This work is anticipated to take 3-4 weeks depending on weather conditions and/or Engineer/Agency directives that may impact production. The following conditions apply to this proposal: I If the conditions of access to and within the areas to be cleared is altered from the agreed to terms (change order) on which this price is based before or during work, these prices will no longer be valid. Prices are based on maximum of 120' drag lengths from allowable mechanized access points/areas. A sufficient number of access points/areas must be allowed by the Owner and Agencies so that this maximum drag length will be capable ranging all areas to be cleared. 204 Base Leg Road, Ci cvusboro, NC 27409 Phone: 336,235.2756 Fax: 336.235 2743 * As directed by the Engineer to repair damages as a result of clearing operations. 2. Contract unit price for permanent seeding does not apply. A price will be provided for wetland seeding and mulching based on the information provided by Baker and Associates. A price will be forwarded for your review upon receipt from our subcontractor. 3 Marking/surveying is not included (a) The conservation easement (CE) boundary will be clearly marked with orange fence or other easily recognizable markings; (b) all trees to be removed within the CE will be marked, (c) all areas where mechanized access through the CE is permissible will be marked/identified, (d) the MALSR boundary will be marked so that it can be utilized as a means of mechanized access. 4. All erosion control devices will be installed and functioning properly prior to work beginning. S Non-mechanized/hand silt removal not included. b. All erosion control to be installed/modified after work begins will be at the direction of the Engineer and compensated at applicable contract unit prices. 7. Price does not include orange fence installation or removal. 8. Price does not include removal of any temporary erosion control devices. 9. A construction entrance will be installed and utilized to gain access to the site from paved surfaces. Price does not include repairs to any paved surface resulting from hauling operations associated with this work as long as a construction entrance is installed and maintained. Engineer will ensure Sharpe Brothers is afforded the necessary access to the site via Bryan Blvd ramps. 10. Owner and Agencies accept that damage to trees that are to remain and other vegetated areas within the CE is unavoidable. The Owner and Agencies further accept that rutting and other damage to all areas within the CE is unavoidable regardless of whether clearing is by mechanized means or via cutting and dragging. 11. Additional mobilization costs will occur if the Engineer or other Agency issue directives that halt work in excess of 4 hours. 12. Owner understands that work will not begin until such time as RPCA is paved. 13 All stream crossings or "swamp mats" will be sized and placed at the direction of the Engineer. 14 Contractor is authorized to use timber/log mats at stream crossing points and other soft areas to be used as mechanized platforms and to drag cut timber across in order to limit damage and provide more stable mechanized access platforms. Mats/logs would be removed upon completion of clearing activities in a given area. 15 Mechanized clearing is authorized within CE areas that are outside of the low, wetland areas identified in figure 3 of May 8, 2008 information provided to Sharpe Brothers. 16. The Engineer will direct all required dress up of cleared areas and will compensate at the agreed to square yard price. This is not inclusive of restorative efforts beyond repairing rutting and seeding/mulching. 17. Clearing contractor has the option of utilizing a "swamp buggy" to access trees in wetland OIL areas provided that a demonstration of its capabilities in the presence of the Engineer indicates that it is capable of reducing damage to the wetland areas when compared to cutting and dragging. 18. Sharpe Brothers shall repair any permanent drainage structures in/around the sediment basin located in the area to be cleared at no cost to the owner should they be damaged during clearing operations. 19. Engineer will compensate Sharpe Brothers at the contract unit price for Class B Rip Rap (line item 080) for the installation, maintenance and removal of required construction entrance(s). • 20. Engineer will have a representative on-site at all times to monitor progress and provide real- time guidance and directives regarding access, boundaries and tree removal. 21 The Engineer will conduct a pre-construction meeting on-site pnor to the start of work with all involved parties in order to review conditions of access, boundaries, and address any remaining questions. 22. Sharpe Brothers requests that the Owner provide written assurance that Agencies are in agreement with the conditions set forth in this letter prior to work beginning.
