The Application provides adequate assurance that the discharge of rip-rap into the waters of Neuse River in conjunction with the proposed jetty construction in Pamlico County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the.State of North Carolina certifies that this activity will not violate` Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related-discharge (increases such that the turbidity in the Stream is 25 NTU`s or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. Project summary Applicant proposes to construct a 20' extension to an existing concrete jetty at property located off SR 1121 on Neuse River near Aligator Gut in Pamlico Mt m r, _ { y. ?' s ? 9. Narrative description The applicant's property is a half acre tract located off:SR 1121 on the Neuse River west of Aligator Gut near Minnesott Beach .in Pamlico County. The property is characterized by the applicant's residence and detached garage, the lot being wooded with mixed pines and hardwoods on sandy soils and approximately 15' eleva- tions. The shoreline is characterized bya nearly vertical bank which tapers very steeply down to the shoreline of the Neuse River. The shoreline is partially bulkheaded with a retaining wall apparently built prior to permit requirements. This retaining wall exists on the easternmost side of the property and the immediate adjacent property on this side has been recently bulkheaded. The westerrmnst portion of the shoreline is unstabilized and adjacent properties on this side are currently unbulkheaded and suffering some minor erosion. Characteristic of this area is a narrow 5-10' wide beach adjacent to this slighly eroding bank. The applicant is proposing to extend the beginnings of a concrete and steel jetty watetward approximately an additional 20' into Neuse River. The struc- ture is about 2' square in sections; it is not expected to extend higher than 1' above the existing NWL, or exceed our 251•length limitation below the NWL. 10. Anticipated impacts This project if constructed as proposed should be expected to cover about 40 sq.ft. of shallow, subtidal, brackish water habi- tat with approximately 6 cu.yds..of concrete material. Narrative descri.?tion The applicant's property is a half acre tract located off SR 1121 on the Neuse River west of Aligator Gut near Minnesott Beach in Pamlico County. The property is characterized by the applicant's residence and detached garage the lot being wooded with mixed pines and hardwoods on sandy soils and-approximately 15' eleva- tions. -The shoreline is characterized bya nearly vertical bank which tapers very steeply down to the shoreline of the Neuse River. The shoreline is partially bulkheaded with a retaining wall apparently built prior to permit requirements. This retaining wall exists on the easternmost side of the property and the immediate adjacent property on this side has been recently bulkheaded. The westerrnnst portion of the shoreline is unstabilized and adjacent properties on this side are currently unbulkheaded and suffering some minor erosidn. Characteristic of this area is a narrow 5-10' wide beach adjacent to.ah-is slighly eroding bank. The applicant is proposing to extenal the beginnings of a concrete and steel jetty wateLward approximately an additional 20' into Neuse River. The struc- ture is about 2' square in sections it is not expected to extend higher than 1' above the existing NWL, or exceed our 25' length limitation below the NWL. 10. Anticipated impacts This project if constructed as proposed should be expected to cover about 40 sq.ft. of shallow, subtidal, brackish water habi- tat with approximately.6 cu.yds..of concrete material. (1) All forms used in molding this jetty structure will be structurally tight during concrete pouring operations in order to ensure the concrete material will be confined along the jetty alignment. (2) No concrete or other fill material will be permitted outside of the alignment indicated on the attached plats. (3) The jetty will not extend farther than 25 feet waterward from the normal water level elevation contour. NOTE: A Section 401 Water Quality Certification is required for this project and is being processed by the N. C. Division of Environmental Management. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval.
