Attached is a copy of the Division of Land Resources letter regarding their disapproval of the proposed
temporary access crossing. Based on this letter the engineer, High Point, and Kernersville are working hard to
negotiate other access. I would request that you hold your review of the project modification until this is
resolved. We are already on hold with DWQ pending an application fee, and will be waiting to pay that until this
issue is resolved.
Thanks for your time, and I will be in touch to give you an update on the resolution of this issue.

You may submit a revised erosion and sedimentation control plan for approval addressing those
items outlined on the enclosed form. Under the authority ofNCGS 113A-a4.l(a), this office has 15
days from the date of receipt to approve or disapprove your revised plan. However, if you wish to
contest the disapproval of this plan, you must request an administrative hearing within 60 days of
your receipt of this letter of Disapproval. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office oil'
Administrative Hearings, 6714 Mail Service Center, Raleigh. North Carolina 27699-6714. A copy
of the petition must be served on this Department as follows:

activity associated with this project shall constitute a violation of the Sedimentation Pollution
Control Act of 1973 (NCGS I l3A-5I through 66).

This project is located within the "Randleman Lake Water Supply Watershed Protection.
Rules." The destruction of additional area within the protected buffers does not comply with
15A NCAC 04B.0112 "Operations in Lakes or Natural Watercourses" and will not be
allowed. Construction access should be gained as originally permitted. As an alternative,
you may want to consider contacting PedEx Ground Package Systems, Inc. and obtain a
temporary construction easement across their proposed si.te development. If construction
easement access changes from what was originally permitted, ensure adequate documentation
is provided to Land Quality.
