This is a request for an extension of the current approval of 401 Water Quality Certification from your office dated
March 24, 2009. At the request of USACOE, impacts to streams have been revised and resubmitted for review.
We are currently awaiting a response and concurrence from the USACOE concerning the revised amount of
stream impact and mitigation required. We anticipate the stream impacts requiring mitigation to be lower than
that previously approved (355 L.F.) by your office. "
Due to this delay, we are unable to determine the proper mitigation payment amount and will thus exceed the time
I frame as specified in paragraph 1 of "Conditions of Certification" attached to your letter. Please note that no
impacts have begun on the project and it is the Town's intent to make mitigation payment to EEP. Once
concurrence is received from USACOE, we will submit a revised PCN form and plans (if applicable) to your
attention with the understanding that receipt of payment made to EEP be forwarded to your office.
Please advise us if you will need any other information regarding this request
