Westinghouse Blvd Charlotte, NC 28273 Re: Section 401 Water Quality Certification application for North Fork Estates Dear Mr. Antemann: On October 10, 2008, the North Carolina Division of Water Quality (Division) received your application for a 401 General Water Quality Certification to impact 1,524 linear feet of stream to improve flood control for the City of High Point in Guilford County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. 1. Please provide documentation that the bottomless arch culvert that is being proposed meets the Division of Water Quality policy as found in the attached document, and online at: http://h2o.enr.state.nc.us/ncwetlands/rd_pub-not.html 2. A site visit conducted on November 25, 3008 noted that a power utility line runs parallel to the stream channel throughout the project boundaries. Traditionally utility companies treat their right-of-ways with herbicides to limit vegetation growth under the power lines. This would directly conflict with the proposed stream bank planting for this project. Please provide information that the City has discussed their proposed planting with the power company and that an agreement has been reached, or revise the stream bank planting plan as necessary. 3. The Division is concerned that the proposed flood plain bench design includes a riprap lined bank throughout the entire project on both sides of the stream. A site visit conducted on November 25, 2008 noted that a significant portion of the stream did not show extreme erosion along stream banks. The addition of a flood plain bench to this area will greatly reduce velocities throughout the channel and reduce bank shear stress. The Division understands that there may be some areas where shear stress is high enough to be of significant concern. The Division requests that the design be re-evaluated regarding the necessity of the riprap. We suggest the use of small riprap sections, riprap aprons or scour holes for stormwater pipes, and or reducing the slope of the stream bank to less than 2:1 as p>;?posed. Please explain why large trees are being removed along the existing stream bank behind the apartment complex. It appears that the plan does not require any work in these areas so it is unclear why the trees are being removed. 5. Please provide a detailed planting plan for the flood plain benches as well as the stream banks. Please clearly indicate on the plan sheets the areas where each plan will be followed. 6. Per the requirements of the General Certification, all work shall be done "in the dry". Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during structure installations. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. 7. Please clarify what Nationwide Permit the USACE will be issuing for this project. 8. Please provide a new PCN table and plan drawings that clearly label each impact area and identify the type of impact and the amount of impact. Please note that stream bank work above the high water mark may not be considered a permitted impact by the USACE. 9. Please provide detailed specifications for the cross vane structures. These details should include details such as angle of construction, depth of construction, type of material, scour pool, fabric usage etc. 10. Please provide detailed specifications for areas where riprap is to be installed at the stream bank. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to Sue Homewood at the address on this letterhead, and a copy to Ian McMillan N. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeffame, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
