Any violation of these terms may subject pemiittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The alignment of the replacement bulkhead must not exceed 2 feet waterward from the existing bulkhead. (2) All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. (3) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) A filter cloth must be installed behind the bulkhead to prevent seepage of back fill material into adjacent waters. (5) No marsh grass will be excavated and/or filled. (6) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when°the project is inspected for compliance: Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1991 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (8) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from operations undertaken by the United States in the public interest. (10) If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U. S. Coast Guard will be installed and maintained by, and at the expense of the permittee. NOTE: All wood material used for the construction of the replacement pier, deck and bulkhead should be salt treated. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. Natural Resources and Community Development Post Office Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Parker: Reference the application of the LaQue Center for Corrosion Technology for Department of the Army authorization to reconstruct and backfill a bulkhead and replace a pier on Banks Channel, Wrightsville Beach, New Hanover County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The new bulkhead will be positioned no farther waterward than an average of 2 feet from the alignment of the deteriorated bulkhead. b. All backfill materials will be obtained from a high ground source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. Vegetated wetlands will not be filled. e. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent the authorized work. -2- f. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. g. A review of your application received November 13, 1987, for a Department of the Army permit to reconstruct and backfill a bulkhead and replace a pier on Banks Channel, Wrightsville Beach, New Hanover County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. Project Summary The applicants propose to replace 33 ft section of existing failing bulkhead and replace existing deteriorating portions of pier and decks to improve commercial facilities. 9. PROJECT DESCRIPTION The project site is located on the South west side of Banks Channel at the intersection of U.S. Hwy 76 East and Auditorium Circle, Wrightsville Beach, New Hanover County, North Carolina. The facility consists of an existing commercial office and research buildings covering approximately 959 of the high ground property located within 20 feet of mean high water mark, two existing piers, two decks and two floating docks over the water. The decks are used primarily for mounting steel and other structural material for corrosion testing. There is an existing wooden bulkhead measuring approximately 250 feet along the shoreline of this property. One deck located on the northern corner of the project measuring approximately 47 ft by 46 ft is deteriorating and needs replacement. A section of the existing pier measuring approximately 13 feet by 13 feet is also in need of repair by bracing and decking. The existing bulkhead is partially failing in one location which requires replacement of approximately 33 feet section. The waters within the project area are classified as SB. They are also a designated secondary nursery area according to Marine Fisheries. The applicants propose to replace the deck measuring 47' by 46 feet located on the Northern end of the property. They also propose to reinforce a section of an existing pier to the south measuring approximately 13 feet by 13.feet by bracing and decking over. A replacement of 33 feet section of the existing bulkhead to the south is also proposed. The replacement bulkhead is to be aligned an average distance of 2 feet waterward of the existing bulkhead needing repair. 10. ANTICIPATED IMPACTS The replacement bulkhead will cause to be consumed approximately 66 s.f. of shallow intertidal water. There will be short term turbidity associated with the construction of the bulkhead. No long term significant impact is expected from this activity.
