Sullins, Director Division of Water Quality November 4, 2008 DWQ Project # 08-1461 New Hanover County CERTIFIED MAIL: RETURN RECEIPT REOUESTED Cert. # 7008-1140-0002-9563-1793 Coffer Investment Properties II, LLC Mr. Matt Murphy 1202 North Lake Park Boulevard, Suite A Carolina Beach NC 28428 Subject Property: Coral Ridge REQUEST FOR MORE INFORMATION Dear Mr. Murphy: On September 24, 2008, the Division of Water Quality (DWQ) received your Pre-Construction Notification (PCN) application to impact approximately 0.405 acres of 404 Wetlands for construction of a residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The applicant for this project is Mr. Matt Murphy for Coffer Investment Properties Il, LLC. On the Secretary of State's website, Mr. Murphy is not identified as a member or agent. Please send the Secretary of State information that lists Mr. Murphy as a new member or re-do the application with an existing member/agent as applicant. 2. Please locate any planned sewer lines on the site plan. 3. Please provide cross sectional drawings of the proposed impact areas. 4. You are proposing two stub roads on the site plan drawings that directly impact wetlands. The DWQ cannot permit such "roads to nowhere". Your Pre-Construction Notification application indicates, "No future permit requests are anticipated, this application reflects all necessary impacts for the successful completion of this project" under Item V. Please remove or change this stub road to a terminal feature such as a cul-de-sac or provide details on the future development to which `Street A' is pointed. 5. Based on the submitted plan drawings, and from review of the State Stormwater Permit SW8080818, it appears that hydrology will be removed from some of the wetlands. Explain how the hydrology will be maintained to the wetlands specifically those adjacent to Pond A, Pond 2A, and Pond 2B. 6. Based on the "Request For Additional Information" letter from the U.S. Army Corps of Engineers dated October 16, 2008, it does not appear that all impacts were disclosed. Please indicate all wetland and stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. General Certification 3705 (GC3705) requires that deed notifications or similar mechanisms be placed on all retained jurisdictional wetlands and waters. Please provide a Draft Copy that includes the proposed preservation language that will be recorded to accomplish this. 8. Several areas of possible non-compliance with the NCGO 10000 permit were noted during the site visit of October 28, 2008. Please provide a written narrative explaining how you intend to comply with this Permit and who will be delegated to inspect the site and maintain required rain gauge and monitoring reports. 9. Based on the "Request For Additional Information" letter from the U.S. Army Corps of Engineers dated October 16, 2008, the accuracy of the wetland delineation map provided with the application appears to be inaccurate with regards to the tributary located along the west side of the main road. Please provide a wetland delineation map signed and approved by the U.S. Army Carps of Engineers. 10. Based upon review of the Pre-Construction Notification application as submitted, a revision or modification of the existing State Stormwater Permit SW8080818 may be necessary. Please contact Malcolm Boney with State Stormwater at 910-796-7215 to discuss possible revisions. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
