Dear Mr. Keith:
On December 21, 2007, the Division of Water Quality (DWQ) received your revised application
dated December 17, 2007 to impact 330 square feet (ft) of Zone 2 protected riparian buffers for
the pump station at the site. The DWQ has determined that your application was still incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected buffers on the subject
property. Since this project was put on hold for additional information on January 11, 2008 and
you failed to respond, DWQ is returning your application. To reapply, please provide the
following information so that we may review your project.
1. Buffer Mitigation
Buffer mitigation will be required as a condition if you choose to proceed with the Minor
Variance. If you choose to proceed with a variance, then please provide a buffer
mitigation plan pursuant to 15A NCAC 02B .0233. If you choose to pay into a mitigation
bank for the required mitigation, please provide an acceptance letter from the mitigation
bank demonstrating they have the available mitigation credits.
2. Stormwater Management
Stormwater management will be required as a condition if you choose to proceed with the
Minor Variance. Please provide a detailed stormwater management plan depicting how
you intend to treat the stormwater running off the proposed impervious surfaces. Please
include all applicable worksheets and Inspection & Maintenance (I&M) agreements.

3. Diffuse Flow
Diffuse flow will be required as a condition if you choose to proceed with the Minor
Variance. Please provide a diffuse flow measure on your plan sheets depicting how you
intend to diffuse the stormwater through the protected buffers. Please include all
applicable worksheets and Inspection & Maintenance (I&M) agreements.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Amy Chapman or Cyndi Karoly at 919-
