authorizing development in Carteret Countyat Goose Creek, off SR 1119 near the
community of Bogue as requested in the permittee's application dated 2/6/85 including
attached plats, sheets 1 and 2 of 2 dated received 8/22/85.
This permit, issued on q-30 -15' , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The pier, including the T-section, will not exceed 225 feet in length from
the mean high water line, in keeping with the traditional pier head line.
(2) The bulkhead will not exceed waterward more than 5' from the mean high water
level at any point along its alignment, and shall average no more than 2'
waterward of the mean high water line.
(3) All fill material to be placed below the mean high water level will be confined
behind the permitted bulkhead.
(4) All oysters within the proposed channel alignment will be relocated prior
to excavation activities.
(5) Prior to excavation activities, the channel alignment must be staked by
a representative of the Divisions of Marine Fisheries and Coastal Management.
(6) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without the
prior approval of the Division of Coastal Management.
(7) No marsh grass will be excavated and/or filled.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered. hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(8) Excavation will not exceed four feet below the elevation of MLW.
(9) : All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding.waters..
(10) An earthen plug will be left. between the area to be excavated and the existing
creek, and a 24-hour period after completion of the excavation will elapse
prior to plug removal .. to prevent unnecessary siltation into the adjacent
water body.
(11) The disposal area effluent will be contained by pipe, trough or similar
device to a point at or `below the mean low 'water level to prevent gully
erosion..and unnecessary siltation.
(12) The terminal end of the pipeline will be positioned at or greater than 50'
from any part of the dike and a maximum distance from spillways to allow
settlement of. suspended solids.'
(13) A water control structure will be installed at the intake end of the effluent
pipe to ensure compliance with water quality standards
(14) The diked disposal area will be constructed a sufficient distance from the
mean high water level or any marsh to eliminate the possibility of dike
erosion into or upon_any marsh and/or surrounding waters.
(15) The disposal area will be properly graded, in a direction away from the
boat basin area, And provided a ground cover sufficient to restrain erosion
within 30 working days of project completion. No vehicular parking will
be allowed in this area.
NOTE: Section 401 Water Quality Certification No. 1793 was issued for this
project on April 18, 1985 by the Division of Environmental Management.
NOTE: The project site is located in an area having a high probability of
containing cultural resources such as artifacts, human remains, etc.
If such materials are encountered, the permittee must immediately stop
work and notify the District Engineer, Wilmington Corps of Engineers,
343-4629 and the N. C. Division of Coastal Management at 733-1664 in
Morehead City.

confined behind the permitted bulkhead.
(3) All oysters within the proposed channel alignment will be relocated prior

(4) Prior to eXcavation activities, the channel alignment must be staked by
a representative of the Divisions of Marine Fisheries and Coastal ilanagenent.
(5) in order to protect juvenile shrimp populations, no excavation or filling
will De permitted between April 1 and September 30 of any year without
the prior approval of the Division of Coastal Management.
(b) No marsh grass will be excavated and/or filled.
(7) Excavation will not exceed four feet below the elevation of ?11-W.

This permit action may be appealed by the pemmittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work of project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(8) All excavated materials will be confined above mean high water ano landward
of regularly or irregularly flooded marsh behind aaequate dikes or other
retaining structures to prevent spillover of solids into any marsh or
surrounding waters.
(9) An earthen plug will be left between the area to be excavated and the
existing creek, and a 24-hour period after completion of the excavation
will elapse prior to plug removal to prevent unnecessary siltation into
the adjacent water body.
(10) The disposal area effluent will be contained by pipe, trough or similar
device to a point at or below the mean low water level to prevent gully
erosion and unnecessary siltation.
(11) The terminal end of the pipeline will be positioned at or greater than
50' from any part of the dike and a maximum distance from spillways to
allow settlement of suspended solids.
(12) A water control structure will be installed at the intake end of Cne effluent
pipe to ensure compliance with water quality standards.
(13) The diked disposal area will be constructed a sufficient distance from
the wean high water level or any marsh to eliminate the possibility of
dike erosion into or upon any marsh and/or surrounding waters.
(14) The disposal area will be properly graded, in a direction away from the
boat basin area, and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion. No vehicular parking will
be allowed in this area.
NOTE: Section 401 Water Quality Certification No. 1793 was issued for this
project on April 18, 1985 by the Division of Environmental Management.
NOTE: The project site is located in an area having a high probability of
containing cultural resources such as artifacts, human remains; etc.
If such materials are encountered, the permittee must immediately stop
work and notify the District Engineer, Wilmington Corps of Engineers,
343-4629 and the N. C. Division of Coastal Management at 733-1664 in
Morehead City.

8. Project summary The applicant proposes to excavate a boat basin, access channel and
to bulkhead his shoreline area at a site within and adjacent to Goose Creek at
Goose Creek Mobile Home Park off SR 1119 near the community of Bogue, Carteret County
Narrative description
The applicant's property is located on the east side of Goose Creek
and off SR 1119 near the community of Bogue, Carteret County. The
property has previously been developed into a 132 lot mobile home de-
velopment known as "Goose Creek Mobile Home Park". Between the exist-
ing mobile home park and the shoreline of Goose Creek there is an ap-
proximately 250' wide area which is vacant and comprised mostly of
yard grasses with some trees toward the southern end. Existing ground
elevations range from about +2.5 to +5.' mean sea level.
The shoreline of the property as it abuts Goose Creek can be charac-
terized as having two significant pockets of Spartina alterniflora
marsh with the remaining shoreline consisting of an approximately 2-3'
high vertical bank which shows signs of moderate erosion. Within
the intertidal area there are scattered concentrations of "coon" oys-
ters all along the applicant's shoreline. The offshore waters and bot-
toms of Goose Creek in front of the applicant's property are relatively
shallow and sandy in nature. There are also substantial scattered beds
of submerged "seagrass" vegetation all along this area. Previous bot-
tom surveys along the project area have also indicated the presence
of scattered amounts of clams. The waters of Goose Creek have been
classified by the Div. of Env. Mgt. as SA waters with the area imme-
diately upstream of the project having been classified by the Div. Mar.
Fish. as a primary nursery area.
The applicant is requesting a permit which would authorize the excava-
tion of a boat ramp/basin area into his highground property, with an ac-
cess channel in Goose Creek in order to provide boat launching facili-
ties for the residents of his mobile home park. Plans submitted with
the application show the proposed excavation of an approximately 450'
long by 15' wide (bottom width) by -4' MLW deep access channel within
Goose Creek. The proposed access channel is to be excavated by hy-
draulic dredge with the resultant spoil materials being placed behind a
proposed approximately 490' long by 200' wide diked disposal area. Ap-
proximately 6,750 sq.ft. of shallow bottom area would be excavated by
the proposed channel, with about 500 cu.yds. of primarily sand materials
being removed. The excavation of the access channel is to be so de-
signed to avoid all seagrass vegetation.
The proposed boat basin area is to be approximately 60' long by 60'
wide by -4' MLW deep and will be located into the applicant's high-
ground property. The proposed boat basin is to be bulkheaded and two
concrete boat ramps (each about 12' wide by 35' long by 4" thick) are
also proposed to be placed within the basin. Excavation of the basin
area would be accomplished by the use of a dragline, with the approxi-
mately 1,000 cu.yds. of spoil materials being placed within the afore-
mentioned diked disposal area. About 4,050 sq.ft. of highground area
would be removed in order to create a like amount of open water area
which presently does not exist.
The applicant is also proposing to bulkhead an approximately 475 lin.
ft. section of shoreline along Goose Creek. Bulkhead is proposed to
be located from 0 - 5' waterward of the MHW line (an average distance
being 2' beyond). No marsh will be bulkheaded and/or filled with
this proposed project.

10. Anticipated impacts
The project as proposed will result in the excavation of approximately
6,750 sq.ft. of shallow bottom area of Goose Creek, with about 500 cu.
yds. of sand material being pumped to a highground diked disposal
area. The proposed channel alignment has been reviewed by representa-
tive of both the DMF and DCM, and it appears that a 15' wide channel
could be excavated in high ground which would avoid seagrass vegeta-
tion. This alignment would, however, have to be staked in the field
and would not be exactly as shown on the submitted plats. The appli-
cant has also indicated that all "coon" oysters within the proposed
channel alignment would be relocated prior to excavation activities.
The proposed boat basin would result in the excavation of about 4,050
sq.ft. of highground area with the removal of about 1,000 cu.yds. of
dirt.. Two 12' wide concrete boat ramps would also be constructed
within the boat basin to provide boat launching capabilities. The
proposed bulkheading would result in the filling in of about 950 sq.
ft. of intertidal area, but would not impact any emergent or submer-
gent wetland vegetation.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section
401, Public.Laws 92-500 and 95-217 of.the United States and subject to the North
Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section
.0500 to Mr. Wayne Comer pursuant to an application filed on the 7th day of
February 1985 to construct a boat basin, ramp, and access channel on Goose Creek.
The application provides adequate assurance that the discharge of fill mater-
ial into the waters of Goose Creek in conjunction with the proposed boat basin,
ramp, and access.channel in Carteret County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate Sections 301, 302,
303, 306, and 307 of Public Laws 92-500 and 95-217 if conducted in accordance with
the application and conditions hereinafter set forth.
Conditions of Certification:
(1) That the activity be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-
related discharge (increases such that the turbidity in the stream is
25 NTU`s or less are not considered significant).
(2) All concrete.for the ramp shall be precast or poured in dewatered forms
so as to prevent wet concrete from contacting surface waters.
(3) After the spoil material has sufficiently dried, the site shall be graded
to slope away from.the boat basin area and shall be planted in grass.
No vehicular parking shall be allowed in this area.
(4) There shall not be any sewage discharged from boats within the basin or
access channel.
Violations of any conditions herein set forth shall result in revocation of
this Certification.
This Certification shall become null and void unless the above conditions are
made conditions of the Federal Permit.

8. Project summary The applicant proposes to excavate a boat basin, access channel and
to bulkhead his shoreline area at a site within and adjacent to Goose Creek at
Goose Creek Mobile Home Park off SR 1119 near the community of Bogue, Carteret County

9. Narrative description
The applicant's property is located on the east side of Goose Creek
and off SR 1119 near the community of Bogue; Carteret County. The
property has previously been developed into a 132 lot mobile home de-
velopment known as "Goose Creek Mobile Home Park Between the exist
ing mobile home park and-the shoreline of Goose Creek there is an ap-
proximately 250' wide area which is vacant and comprised mostly of
yard grasses with some trees toward the southern end. Existing ground
elevations range from about +2.5 to +5' mean sea level.
The shoreiine.of,the property as it abuts Goose Creek can be charac-
terized as having two significant pockets of Spartina alterniflora
marsh with the remaining shoreline consisting of an approximately 2-3'
(high vertical bank which shows signs of moderate erosion. Within
the intertidal area there are scattered concentrations of "coon" oys-
ters all along the applicant's shoreline. The offshore waters and bot-
toms of Goose Creek in front of the applicant's property are relatively
shallow and sandy in nature. There are also substantial scattered beds
of submerged "seagrass" vegetation all along this area. Previous bot-
tom surveys along the project area have also indicated the presence
of scattered amounts of clams. The waters:of Goose Creek have been
classified by the Div. of Env. Mgt. as SA waters,with the area imme-
diately upstream of the project having been classified by the Div. Mar.
Fish. as a primary nursery area.
The applicant is requesting a permit which would authorize the excava-
tion-of a boat ramp/basin area into his highground property, with an ac-
cess channel in Goose Creek in order to provide boat launching facili-
ties for the residents of his mobile home park. Plans submitted with
the application show the proposed excavation of an approximately 450'
long by 15' wide (bottom width) by -4' MLW deep access channel within
Goose Creek. The proposed access channel is to be excavated by hy-
draulic dredge with the resultant spoil materials being placed behind a,
proposed approximately 490' long by 200' wide diked disposal area. Ap-
proximately 6,750 sq.ft. of shallow bottom area would be excavated by
the proposed channel, with about 500 cu.yds. of primarily sand materials
being removed. The excavation of the access channel is to be so de-
signed to avoid all seagrass vegetation.
The proposed boat basin area is to be approximately 60' long by 60'
wide by -4' MLW deep and will be located into the applicant's high-
ground property. The proposed boat basin is to be bulkheaded and two
concrete boat ramps (each about 12' wide by 35' long by 4" thick) are
also proposed to be placed within the basin. Excavation of the basin
area would be accomplished by the use of a dragline, with the approxi-
mately 1,000 cu.yds. of spoil materials being placed within the afore-
mentioned diked disposal area. About 4,050 sq.ft. of highground area
would be removed in order to create a like amount of open water area
which presently does not exist.
The applicant is also proposing to bulkhead an approximately 475 lin.
. ft. section of shoreline along Goose Creek. Bulkhead is proposed to
be located from 0 - 5' waterward of the MHW line (an average distance
being 2' beyond). No marsh will be bulkheaded and/or filled with
this proposed project.

10. Anticipated 'impacts
The project as proposed will result in the excavation of approximately
6,750 sq.ft. of shallow bottom area of Goose Creek, with about 500 cu.
yds. of sand material being pumped to a highground diked disposal
area. The proposed channel alignment has been reviewed by representa-
tive of both the.DMF and DCM, and it appears that a 15' wide channel
could be excavated in high ground which would avoid seagrass vegeta-
tion. This alignment would, however, have'to be staked in the field
and would riot be exactly as shown on the submitted plats. The appli-
cant has also indicated that all."coon" oysters within the proposed
channel alignment would be relocated prior to excavation activities.
.The proposed boat basin would result in the excavation of about 4,050
sq.ft. of highground area with the removal of about 1,000 cu.yds. of
dirt.. Two 12' wide concrete boat ramps would also be constructed
within the boat basin to provide boat launching capabilities. The
proposed bulkheading would result in the filling in of about 950 sq.
ft. of intertidal area, but would not impact any emergent or submer-
gent wetland vegetation.

pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after.receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by April 29, 1985, the District Engineer
will deem that waiver has occurred.

Enclosed please find an application to dredge and/or fill submitted on
behalf of Wayne and Harold Comer. The project site is located on the eastern
shore of Goose Creek in Carteret County. They would like to excavate an access
channel from Goose Creek to existing high ground. A boat basin is planned to
accommodate the increasing access demands from their mobile home park residents.
In addition, concrete bulkheading is planned for a portion of their property
along Goose Creek.
The 450' x 15' access channel will begin in Goose Creek where a 4' water
depth exists. From there, it will-run approximately perpendicular to the shore-
line and will abate in a 60' x 60' boat basin. The proposed depth of the basin
and access channel is 4', thereby enhancing water circulation. Two 30' x 12'
concrete boat ramps (4" thick) will accommodate boat access needs. Neither the
access channel nor the basin will be excavated within 25' of the nearby marsh
area. The entire basin will be encompassed by a 4" thick poured concrete bulk-
head (reinforced). The landward edge will be abutted by a 4' wide deck to be
placed on existing ground. The deck will be made of 2" x 6" salt treated lumber.
The disposal area will be on adjacent high ground where eventual boat
trailer parking will be permitted. The spoil area is approximately 490' x 200'
and the excavated material for the channel and basin will raise the existing
ground level by .82'. An earthen dike will encompass the entire spoil area.
A hydraulic dredge will create the access channel and the basin will be dug
by dragline. This common retention area will service both operations.
Sections along Goose Creek are proposed to be bulkheaded (concrete). Be-
ginning at the existing wood bulkhead of J.R. Kelly, and extending in a norther-
ly direction, the Comer brothers would like to construct a 100' segment of bulk-
heading ending where a 180' area marsh exists. A bulkhead would begin again at
the northern end of this marsh and continue for 350' along the shoreline to
where the access channel intersects with high ground. It would continue
unabated around the basin and end where another portion of marsh exists about
30' north of the access channel. No marsh will be entrapped or destroyed by

any bulkheading or excavations. Approximately 300 cubic yards of material
will be used as backfill for those areas where the bulkheads extend beyond
the MWL. No bulkhead will extend more than 5' from existing MWL.

Reference the application of Mr. Wayne D. Comer for a
Department of the Army permit to maintain an access channel/canal
and a basin and construct boat. ramps, a bulkhead with fill and
piers on Goose Creek in Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to avoid adverse impacts during periods of high
biological activity, no excavation or filling will be
accomplished between the dates April 1 through September 30 of any
year without the prior approval of the U. S. Fish and,
Wildlife Service and the North Carolina Division of Coastal
Management.
b. The basin will be excavated landward of a sedimentation
barrier adequate to contain turbidity. A 24-hour period of time
will be allowed to expire after excavation within the basin and
before the barrier is removed to allow for maximum settlement of
suspended solids.
c. Prior to excavation, oysters present in the basin, canal
and channel alignments will be removed to an area which will not
be affected by the dredging.

d. No wetland vegetation will be excavated or filled.
e. The bulkhead will not be positioned farther than five
feet waterward from the mean high water (MHW) elevation at any
point along its alignment. The bulkhead will not be positioned
farther waterward from the MHW elevation contour than an average
distance of two feet. To prevent an unintentional violation of
this authorization, representatives of the North Carolina Division
of Coastal Management and the Corps of Engineers are available to
stake the alignment prior to construction.
f. All excavated materials will be confined landward of the
MHW elevation contour within adequate dikes or other retaining
structures to prevent spillover of solids into any marsh or
surrounding waters.
g. The terminal end of the pipeline from the hyudraulic
dredge into the diked retention area will be positioned at or
greater than 50 feet from any part of the dike and at a maximum
distance from spillways to prevent dike erosion and to allow
adequate settlement of suspended solids.
h . A water control structure will be installed at the
intake end of the effluent pipe leading fronm the retention area
in order to ensure maximum settlement of suspended solids.
i. Flow from the diked retention area will be confined by
pipe, trough or similar device to a point at or below the
elevation of mean low water (MLW) to prevent gully erosion
and resultant unnecessary siltation.
j. Excavation will not exceed four feet below the elevation
of MLW.

to bulkhead his shoreline area at a.site within and adjacent to Goose Creek at
Goose Creek Mobile Hane Park off SR 1119 near the commmity of Bogue, Carteret County

9. Narrative description
The applicant's property is located on the east side of Goose Creek
and off SR 1119 near the community of Bogue, Carteret County. The
property has previously been developed into a 132 lot mobile home de-
velopment known as "Goose Creek Mobile Home Park". Between the exist-
ing mobile home park and the shoreline of. Goose Creek there is an ap-
proximately 250' wide area which is vacant and comprised mostly of
yard grasses with some trees toward the southern end. Existing ground
-elevations range from about +2.5 to +5' mean sea level.
The shoreline of the property as it abuts Goose Creek can be charac-
terized as having two significant pockets of Spartina alterniflora
marsh with the remaining shoreline consisting of an approximately 2-3'
high vertical bank which shows signs of moderate erosion. Within
the intertidal area there are scattered concentrations of "coon" oys-
ters all along the applicant's shoreline The offshore waters and bot-
toms of Goose Creek in front of the applicant's property are relatively
shallow and sandy in nature. There are also substantial scattered beds
of submerged "seagrass" vegetation all along this area. Previous bot-
tom surveys along the project area have also indicated the presence
of scattered amounts of clams. The waters of Goose Creek have been
classified by the Div, of Env. Mgt. as SA waters with the area imme-
diately upstream of the project having been classified by the Div. Mar.
Fish. as a primary nursery area.
The applicant is requesting a permit which would authorize the excava-
tion-of a boat ramp/basin area into his highground property, with an ac-
cess channel in Goose Creek in order to provide boat launching facili-
ties for the residents of his mobile home park. Plans submitted with
the application show the proposed excavation of an approximately 450'
long by 15' wide (bottom width) by -4' MLW deep access channel within
Goose Creek. The proposed access channel.is to be excavated by hy-
draulic dredge with the resultant spoil materials being placed behind a-
proposed approximately 490' long by 200' wide diked disposal area. Ap-
proximately 6,750 sq.ft. of shallow bottom area would be excavated by-
the proposed channel, with about 500 cu.yds. of primarily sand materials
being removed. The excavation of the access channel is to be so de-
sianed to avoid all seagrass vegetation.
The proposed boat basin area is to be approximately 60' long by 60'
wide by -4' MLW deep and will be located into the applicant's high-
ground property. The proposed boat basin is to be bulkheaded and two
concrete boat ramps (each about 12' wide by 35' long by 4" thick). are
also proposed to be placed within the basin. Excavation of the basin
area would be accomplished by the use of a dragline, with the approxi-
mately 1,000 cu.yds. of spoil materials being placed within the afore-
mentioned diked disposal area. About 4,050 sq.ft. of hig.hground area
would be removed in order to create a like amount of open water area
which presently does not exist.
The applicant is also proposing to bulkhead an approximately 475 lin.
ft. section of shoreline along Goose Greek. Bulkhead is proposed to
be located from 0 - 5' waterward of the MHW line (an average distance
being 2' beyond). No marsh will be bulkheaded and/or filled with
this proposed project.

10. Anticipated impacts
The project as proposed will result in the excavation of approximately.
6,750 sq.ft. of shallow bottom area of Goose Creek, with about 500 cu.
,yds. of sand material being pumped to a highground diked disposal
area. The proposed channel alignment has been reviewed by representa-
tive of both the.DMF and DCM, and it appears that a 15' wide channel
could be excavated in high ground which would avoid seagrass vegeta-
tion. This alignment would, however, have•to be staked in the field
and would-riot.be exactly as shown on the submitted plats. The appli-
cant has also indicated that"all""coon" oysters within the proposed
channel alignment would be relocated prior to excavation activities.
The proposed boat basin would result in the excavation of about 4,050
sq.ft. of highground area with the removal of about 1,000 cu.yds. of
dirt.. Two 12' wide concrete boat ramps would also be constructed
within the boat basin to provide boat launching capabilities. The
proposed bulkheading would result in the filling in of about 950 sq.
ft. of intertidal area, but would not impact any emergent or submer-
gent wetland vegetation.
