differences in State-
Federal positions or policies, the final action taken on your
application by the State will result in your receiving written
notice from us that your application is consistent with the
general permit and you may commence your activity. Only after
receiving such confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been

Reference the application of the USS North Carolina Battleship
Commission, represented by Captain F. S. Conlon, USN (Ret.), for
Department of the Army authorization to maintain a basin off the
Cape Fear River, USS North Carolina Battleship Memorial,
Wilmington, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile shrimp and anadromous and
non-anadromous fin fish, no excavation will be permitted between
the dates of February 1 and September 30 of any year without the
prior approval of the North Carolina Division of Coastal
Management.
b. The final alignment of the excavated material retention
area will be approved by the North Carolina Division of Coastal
Management and the Corps of Engineers prior to the commencement of
any work. This area will be located a sufficient distance from
the mean high water (MHW) elevation contour and any wetland
vegetation to eliminate the possibility of dike erosion into
waters or wetlands.

c. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour within adequate dikes or
other retaining structures to prevent spillover of solids into any
vegetated wetlands or surrounding waters.
d. The terminal end of the pipeline from the dredge to the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and a maximum distance from spillways to
prevent dike erosion and to allow adequate settlement of suspended
solids.
e. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area to ensure
maximum settlement of suspended solids.
f. Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the mean
low water (MLW) elevation contour to prevent gully erosion and
siltation.
g. Excavation will not exceed 10 feet below the elevation of
mean low water (MLW).
h. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.
i. This permit does not authorize interference with any
existing or proposed Federal project.

be 11.0' (MSL) at the memorial site.
NOTE:. This 12/87 modification authorizes the addition of a parking lot driveway
and placement of riprap in an existing ditch.
This permit action may be appealed by the permittee

9. PROJECT DESCRIPTION
The project is located on the west bank of the Cape Fear River just downstream
of the confluences of the Cape Fear and N.E. Cape Fear rivers. There is an
existing ships basin which measures approximately 1000' long by an average of
250 wide. Shoaling has occurred within the basin and has become a problem for
the vessel. When last dredged a plug (shoal) was left at the mouth of the
basin in hopes of reducing the shoaling rate within the basin. This apparently
had little effect. The adjacent waters are classified as SC and are a
designated primary nursery area outside the river channel.
The applicants propose to maintain the entire basin. The dimensions are
approximately 1000' long x 250 wide x -10' mean low water. Approximately
24,000 cubic yards of material will be excavated and will be pumped to a spoil
disposal site ol?Eagle Island. This island has been used for spoil in the
past. It will be necessary to construct a new dike wall for the disposal area.
10. ANTICIPATED IMPACTS
Provided that the project is timed to avoid periods of peak biological activity
no significant adverse impacts will result from the dredging. In order to
properly control the spoil material it will be necessary to rework the disposal
area dikes.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 ?i x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be-sufficiently detailed to guide-agency per-
sonnel unfamiliar with the area to the-site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).
