This permit, issued on MUM / , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void
(1) The surface elevation along the pipeline corridor must be re-established
to pre-project grade.
(2) All stormwater must be collected and stored on the east side of River Road.
(3) The activity shall be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction-related
discharge (increases such that the turbidity in the Stream is 25 NTUs or
less are not considered significant).
NOTE: The Division of Environmental Management issued Water Quality Certification
No. 2157 for this project on September 29, 1987. NPDES permit No. NC
0065480 also has been issued, authorizing treatment plant discharge.
NOTE: The permittee is advised that plans and specifications of all water system
improvements must be approved by the Division of Health Services prior
to the award of a contract or the initiation of construction (as required
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Through coordination with Mr. C. Robert Stroud of the North
Carolina Division of Coastal Management, we have learned of your
plans to install a package sewage treatment plant with effluent
outfall on the Cape Fear River on River Road property, south of
Sanders Road, New Hanover County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 330,
published in the Federal Register on November 13, 1986, lists
nationwide permits. Authorization was provided for outfall
structures and associated intake structures where the effluent
from that outfall has been permitted under the National Pollutant
Discharge Elimination System (NPDES) program.
For this nationwide permit to be valid, you must comply with
the following conditions:
a. Any discharge of dredged or fill material will not occur
in the proximity of a public water supply.
b. Any discharge of dredged or fill material will not occur
in areas of concentrated shellfish production.
c. The activity will not jeopardize a threatened or
endangered species as identified under the Endangered Species Act,
or destroy or adversely modify the critical habitat of such
species.

d. The activity will not significantly disrupt the movement
of those species of aquatic life indigenous to the waterbody.
e. Any discharge of dredged or fill material will consist of
suitable material free from toxic pollutants.
f. Any structure or fill will be properly maintained.
g. The activity will not cause an unacceptable interference
with navigation.
h. The following management practices will be followed to the
maximum extent:
(1) Discharges of dredged or fill material into waters of
the United States will be avoided or minimized through the use of
other practical alternatives.
(2) Discharges in spawning areas during spawning seasons
will be avoided.
(3) Discharges will not restrict of impede the movement
of aquatic species indigenous to the waters or the passage of
normal or expected high flows or cause the relocation of the
waters.
(4) If the discharge creates an impoundment of water,
adverse impacts on the aquatic system caused by the accelerated
passage of water and/or the restriction of its flow will be
minimized.
(5) Discharge in wetland areas will be avoided.

The District Engineer has determined that the individual and
cumulative adverse effects of your work on the environment will be

construct a sewage outfall for Beau Rivage Plantation.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of cape Fear
River in conjunction with the proposed sewage outfall in New Hanover
County will not result in a violation of applicable water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition (s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That the surface elevations after completion of
the outfall be the same as the preconstruction
elevations.

The applicant is proposing to install a package and effluent
outfall pipe. The applicant currently holds a NPDES permit for
the discharge. The project includes the disturbance of
approximately 140 square feet of wetlands. The project is
adjacent to the Cape Fear River, classified SC.
The project has been reviewed to determine impacts to water
quality. The project will require a 401 Water Quality
Certification which should contain the following conditions:
1. That the work be done in such a manner as to not cause the
turbidity levels to increase above 25 NTUs outside of the
construction area.
2. That the post construction ground level is the same as
preconstruction ground level.
This office has no objection to the project as proposed.

PROJECT DESCRIPTION
The project site is located between US 4215 and River Road (SR 1100) and south
of Sanders Road (SR1187) in New Hanover County. The site has been partially
developed in the area east of River Road which is completely outside any AEC.
A golf course with surrounding subdivision is under construction. The 670 acre
tract has been examined by the US Corps of Engineers and "404" wetlands have
been identified. There has been some excavation of these areas but no filling.
The applicants have identified these "404"areas on sheet 2 of 3. There are
areas on the west side of River Road identified as future development on the
same plat which also contains "404" wetlands. These areas have not been
designated as yet by Corps personnel. The river is classified as SC waters
and a secondary nursery area. There is a 46' wide border of wetlands along the
river - approximately 36' of this is smooth cord grass, the other 10' are
vegetated by an unknown species.
In order to treat the waste water generated in the subdivision the applicant's
are proposing a 75,000 gallons per day package treatment plant. The discharge
from this facility will be placed in the Cape Fear River. The treatment plant
will be sited on high ground on the west side of River Road. A 4' force main
will transport the untreated sanitary waste from the subdivision to the plant.
The discharge will be by an 8" line. The line will be approximately 830' in
length. It will supported or pipe trestles for approximately 730'. The final
approximately 100' will be instated within an excavated trench. The waterward
end of the pipe will be rip-rapped for protection.
ANTICIPATED IMPACTS
The approximately 138 s.f. of wetlands will be temporarily disturbed in order
to install the pipeline. Provided that the original grade is re-established
over the pipe line route, no significant adverse impacts will result from the
pipe installation. The stormwater runoff within the subdivision will be
collected for golf course irrigation. The ultimate build out permitted for
this tract is stated at 1160 units. If properly operated, we do not anticipate
any adverse impact on coastal resources within the river.
