Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All excavated materials shall be confined landward of the existing bulkhead. It is recommended that a 15' buffer zone be maintained between spoil materials and the existing bulkhead. (2) All excavated materials will be spread and provided with a ground cover sufficient to restrain erosion within 30 days of project completion. (3) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (4) Erosion control measures must be installed at the outset to prevent any sediment from getting into Newport River as a result of this land disturbing activity. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary Applicant proposes to construct a new hos hate barae rt terminal adjacent to Ne ort River at the, Morehead city Poin Carteret County. - _ :; 4?, 9. Narrative description 10. The applicants are leasees from the N. C. State Ports Authority. The applicants have major investments in phosphates, phosphate deri- vities, bulkhandling and bulk storage facilities at the Morehead City port terminal. These facilities are concentrated primarily on the north and northeast side of the port bordering Newport River. The elevations in this area are in excess of 8' and the land is in- tensely developed being covered primarily by eithr asphalt or con- crete. A vertical concrete bulkhead borders the shoreline in this Area. The applicants are undertaking a major redevelopment and improvement project of their facilities in the area. A new'bulk storage build- ing is being constructed west of the existing bulk storage building, and two new phosphoric acid tanks are being constructed east of this bulk storage building between it and the air supported building. All of the development is being undertaken landward of the estuarine shore- line AEC. Within the estuarine shoreline AEC, and associated with the redevelop- ment, the applicants are proposing to replace the existing barge off- loading conveyors with more efficient equipment. A self contained barge unloader designed to run on tracks is being proposed. This device will run on rails'supported by two 650' concrete caps which will rest on subterrestrial piles. Once the unloader is installed, the unloading arm will extend up to 40' offshore when in use. Anticipated impacts Conducting the project as proposed will result in the disturbance of about 25,920 sq.ft. of highground area landward of the existing bulk- head structure, divided equally between (and centered on) the pro- posed track alignments. No direct impacts should occur to the adja- cent waters of Newport River, and in operation an increase in effi- ciency should occur in the handling of the phosphate materials, re-- ducing stray nutirents. The potential for the erosion of excavated sediments exists, however. Adjacent waters support commercial populations of trout, spot, croaker and other finfish, various shellfish such as clam and oysters, and other commercial important species such as blue crabs and shrimp.
