Dear Sirs:
Effective April 20, 2004, restoration efforts for the impacted stream channel and riparian
buffers at the referenced site were completed in accordance with the approved
Restoration Plan.
Construction consisted of the restoration of 110 linear feet of impacts resulting from the
placement oftwin reinforced concrete pipe culverts beneath a cul-de-sac along the west
side of Studbury Hall Court. Details of the construction and restoration methodology are
described in the Stonegate Phase 5A Stream and Neuse River Buffer Restoration Plan
dated May 2003 prepared by S&EC. Upon completion of the construction, stream bank
and buffer planting was performed.
For your information we have attached a series of pre- and post-construction photographs
which describe the restoration efforts. Each set of photos were taken in the same general
location for ease of reference. Slight differences in perspective may be noticed due to the
fact that large portions of the previously installed culverts have been removed. We have
also included a completed copy of the DWQ Certificate of Completion as required in the
401 Water Quality Certification letter dated January 9, 2003.

Dear Mr. Sandman;
You have our approval, in accordance with the attached conditions, to impact 0.39 acres of buffers
for the purpose of constructing a res,idential subdivision as you described in your application dated
January 9, 2003. After reviewing your application we have decided, this fill is covered by General
Water Quality Certification Numbers 3374 and 3375. TI1;S Certification allows you to use Nationwide
Pennit Numbers 12 and 14 when the Corps of Engineers issues it. This approval is' also valid for the
Noose River buffer rules (HA NCAC 2B .0233). In addition, you should get any other foderal, state or
local pennits before you go ahead with your projectincluc1ing (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Als() this
approval will expire when tbe accompanying 404 or CAMA permit expires unlesB otherwise
speclfled in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project. you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible fO,r
complying whh all conditions. This approval shall eJl.pire when the co,rresponding Nationwide Pennit
expires or as otherwise proVided in the General Certification. If total wetland fills for this project (now
or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
28 .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and those listed below.
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules. and any subsequent modifications, the applicant is required to retum the attached
certificate of comp.1etion to the 401/Wetlands Unit, North Carolina Division of Water QuaJjty,
1650 Mail Service Center, Raleigh, Ne, 27699-1650.
2. Deed notifications or similar .mechanisms shall be placed on all retained juriSdictional wetlands,
waters and protective buffers in order to assure compliance for future wetland, water and buffer
impact. These mechanisms shall be put in place prior to impacting any wetlands, waters ancVor
buffers approved for,impact under this Certification Approval and Authori,zatJon CertIficate. A

3. An additional condition is that stonnwater shall be directed to flow in a diffuse manner at non-
erosive velocities through the entire protected stream buffers without re-concentrating.
Additionally, a stormwater management plan for this project shall be provided to this Office
before any of the impacts approved herein are conducted. The plan shall sPecify all stormwater
discharge points, plan details~ and calculations to indicate that diffuse flow through the protected
buffe,rs as described above wiJI be achieved.
If you <<So not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You ,must act within 60 days of the date that you r.eceive this letter. To ask for a hearing, send
a written petition, which confo,rms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447~ Raleigh, N.C. 27611-7447. This certification and. its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The Wetlands Unit staff reviewed the stormwater management plans for the subject project and determined that condition
no. 3 of the 401 Water Quality Certification and Neuse Buffer Approval will not be met:
1 . Diffuse Flow
Condition no. 3 stipulates that all stormwater must flow in a diffuse manner through the protected buffers. Discharge
points labeled nos. CB 6, 10, and 17 A and YI 20B are not expected to achieve diffuse flow through the buffers
based on the design information provided. The level spreaders at nos. CB 25 and 23 are not sized per the Draft
Level Spreader Design Options available at http://h20,ehnr.state.nc.us/ncwetlands/level.pdf.ltis recommended that
the stormwater discharges be redesigned per the above criteria.

Dear Mr. Adams:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 300 feet of intermittent stream and 32,300 square feet (ff) of protected riparian buffers associated
with the previously constructed Studbury Hall Court, as described within your application dated October 14,2002. After
reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ)
General Water Quality Certification Number(s) 3362. The Certification(s) allows you to use Nationwide Permit 39 when
issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization
Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go ahead with your project including
(but not limited to) Erosion and Sediment Control and Non-discharge. Also, this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification. This approval shall replace
the approval issued on October 28, 2002.
This approval is only valid for the purpose and design that you described in your application, If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
1. Stream/Buffer Restoration and Buffer Preservation
Work on the 110 feet of "restored stream channel" must result in a stable channel. The associated restored buffer
must have adequate cover of woody vegetation. The buffer preservation areas must be protected with a
conservation easement or similar mechanism and DWQ must be copied on this legal mechanism within 60 days of
the date of this letter. (If this notice of the conservation easement has already been submitted to the DWQ, then no
further notices need to be sent.)
2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.

Dear Mr. Adams:
You have our approval, in accordance with the attached conditions and those listed below, to
temporarily impact an additional 300 linear feet of stream for the construction of a cul-de-sac at
Studbury Hall Court in Stonegate Subdivision Phase 5A, as you described in your application dated
October 14, 2002 (received October 15, 2002). After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Number 3362. This certification allows you
to use Nationwide Permit Number 39 when the U.S. Army Corps of Engineers issues it. This approval
is also valid for the required DWQ approval under the Neuse River buffer rules (15A NCAC 28
.0233).
In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, and
Non-Discharge regulations. This approval will expire when the accompanying 404 Permit
expires unless otherwise specified in the General Water Quality Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must
follow the conditions listed in the attached certification and any special or site-specific conditions
listed below.
SPECIAL CONDITIONS:
1. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate
of Completion Form" to notify DWa that all the work included in the 401 Certification has been
completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the Division of Water Quality.
2. If you change your project, you must notify us in writing and you may be required to send us a
new application.
3. If total wetland fills for this project (now or in the future) exceed one acre or permanent,
perennial stream impacts exceed 150 linear feet, then compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7).

SITE-SPECIFIC CONDITIONS:
1. Additional written approval is needed from DWQ under a Minor Variance from the Neuse River
buffer rules for construction of any homes within 50 feet of the existing channel or the channel
that will be reopened as a result of this approval. Until the site plans are completed for these
lots, it is not clear whether Minor Variances are needed. Please be aware that these Minor
Variances may require additional, compensatory buffer mitigation.
2. Work on the re-opened stream channel must result in a stable channel with adequate cover with
woody vegetation. The buffer preservation areas must be protected with a conservation
easement or similar mechanism and DWQ must be copied on this legal mechanism within 60
days of the date of this letter.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory

The purpose of this letter is to request an after-the-fact Nationwide permit for
unauthorized impacts to a stream channel and buffers at Stonegate Subdivision Phase 5A
We also request an after-the-fact 401 Water Quality Certification and Buffer approval for
the project from the NC-DWQ. A Pre-construction Notification i\pplication (PCN) is
attached, as well as an agent authorization form.
The subject project is located approximately % mile southeast of the intersection of Ligon
Mill Road (SR 2044 and Burlington Road (SR 2045). The site is bounded to the west by
Ligon Mill Road and is adjacent to Toms Creek, Please refer to the USGS topographic
map attached for the location of the project.
Stonegate Subdivision is a proposed residential subdivision and is considered part of the
St. Andrews Plantation project by the USi\CE and NC-DWQ. On December 20,2001,
the USi\CE notified the applicant that an after-the-fact permit would be required as
remedial action for unauthorized impacts to an unnamed tributary of Toms Creek located
on-site. Approximately 410 linear feet of channel has been impacted for the purpose of

preparing the site for residential development, 110 feet of the impact will be restored
leaving 300' of channel impact. Per a 2/20/02 conversation with Ms, Amanda Jones, the
USACE considers the impacted channel to be "unimportant". A site meeting was
conducted on 4/30/02 with Mr, Steve Mitchell to review the site tlnd develop a strategy
for resolving the impact issues, A previous consultant handled the confirmation of the
Wetlands and Neuse Buffers on-site, According to the Buffer plat provided by the
previous consultant, signed by Mr, Steve Mitchell ofNC-DWQ, the impacted channel
feature on the southwestern corner of Stonegate was determined to be an ephemeral
channel and therefore not subject to the Neuse River Buffer Rules. However, Mr,
Mitchell's records are not consistent with those supplied to the project engineer and
developer by the previous consultant. Therefore, DWQ has chosen to attempt to resolve
the matter in a fashion that complies with the rules but does not unfairly punish the
developer. Especially considering the fact that the road is already constructed.
Wetlands within the proposed Stonegate Subdivision were originally delineated by
another consultant. Mr, Todd Tugwell, of the USACE, approved the previous
consultant's wetland delineation on August 3rd, 2001 (Action ID 200021063), The
previous consultant advised the applicant and project engineer that the wetland
delineation approved by the USACE included the area of unauthorized impact and that no
jurisdictional wetlands or waters were present in the subject area, Based on this
information, the applicant and engineer designed the subdivision and placed a culvert in
the subject area to prepare the site for residential development. However, contrary to the
information provided to the applicant by the previous consultant, USACE records
indicate that the consultant never obtained a jurisdictional determination for the subject
area, S&EC flagged the remaining unimpacted jurisdictional channel on-site and
determined that no additional wetlands or waters were present within Phase I of
Stonegate, Our flags were surveyed by the John R, McAdams Company and are shown
on the attached plan.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and may require
compensatory mitigation to offset unavoidable losses of waters of the US when impacts
exceed the requirements for notification (0,10 acre) or if a discharge to a special aquatic
site such as wetlands is proposed, The applicant is complying with the USACE's request
to submit for an after-the-fact permit. The applicant requested that S&EC delineate the
remaining undisturbed channel on-site in order to avoid any additional channel impact.
The applicant plans to avoid any further impacts to the channel feature and does not plan
to impact any other wetlands or waters within Phase 5A of Stonegate Subdivision (see
attached plan). Also 110' of the impacted channel will be restored, The Corps has
indicated that no additional mitigation would be required for the project.
NC-DWQ's current policy requires stream mitigation for impacts greater than 150 linear
feet per project to stream channels containing significant aquatic function, An office

meeting with Mr, Steve Mitchell, Mr, John Dorney, and myself occurred on 8/01/02 to
determine acceptable mitigation for DWQ, At the meeting it was agreed that providing
Stormwater treatment that would not otherwise be required for the more densely
developed areas of Phase 6 would be acceptable to offset stream impacts, In addition
preservation at a S:1 ratio of existing buffers SO'-100' from a buffered stream and at a
10: 1 ratio 100' -200' from a stream was determined to be acceptable for buffer mitigation,
A detailed description of mitigation requirements is in the attached 9/12/02 John R,
McAdams letter site plans and stormwater plans for Phase 6 are also attached. Plans
were revised in Phase SA so that no Zone 1 impacts are required for lot development (see
attached lot plan). Stormwater from the Phase SA project will be required to meet the
diffuse flow requirements also. Attached is a plan from John R. McAdams detailing how
Stormwater is being handled in Phase SA. We believe that the attached package contains
all the mitigation requirements required to satisfy DWQ and put this matter to rest. Since
impacts to Zone 2 are necessary for four of the lots a minor variance form is also
attached,

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action 10 Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
Nationwide permits 12, 14, and 26 were issued for use on St. Andrews, Phase II in June of 1994
(Action ID Number 199402915). These permits authorized impacts to 0.53 acre of wetlands
(0.28 for utility lines, 0.18 for road crossings, and 0.07 for driveways). 401 Water Quality
Certification was issued for these impacts (OEM Project # 94487). Nationwide Permits 13, 14
and 26 were issued for St. Andrews, Phase IV, in 1997, and authorized 0.1 032 acre of impacts
(0.0977 acre for filling and 0.0055 acre for bank stabilization). 401 Water Quality Certification
was issued for these impacts in May 1997 (DWQ Project # 970318). Nationwide Permits 14 and
39 were issued for use on St. Andrews, Phase V in July of 200 I (Action IDs 200120869 &
200121149). NWP 14 authorized impacts to 0.028 acre of wetland (which included 95 linear
feet of stream channel) associated with a road crossing, and NWP 39 authorized 0.027 acre of lot
fill, for a total impact of 0.034 acre (95 linear feet of channel). The applicant was required to
mitigate for 0.027 acre of lot fill impact and opted to make payment to the North Carolina
Wetlands Restoration Program in the amount necessary to perform restoration to 0.054 acre.
The USACE issued a Notification of Unauthorized Activity for Phase I of Stonegate
Subdivision on December 20, 2001 (Action ID 200220341). The notification requested that an
after-the-fact permit be submitted for the unauthorized work.

V. Future Project Plans
Are any additional permit requests anticipated for this project in the future? If so, describe the
anticipated work, and provide justification for the exclusion of this work from the current
application: Stonegate Subdivision is considered part of the same proiect as St. Andrews
Plantation. The St. Andrews Plantation Phase VI application submitted by Appian in February
2001 has been withdrawn by the applicant. Phase VI of St. Andrews Plantation will be
redesigned by John R. McAdams and S&EC has been retained to handle Phase VI 401/404
issues. Once plans are completed, S&EC will submit for Phase VI permits if needed. However,
for now submitted mitigation plans describe areas on Phase 6 to be used for mitigation.

It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent

plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a

VII. Impact Justification (A voidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Wetlands on-site were delineated by another consultant. The previous consultant advised the
applicant and project engineer that the wetland delineation approved by the USACE included the
area of unauthorized impact and that no jurisdictional wetlands or waters were present in the
subiect area. Based on the previous consultant's evaluation that the area was not jurisdictional.
the applicant and engineer designed the subdivision and placed a culvert in the subject area to
prepare the site for residential development. However, contrary to the information provided to
the applicant by the previous consultant. USACE records indicate that the consultant never
obtained a jurisdictional determination for the subject area. The USACE has conducted a site
visit and determined that a culvert has been placed in an unimportant jurisdictional channel and
that an after-the-fact permit will be required.
The applicant is complying with the USACE's request to submit for an after-the-fact permit.
The applicant requested that S&EC delineate the remaining undisturbed channel on-site in order
to avoid any additional channel impact. The applicant plans to avoid any further impacts to the
channel feature and does not plan to impact any other wetlands or waters within Phase I of
Stonegate Subdivision (see attached plan).
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

The attached exhibits renect the repair and reconstruction work proposed in the
area of the St. Andrews - Phase SA project, the additional bu1Tering that can be
provided in future projects and the preliminary calculations for a storm water
treatment facility to treat run-01T from the more impervious uses in the future
development.
Impacts
We will be eliminating approximately 110 linear feet of impact to the
stream channel by reducing the length of the existing parallel culverts
and removal of three storm drainage structures. The stream channel
and buffer will be re-established in this area, The remaining stream
impact is approximately 300 linear feet.
Two outlet pipes from the roadway will be shortened and flow will
pass through a "Preformed Scour Hole with Level Spreader" at the
outlet of each pipe,
Other than the buffer impacted by the culverts and dissipator, the 30
ft., Zone L stream buffers will be re-established and recorded on the
plats for these lots, The proposed houses and driveways will not
impact the Zone 1 buffer area.
Other than the buffer impacted by the culverts and dissipator the 20 11:"
Zone 2, stream buffer will only have minor impacts for the
construction of 4 houses. The total impact for the 40 n. x 40 ft..
building area, as shown on the exhibit, is 2,294 SF.

SEEDBED PFEPARAllON
1.) Chisel compacted areas and spread topsoil 3 inches deep over adverse soil
conditions, if available.
2.) Rip the entire area to 6 inches deep.
3.) Remove all loose rock, roots, and other obstructions leaving surface
reasonably smooth and uniform.
4.) Apply agricultural lime, fertilizer, and superphosphate uniformly and mix with
soil. (see below)
5.) Continue tillage until a well-pulverized, firm, reasonably uniform seedbed is
prepared 4 to 6 inches deep.
6.) Seed on freshly prepared seedbed and cover seed lightly with seeding
equipment or cultipack after seeding.
7.) Mulch immediately after seeding and anchor mulch.
8.) Inspect all seeded areas and make necessary repairs or reseedings within
the planting season, if possible. If stand should be over 60% damaged.
reestablish following original lime, fertilizer, and seeding rates.
9.) Consult Conservation Inspector for maintenance treatment and fertilization
after permanent cover is established.
Apply: Agricultural Limestone - 2 tons / acre ( 3 tons / acre in clay soils).
Fertilizer - 1000 Ibs. / acre 10-10-10. Superphosphate - 500 Ibs. / acre -
20%. Mulch - 2 tons / acre - small grain straw. Anchor - Asphalt Emulsion
@ 300 gals. / acre.

CONSTRUCTION SEOUENCE
1. Obtain letter of Plan Approval for sedimentation and erosion control.
2. Install all erosion control measures as shown on the approved
plans. Clear only as necessary to install these devices.
3. Obtain certificate of compliance through on-site inspection by City
Environmental Inspector.
4. Proceed with clearing, grubbing. and rough grading.
5. Install storm sewer, if shown, and protect inlets with inlet protection
devices, sediment traps, or other approved measures, as shown on
plans. Maintain devices as needed.
6. Establish ground cover on graded slopes and fills.
7. Stabilize site as areas ore brought up to finished grade with
vegetation or pavement.
8. When construction is complete and all areas have been stabilized,
request final inspection by City Environmental Inspector.
9. If site is approved, remove soil erosion control measures and
stabilize these areas. All permanent erosion control devices. such as
velocity dissipaters. should be installed now.
10. Obtain Letter of Completion.
Consult Conservation Engineer or Soil Conservation Service for additional
information concerning other alternatives for vegitation of denuded areas. The
above vegetation rates are those which do well under local conditions; other
seeding rate combinations are possible.
Reseed according to optimum season for desired perminate vegitation. Do
not allow temporary cover to grow over 12" in heigh t before mowing, otherwise
fescue may be shaded out.
