I write to request, pursuant to N.C.G.S.§ 132-6, that you furnish copies of the following public
records:
All records (whether an original or a copy) within the custody or care of the N.C.
Division of Water Quality (NCDWQ), or any of its employees or consultants,
which relate to the application of the Grandview Peaks development in
McDowell County for a 401 certification to impact waters of the state (DWQ No.
20070168).
All records (whether an original or a copy) within the custody or care of the N.C.
Division of Water Quality (NCDWQ), or any of its employees or consultants,
which relate to the application of the Ammons Mountain Properties Inc.
development in Madison County for a 401 certification to impact waters of the
state (SAW-2008-2246).
This request is specifically intended to include any record which exists in any form as of your
receipt of this request. The term record is intended to include, but not be limited to, (1) all
records as defined in N.C.G.S.§ 132-1; (2) all types of electronic communication regardless of
whether a printed hard copy of that communication exists, whether it has been archived or backed
up, or whether that communication has already been deleted from the hard drive of the local
workstation, server, or other media; and (3) all notes, documents, and other records, including
drafts, which may still be in the possession of NCDWQ staff, or which may otherwise exist, but
which have not been made a part of the agency's files.
I am happy to work with you to facilitate the production of the requested public records or to
explore opportunities to narrow the scope of the records request.
