Za n, When we reached out for the additional information requested,we discovered that the engineering firm/contractor was unaware that the 401 permit had not been issued/needed. As a result of miscommunication, impacts associated with the utility line installation on Block G were initiated on August 28, 2017 when the 404 permit was issued, and were completed during the week of September 11, 2017. Attached is a photograph of the completed sewer line installation. Utility installation on Block F has not occurred. The client would like to continue with the 401 permit after-the-fact, in order to account for the unauthorized impacts on Block G, and would like to continue pursuing the 401 permit for Block F. Please see the responses below: 1. Please provide a typical or construction sequence showing how the proposed work will meet General Condition 9 of Water Quality Certification 4086, which states that"all work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with the disturbed area." [15A NCAC 02H .0506(b)(3)] A pump around system/apparatus will be used to divert flow during utility line installation on Block F.This system incorporates the use of a temporary, impervious dike near the water intake area. Water will be collected via an intake hose and pumped around the existing stream channel via a discharge hose. The impervious dike used to capture water near the intake hose will be removed upon the completion of construction activities. 2. Figure 3.5 shows Class B rip rap installation for the stream crossing detail. The stabilization method in the Project Description and Avoidance and Minimization sections of the PCN states, "the wetlands and stream bank will be returned to pre-existing conditions after installation and will be stabilized with matting and seed". Please update Figure 3.5 to reflect the proposed stabilization method description in the PCN or provide justification for the use of rip rap on the streambank.
