Box 2493 Manteo, NC 27954 Dear Ms. Wilson: The Division of Water Quality has reviewed your plans for the discharge of fill material into an unspecified amount of protected riparian buffers located at 14139 Silver Lake Road in Ocracoke in Hyde County for commercial development and installation of a septic tank and drain field. Insufficient evidence is present in our files to conclude that your project must be built as planned in the protected buffers in accordance with 15A NCAC 2H .0259. Furthermore, the proposed impacts will require a Major Variance from the NC Environmental Management Commission since you have proposed impacts in Zone 1 (within 30 feet of the edge of the riparian buffer). If your project can be redesigned to only impact Zone 2 (beyond 30 feet from the edge of the riparian buffer), then DWQ staff have the authority to issue a Minor Variance for the project. Therefore, unless modifications of the proposal are made as described below, we cannot approve your project will `place this project on hold as incomplete until we receive this additional information. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you redesign your project as outlined above? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your application. Also this project will require compensatory mitigation as described in 15A NCAC 2H .0259 for the Minor or Major Variance. Your mitigation proposal is insufficient because none was proposed. In addition, stormwater management will be needed for the new development. Your proposal to "divert the runoff from the building eaves to the highway" is not acceptable since this will not result in treatment of the stormwater runoff before it enters downstream waters. Finally please specify the exact amount and location of impact to the buffers in your response. Please respond within three weeks of the date of this letter by sending a copy of this information to me and, one copy to Washington Regional Office. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. The intent of this request was to construct a commercial building well within both Zone 1 and Zone 2 of the Tar / Pamlico basin buffer. Enclosed are copies of CAMA permits that are active on the property. These permits have been renewed since the early 1990's and have been passed on to three different property owners. The permits are for activities not discussed in the variance request, but are associated with the property and the overall intent of land use. The permit was renewed on 19 January 1996. The property was sold and the permit was transferred to William Hegamyer on 11 July 1997. The permit was renewed by Hegameyer on 2 February 1998 and 8. March 2000. Wrobleski completed the dredging work and Hegameyer undertook the pier/slip construction. All that remains to be completed is a roof over the 16'x 30' platform. Mrs. Ruth Jolly Wilson has recently purchased the property from William Hegameyer and is now requesting to transfer and renew the permit in order to complete the remaining work. Mr. Hegameyer has agreed to the permit transfer. Also, she recognizes the advantages to possessing an active permit for the site. I have no objection to the transfer and renewal of this permit. Enclosed is a copy of the deed, purchase agreement and signed statement form Mr. Hegameyer agreeing to the transfer of all permits with the sale of the property. This permit, issued on January 24, 2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Any project proposal referenced in the application dated 1/21/ and 9/26 not depicted in the attached revised workplan drawing dated 11/11/91 is hereby deleted. (Previous applications are referenced solely for project background information) Excavation 2) Because of the distance offshore and the existing coastal marsh, excavation shall be conducted only by hydraulic dredge. 3) Excavation shall take place no closer than 30 feet from the waterward edge of the existing coastal marsh. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2004 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Wilson Permit #22-92 Page 2 of 3 ADDITIONAL CONDITIONS 4) Excavation will not exceed -8 feet below the mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. No marsh grass will be excavated and/or filled. 6) Consistent with recommendations from the NC Division of Marine Fisheries, no excavation shall be conducted from February 1 to October 31 of any year. 7) The limits of the spoil area shall be staked and verified by DCM 'staff prior to the construction of any dikes or berms. 8) A silt fence shall be placed around the entire perimeter of the spoil area prior to the construction of any dike or berms. 9) Following completion and/or shut down of excavation during any year (consistent with condition #6 above), all spoil material shall be removed from the site to a non-wetland area, dike shall be graded down to pre-spoil conditions, the site leveled and stabilized and the area sown with appropriate vegetation within 45 calendar days. 10) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 11) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. 12) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or beyond the mean low/normal water level to prevent gully erosion and unnecessary siltation. . 13) The terminal end of the pipeline will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 14) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. NOTE: The N.C. Division of Water Quality has authorized the project dredging under General Water Quality Certification No. 2598. The permittee is reminded of spoil area management Condition No. 2 of that Certification. NOTE: If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. Piers 15) Because of the pie-shaped configuration of the riparian access of the permittee, the piers shall not be constructed on the alignments depicted on the 11/11/91 plat. The pier alignments shall be established onsite prior to construction by staff of the Division of Coastal Management. Ruth J. Wilson ADDITIONAL CONDITIONS Permit #22-92 Page 3 of 3 16) No portion of either pier or mooring pilings shall be closer that 15 feet from the dividing line between adjacent areas of riparian access. 17) The southern pier shall not exceed 165 feet in total length; the northern pier shall not exceed 150 feet in total length. 18) The 30 foot by 16 foot platform area on the southern pier may be covered by a roof; however, no wall or other structures shall be placed around the platform so that the platform remains unenclosed. 19) A total of no more that 10 boats may be simultaneously moored at the piers. Miscellaneous Construction 20) The proposed gazebo shall be constructed landward of all wetlands. Operational Conditions 21) The permittee will promptly post and enforce a "no sewage discharge" policy. 22) The docking facility will display a sign showing the location of the pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main piers. 23) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 24) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 25) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 26) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 27) This transfer/renewal must be readily available on site when a Division representative inspects the project for compliance. Wilson: 1 have recently had the pleasure to evaluate the above referenced tract with the aide ofbackhoe pits and in the presence of Hugb Watson of the Hyde County Health Department. The site was evaluated using North Carolina Laws and Rules far Sewage Treatment and Dispoal Syste? T15A NCAC 18A.1900 et seq. as a guide. The site appears to be multiple layer of mixed quaky fid over the wet native sandy soils. During our field investigation, it was determined that the site Should be approached as gttalit iug eadsdng fill. It was stated that a proposal for a wastewater system should include repair area and not exceed 480 gallons per day if space permits. After careful design consideration, I have prepared a proposed site plan that should allow for the Veamnent and disposal of 490 gallons per day of wastewater with a peat pretreatment system as shown based upon feedback provided by Hugh Watson. The initial wastewater system would be a Puraflo peat pretreatment system as shown in pink. The repair wastewater system would be an Eco&a pretreatment wastewater system as shown in purple, The yellow border represents a requisite 5 foot buffer required due to tins site being existing fill I have assumed a front property line at the edge of the asphak of NC Highway 12 as shown. For plaru*jg purposes, you should give a copy of this sketch to your archhect and inform ftm that this proposal does not slow a 4.5' x 8' septic tank and a 4.5' x 8' pump tank which will also be required. We can locate these features almost anywhere along the yellow buffer area. Any proposed driveway can co= up to, but not encroach on the yellow buffer area. Any proposed foundation roust be 5 feet from the yellow buffer area. If this area is too large to accommodate a proposed building, we can shrink the size of the drainfield, however, the volutme of wastewater that we can dispose of will decrease as well.
