The source hag beon advised to apply for an air quality permit. To date, no application has been received. The source has also been notified that operating any crushing equipment is to violate the North Carolina Administrative Code. Box 2071 Boone, North Carolina 28607 Dear Mr. Cecile: SUbJG0t: Air Permit No, 213SR4 K & C Crushed stone Bamboo Road Quarry Boone, North Carolina Watauga County Reference is made to your letter dated February 16, 1993, claiming that this off ice erred in not issuing Permit No. 2135R4 in the name of K & C Crushed Stone. You were notified in a letter dated rebruary 1, 1993 that Permit No. 213SR4, issued November 16, 1992 to K C Crushed Stone, Inc., had been declared null and void since *1K C Crushed Stone, Inc." has no valid status as a corporation. You claim that this of f ice should have issued the permit to 01K & C Crushed Stone". In fact, the permit application (form AQ -22) was made in the name of "K C Stone" which also has no valid status as a corporation. Since the application was made in the context of a permit renewal and since no specific request was made for a name change, the permit was issued to K & C Crushed Stone, Inc., the holder of the previous permite Permit No. 2135R3. If this action was unacceptable to you, you should have requested a modification within 30 days using the procedures outlined in paragraphs 2 and 3 of the cover letter for Permit No. 2135R4. U" it remains the position of this Division that X & C Crushed Stone does not hold an Air Quality Permit and to operate crushinq, screening and/or conveying equipment would be a violation of North Carolina General Statute (NCGS) 143-215.108, and 15A North Carolina Administrative Code (NCAC) 2H .0600, "Air Quality Permits." Each day that you operated the subject unpermitted equipment could constitute an additional violation of 15A NCAC 2H .0600. Each violation is subject to enforcement action, including a civil penalty of up to $10,000 and/or injunctive relief, pursuant to NCGS 143-215.114. If you wish to operate the equipment you are advised to submit an application (form AQ -22, enclosed) and acquire a permit for the equipment prior to operation. Your application must include a copy of your written request for a "determination of consistency" with any local government zoning or subdivision ordinance bearing the date of receipt entered by the clerk of each local government having jurisdiction (instructions enclosed). A $50.00 permit processing fee is required, and you should submit a check payable to the North Carolina Department of Environment, Health and Natural Resources along with your permit application.
