(1) The riprap will be clean material, free of waste metal products, organic
materials, unsightly debris, or petroleum products.
(2) No riprap material in Lxcess of the minimum needed for erosion protection
will be placed wuterwar'd or the ?m?ean high water (MHW) elevation contour
or on any marsh outside of the proposed alignment as shown on the work
plat drawing.
(3) The riprap material will not be positioned farther than 5 feet waterward
from the mean high water (MHW) elevation contour at any point along its
alignment. To prevent an unintentional violation of this condition, represen-
tatives of the Corps of Engineers and the N. C. Division of Coastal Management
are available to stake the alignment before work begins.
(4) All construction upon the highground property must be consistent with
all local, state, and federal building code requirements which include
the federal flood insurance program.
(5) No portion of the concrete pad under the house or the driveway may be

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Mr. Harold Myers pursuant to
an application filed on the 26th day of April, 1985 to construct a boat
ramp and riprap the shore along an adjacent canal.
The Application provides adequate assurance that the discharge of
rip-rap into a wetlands area adjacent to the waters of a man-made canal
in conjunction with the proposed bank stabilization and boat ramp in
Carteret County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 25 NTU`s or less
are not considered significant).
2. That the level of the riprap be elevated approximately
one foot above the natural yard elevation and create a
swale on the landward side of the riprap embankment.
3. That a gently sloped mound area be constructed around the
waterward side of the house and proposed parking area to
retain stormwater on the streetside of the property.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions(s) are made conditions of the federal Permit{s}.

SUBJECT: Application for 401 Certification

Carteret County
As you may recall, the applicant proposes to install 128 linear feet of rip-rap,
a 36 foot by 6 foot pier, a 10 x 20 foot boat ramp and a concrete driveway and
slab for his single family residence adjacent to a man-made canal to the White
Oak River, Classified SA. On May 31, 1985, this office submitted comments relative
to the application for 401 Certification, recommending that the project be denied
due to the impervious surface area exceeding 18% of the total site.
On Monday, July 1, 1985, Mike Williams visited with Mr. Myers to discuss the pro-
ject. As a result of that discussion, it is recommended that a 401 Certification
be issued, based on the following comments:
(1) Mr. Myers has agreed to elevate the level of the rip-rap approximately 1 foot
above the natural yard elevation and create a swale on the landward side of the
rip-rap embankment.
(2) Mr. Meyers has agreed to construct a gently sloped mound area around the water
ward side of the house and proposed driveway and parking area to retain stormwater on
the street side of the property.
Observations made during the visit:
(1) Soils are very well drained (Heavy rains experienced prior to the visit).
(2) No slopes, drainage swales or storm culverts exist within the entire development.
The area is completely flat.
(3) Neighboring houses presently have a design similar to the proposed project.
It is recommended that a 401 Certification be issued containing the two conditions
Mr. Meyers agreed to as stated above.

Reference the application of Mr. Harold W. Myers for a
Department of the Army permit to place riprap material and
construct a pier and a boat ramp on a manmade canal off the White
Oak River near Cedar Point, Dolphin Bay subdivision, Carteret
County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The riprap will be clean material, free of waste metal
products, organic materials, unsightly debris, or petroleum
products.
b. No riprap material in access of the minimum needed for
erosion protection will be placed waterward of the mean high water
(MHW) elevation contour.
C. The riprap material will not be positioned farther than

Reference your application for a Department of the Army permit
to place riprap material and construct a pier and boat ramp on a
manmade canal off the White Oak River near Cedar Point, Dolphin
Bay subdivision, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.
