Approval of 401 Water Quality Certification and Authorization Certificate per the Neuse
River Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions
Dear Mr. Sullivan:

You have our approval, in accordance with the attached cqnditions and those listed below, to
place fill within or otherwise impact 78 feet of streams, 0.27 acres of wetlands, and 7659 square
feet (ft2) of protected riparian buffers for the purpose of a rdad crossing at the subject property,
as described within your application dated October 30, 2001(application received by the Division
of Water Quality on November 12, 2003) and the additional information received on January 28,
2004, May, 272004, and July 21,2004 by the N.C. Division of Water Quality (DWQ). After
reviewing your application, we have decided that the impacts are covered by General Water
Quality Certification Number 3404 (GC3404). The Certification allows you to use Nationwide
Permit 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act
as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A
NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control, Non-discharge, and construction stormwater permit
(NCGOlOOOO). Also, this approval to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application shall expire upon expiration of the 404 or
CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

4. No Sediment & Erosion Control Measures win Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in
wetlands and waters is unavoidable, they shall be removed and the natural grade restored
within six months of the date that the Division of Land Resources has released the
project.
5. Construction Stormwater Permit NCGOlOOOO
1. Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division
of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control
program, an NPDES General stormwater permit (NCGOlOOOO) administered by DWQ is
automatically issued to the project. This General Permit allows stormwater to be
discharged during land disturbing construction activities as stipulated by conditions in the
permit. If your project is covered by this permit [applicable to construction projects that
disturb one (1) or more acres], full compliance with permit conditions including the
sedimentation control plan, self-monitoring, recoiq keeping and reporting requirements
are required. A copy of this permit and monitoring\report forms may be found at

6. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401/Wetlands Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification, shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act and the Neuse Riparian buffer protection rule as described within 15A NCAC 2B

Dear Mr. Sullivan:
On November 28, 2004, Wetlands/401 Unit of the Division of Water Quality received the additional information
requested in a letter sent to you from the DWQ dated November 15,1003 to impact 0.27 acres of wetlands, 78 feet of
stream, and 7659 square feet of protected riparian buffers to construct the proposed Fern Valley Subdivision, Phase IV. On
May 27, 2004, DWQ received additional information in response to.a February 10,2004 DWQ additional information
letter. After review of your response, this office is placing your project on hold. Please note that if the response to this
letter is not adequate, that DWQ will return the application and you will need to reapply with a new fee. We will require
you to address the following items in order to allow processing of you! project to continue pursuant to 15A NCAC 2B
.0500.
1) Upon review of the material, DWQ staff were unable to determine whether the feature located on western portion of
the tract was subject to Neuse Riparian Buffer Rules. The site vicinity did not match exactly one of the plan sets
provided in the application. As such, please address in your response whether the feature is depicted on the Wake
County Soil Survey and/or USGS map and properly confirm/determine whether western feature (labeled wetlands on
the plans) is subject to Riparian Buffer Rules.
2) If the abovementioned feature is subject to the Neuse buffer rules, your plans need to depict buffers accordingly.
3) Your response to the February 10,2004, DWQ additional information letter indicated the following" The stub road
labeled Ivey Valley Drive is south of the pond described. Its construction has no impact on buffers or wetlands. This
stub was required by the town of Fuquay as a part of the town thoroughfare plan."
Pursuant to 15A NCAC 2H .0506 (b) (4) the wetlands 401 Unit is required to adequately address cumulative impacts.
As such, provide documentation from the Town of Fuquay Varina that this "stub-out" is a part of the thoroughplan and
is required by the Town. From your response, possible follow-up discussions with the Town, the Transportation Unit
ofDWQ, and US Army Corps of Engineers, a determination will be made as to whether this road crossing/project
meets conditions of this rule and whether the Certification for this project may be issued.
4) Please provide a detail of the road crossing. You explained in your response that three (3) 30 inch pipes will be used
in the crossing. Please detail, the toe slope fill of the crossing, the plans must show the specific placement of the
pipes, the plans must show the location of the stream channel with respect the pipe placement, the plans must also
show the location of any inlet and/or outlet stabilization measures (rip-rap), and explain how the flow will be directed
back into the channel. It is the experience of the Wetlands Unit staff that muti-cuverted crossing, like that indicated in
your application, will result in impacts to the stream well beyond the footprint of the toe slope fill, due to bank
destabilization and the need to connect flow into the original stream channel. If these impacts occur, they must be
addressed as apart of this application.
If you have any questions or would require any additional information please contact Danny Smith at (919)

Re: Fern Valley, Phase 4, Ivy Valley Drive Extension
Dear Mr. Bagley:
In response to your question about the extension oflvy Valley Drive, this street is defined
by the Town as a Residential Collector Street and therefore is required to continue east
and intersect with Sunset Lake Road. The right of way and road construction oflvy
Valley Drive must extend to the eastern property line of Fern Valley Phase 4 in
accordance with the approved construction drawings. This improvement will then allow
the street to continue as part of the next phase of Fern Valley or provide a connection
with future development to tie to Sunset Lake Road.
I hope this clarifies any questions regarding the extension oflvy Valley Drive. When
Fern Valley was first submitted to the Town for review in 1997 it was discussed at that
time that the project, if additional phases were added, that Ivy Valley Drive would
continue east toward and intersect with Sunset Lake Road.

Attached for your files and review are seven sets (7) of the sheets showing the revisions to
plans addressing your comments from Feb. 102004. Also, the following are written responses to your
like numbered comments.
I. The area in question on the west property line at Sethcreek Drive is subject to Neuse
Riparian Buffer Rules.
2. The plans now show the Neuse Buffers as requested. This can be seen on sheet 2 of7
at the end of Sethcreek Drive.
3. The stub road labeled Ivey valley drive is more than 150 feet south of the pond
described. Its construction has no impact on buffers or wetlands. This stub was
required by the town of Fuquay as a part of the town roadway system plan. A letter
from the town planner is attached for your consideration requiring us to complete this
stub per plans.
4. The pipe design was for three 30" pipes required to prevent overtopping of the
roadway in the event of a 25 year storm event. We recognize that for most rainfalls, a
single pipe would be adequate. The town engineer requiring that the headwater not
flood lots or overtop the road is Jay Myers. You may contact Jay Meyers at 567-
3911. A detail of the crossing is attached.

Dear Mr. Floyd:
On January 28, 2004, the Division of Water Quality (DWQ) received the additional information requested in a letter sent to
you from the DWQ dated November 25, 2003 to impact 0.27 acres of wetlands, 78 feet of stream and 7659 square feet
(fe) of protected riparian buffers to construct the proposed Fern Valley Subdivision, Phase IV. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetland, streams and/or buffers on the
subject property. Therefore, unless we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and 28 .0233(8) and will place this project on hold as
incomplete until we receive this additional information. Please provide 7 copies of the following information so that we
may continue to review your project. This information should be submitted to this office at the address within this
letterhead. Please be aware that if these issues are not adequately addressed with this third submittal, then we will return
your application and require you to reapply with a new fee and revised application.
Additional Information:
1. DWQ previously requested that you provide cross section details showing the provisions for aquatic life passage for
your road crossing; however this was not provided. Please submit these details.
2. DWQ previously requested that you indicate the diffuse flow provision measures on the site plan; however this was
not provided. These diffuse flow provisions need to be located out of wetlands and buffers and around all stream
features within your site plans. Also note that if a stream feature exists adjacent to your site plans, then diffuse flow
provisions could possibly be needed in these areas as well.
3. Please show all stream impacts including all fill slopes, dissipaters and bank stabilization on the site plan. Please
note that this could increase the amount of stream impacts previously applied for and would require an additional
application fee.
4. The stub road labeled as Ivy Valley Drive on the plans does not appear to be necessary. It appears that this stub
road is directed towards an existing pond, and this impact would be hard to permit for future development. Please
eliminate the stub road or provide additional information as to why it is necessary for this project.
5. Please clarify on your application if you plan to use one 36" pipe or two 42" pipes in your road crossing, since this is
unclear in your application.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility. and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts. and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction

VIII. Mitigation
DWQ - In accordance with I5A NCAC 2H .0500, mitIgation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessaTY_'_~o ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative' value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include.
but are not limited to: reducing the size of the project; establishing and maintaining wetland
andlor upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any appljcation
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
