Granville Lilley 214 Whispering Pines Road Washington, NC 27889 DWQ Project # 2003-0280v2 Granville County On-Site Determination for Applicability to the Tar-Pamlico River Riparian Area Protection Rules (15A NCAC 2B .0259) Dear Mr. Lilley: On February 10, 2009, at your request Amy Chapman conducted an on-site determination to review one stream feature located on the subject property for applicability to the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259). The feature is labeled as "08-1854B" on the attached maps initialed by Amy Chapman on February 11, 2009. Roberto Scheller from the Division of Water Quality (DWQ) Washington Regional Office had previously conducted an on-site determination of the stream. In your undated letter to the Director received by DWQ on January 8, 2009, you requested an appeal of his determination as provided within 15A NCAC 02B .0259(3)(a). At your request, Amy Chapman conducted an appeal of Roberto Scheller's previous determination as stated above. During the review Amy Chapman evaluated the stream using the DWQ Stream Classification Form (form). She evaluated the point at which she believed the stream to begin and calculated the score of that reach to be 30.5 points for "08-1854B". The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". The DWQ has determined that the stream labeled as "08-1854B" on the attached map is "perennial" and is subject to the Tar-Pamlico Buffer Rule. This stream and its associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers.
