Plantation Investors, LLC seeking Department of the Army authorization for the discharge of fill

Authority
The Corps will evaluate this application and decide whether to issue, conditionally issue, or deny
the proposed work pursuant to applicable procedures of Section 404 of the Clean Water Act (33
U.S.C. 1344).
Location
The 99.56 acre project area is the eastern portion of Mid South Club, an existing residential
community and golf club, located off of Midland Road (NC Hwy 2), east of Hwy 15/501, in
Southern Pines, North Carolina. The site contains approximately 11.67 acres of jurisdictional
riparian wetlands which are adjacent to an unnamed tributary (UT) to Aberdeen Creek (Watson
Lake), a tributary of the Lumber River, a Navigable Water of the United States. Site coordinates
are 35.1824°N, 79.4215°W.
Existing Site Conditions
The project area rests within an existing residential community with an 18-hole golf course.
There are 309 single family lots, 208 townhomes, 43,500 linear feet of roadways, 26,000 linear
feet of cart paths, and 31.25 acres of golf course and jurisdictional ponds (those created by
impoundments along two UTs to Aberdeen Creek). In 1998, the Corps of Engineers issued a
Nationwide permit verification, which authorized the discharge of 2.9 acres of fill material for
road crossings as well as the construction of the golf course and three large ponds (resulting in
10.1 acres of open-water impoundments) (Action ID: SAW-1997-07182).
The approximately 100 acre project area is undeveloped, aside from some existing paved roads
and existing fairways #245 which are associated with the 18-hole course. The site consists of
11.67 acres of jurisdictional wetlands; to include open-water impoundments of the UT to
Aberdeen Creek and several wetland fingers draining into them.
According to the United States Department of Agriculture Soil Survey of Moore County
(December 1986), wetlands within the site are classified as Vaucluse loamy sand and Bibb fine
sandy loam, poorly drained respectively, and have been classified as hydric soils for Moore
County. These wetlands support vegetation which mainly consists of loblolly pine (Pinus
taeda), tulip tree (Liriodendron tulipfera), red maple (Acer rebrum), greenbriar (Smilax
laurifolia), and switchcane (Arundinaria tecta). Upland soils are classified mostly as Candor
sand (excessively drained, non-hydric) and Ailey loamy sand (well drained, non-hydric), and
support longleaf pine (Pinus palustris), loblolly pine (Pinus taeda), turkey oak (Quercus Laevis),
and bracken fern (Pieridium aquilinum).
Surrounding land use currently consists of developed, residential area to the east (Southern Pines
City limits), an apartment complex and shopping center to the southwest, Morganton Road to the
south, and Midland Road (NC Hwy 2) to the north.
Applicant's Stated Purpose
The purpose of the project is to provide additional residential development within an existing
golf course community in Moore County.
Project Description
The applicant has proposed to discharge fill material (approximately 540 cubic yards) into 0.126
acres of jurisdictional wetlands to construct a roadway and sewer line crossing to access the
eastern portion of the property. The applicant also proposes to construct a bridge to avoid stream
impacts and partially avoid wetlands. Project plans and narrative have been included with this
Public Notice.
The applicant also submitted an Alternatives Analysis, included with this Public Notice.

The applicant submitted a mitigation proposal with their application that entails payment into the
Ecosystem Enhancement Program (EEP) for'restoration of 0.13 acres of riparian wetlands within
the Lumber River watershed.
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate State
agencies for review. The Corps will generally not make a final permit decision until the North
Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State Certification
required by Section 401 of the Clean Water Act (PL 92-500). The receipt of the application and
this public notice combined with appropriate application fee at the North Carolina Division of
Water Quality central office in Raleigh will constitute initial receipt of an application for a 401
Water Quality Certification. A waiver will be deemed to occur if the NCDWQ fails to act on
this request for certification within sixty days of the date of the receipt of this notice in the
NCDWQ Central Office. Additional information regarding the Clean Water Act certification
may be reviewed at the NCDWQ Central Office, 401 Oversight and Express Permits Unit, 2321
Crabtree Boulevard, Raleigh, North Carolina 27604-2260. All persons desiring to make
comments regarding the application for certification under Section 401 of the Clean Water Act
should do so in writing delivered to the North Carolina Division of Water Quality (NCDWQ),
1650 Mail Service Center, Raleigh, North Carolina 27699-1650, Attention: Ms Cyndi Karoly by
November 3, 2008.
Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic Places
and is not aware that any registered properties, or properties listed as being eligible for inclusion
therein are located within the project area or will be affected by the proposed work. Presently,
unknown archeological, scientific, prehistoric, or historical data may be located within the
project area and/or could be affected by the proposed work.
Endangered Species
The Corps has reviewed the project area, examined all information provided by the applicant and
consulted the latest North Carolina Natural Heritage Database. Based on available information,
the Corps is aware of the presence of red-cockaded woodpecker (RCW) (Picoides borealis)
foraging partitions associated with Southern Pines-Pinehurst (SOPI) clusters 97 and 109 within
the project area. The applicant's agent, Dr. J.H. Carter III and Associates, Inc. believes both
clusters are inactive. A final determination on the effects of the proposed project will be made
upon additional review of the project and completion of any necessary biological assessment
and/or consultation with the U.S. Fish and Wildlife Service and/or National Marine Fisheries
Service.

Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable impacts,
including cumulative impacts, of the proposed activity on the public interest (please see attached
information regarding permitting history and cumulative impacts). That decision will reflect the
national concern for both protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered
including the cumulative effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, historic properties, fish and wildlife values, flood
hazards, flood plain values (in accordance with Executive Order 11988), land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of property ownership,
and, in general, the needs and welfare of the people. For activities involving the discharge of
dredged or fill materials in waters of the United States, the evaluation of the impact of the
activity on the public interest will include application of the Environmental Protection Agency's
404(b)(1) guidelines.
Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies
and officials, including any consolidate State Viewpoint or written position of the Governor;
Indian Tribes and other interested parties in order to consider and evaluate the impacts of this
proposed activity. Any comments received will be considered by the Corps of Engineers to
determine whether to issue, modify, condition or deny a permit for this proposal. To make this
decision, comments are used to assess impacts on endangered species, historic properties, water
quality, general environmental effects and the other public interest factors listed above.
Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act
(NEPA). Comments are also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity.
Any person may request, in writing, within the comment period specified in this notice, that a
public hearing be held to consider the application. Requests for public hearings shall state, with
particularity, the reasons for holding a public hearing. Requests for a public hearing shall be
granted, unless the District Engineer determines that the issues raised are insubstantial or there is
otherwise no valid interest to be served by a hearing.

This letter is in response to your request for more information in an email dated 28 May 2008,
regarding the individual permit (IP) application submitted 9 March 2007 for a bridge crossing within
the Mid South Club, Southern Pines, Moore County, North Carolina (NC). As requested, we are
providing the following information and materials:
1. A revised IP application is enclosed and has been updated to include the after-the-fact
wetland impact (0.*acre) identified as Wetland D, near Belfair Court, during your site
visit and wetland verification on 12 February 2008. A zoomed in map of Wetland D
projected over an aerial photograph is included (Figure 1).
2. We have requested additional wetland mitigation credits from the NC Ecosystem
Enhancement Program (EEP) to compensate for the revised impacts.
3. A copy of the historic impacts map that we submitted to you on 15 January 2008 has been
updated to include the 2008 wetland delineation line, the location of Wetland D and an
approximate boundary separating the current project area from existing development within
the Mid South Club (Figure 2). (The numbers on the map correspond with the historic
impacts outlined in the January 15 letter. I left them on the map for consistency, however,
they are not referenced in this letter.) The proposed development totals 99.56 acres. An
itemized acreage list for the development was provided on the master plan with the original
IP application.

The proposed project involves extending a road and sewer line into the undeveloped portion of the property. The sewer line will cross the
jutisdictional areas on pilings; a letter issued by the USACE (with Action ID SAW-2007-490-063) on 4-9-2007 stated that no DA authorization is
required for the sewer line. An after-the-fact impact for fill near Belfair Court (0.02 acre) has also occurred onsite.

To extend the road system and sewer line into the undeveloped portion of the Mid South to allow for build-out of the property. The
stream/wetland crossing is the only way to access the eastern side of the property due to the location of wetlands, lakes and the golf course.

4. Updated plan and profile views of the proposed bridge crossing with the 2008 delineation
are enclosed. A profile view showing the utility line is also enclosed. Note that the revised
wetland line caused a realignment of the future bridge and road to minimize impacts. The
bridge was also raised above the 100-year flood level. With these revisions, the proposed
wetland impacts are 5505 ftz (0.126 acre) and 540 yd3 of fill material.
5. A plan view of the after-the-fact impact at Belfair Court is included.
6. The proposed project falls within red-cockaded woodpecker (RCW) (Picoides borealis)
foraging partitions associated with Southern Pines-Pinehurst (SOPI) clusters 97 and 109,
which are both inactive. Mid South Club is enrolled in the NC Sandhills Safe Harbor
Program. There are no other records of protected species occurrences within the proposed
development.
7. A statement of findings regarding cultural resources on the project site is forthcoming. We
have requested information from the State Historic Preservation Office and are awaiting a
response.

Proposed Bridge and Sewer Line Crossing
The Mid South Club is using a bridge to span the stream in order to avoid stream channel
impacts and minimize wetland impacts. The sewer line will also be built on piers in order to
avoid stream channel impacts and will be located immediately adjacent to the bridge, using the
same fill area as the bridge in order to minimize wetland impacts. In addition, on the southern
end of the property they decided to use an existing road crossing which will result in no impacts
to jurisdictional wetlands or waters. Mid South Club also eliminated a proposed townhouse unit
which would have impacted additional wetland areas.

Proposed Bridge and Sewer Line Crossing
Alternative Analysis of Roadway Bridge and Sanitary Sewer Crossing the Stream
and Wetlands to Allow Single Family Home Development:
No Action - Do not build the bridge or the sewer line. Not constructing the
roadway bridge and sanitary sewer line would prevent any further development in
the approximately 80-acre parcel located on the eastern side of the stream, ponds
and wetlands that comprise this upper reach of an unnamed tributary of Aberdeen
Creek. This parcel has always been a part of the Mid South Golf Course
Development, a private and gated community. There is no perimeter access to
outer adjacent properties. The Town requires a looped roadway system for such a
collector road serving more than 50 lots -for homeowner and emergency access.
2. The proposed bridge with a span of 50-feet will prevent any stream channel
impacts, with only about 0.08-acre of fill impacts to wetlands at the bridge
abutment ends. To span the entire wetlands would require a 150-foot bridge, at
approximately four times the cost of a 50-foot bridge. Because these roadways
are private, and being within a gated community, the Town still requires roadway
and bridge standards to conform to public NC DOT specifications, but be owned
and maintained by the private homeowners association in the development. Thus,
the developer and homeowners association can not afford a bridge costing four
times as much as that proposed. With the proposed 50-foot bridge and its
abutment fills, no further wetlands impacts will result in installing the gravity
sanitary sewer line. Due to vertical depth limitations where we are tying into the
existing sanitary sewer outfall, requires that the gravity sewer line be aerial (up on
piers) over the stream channel, and spanning the same length as the bridge.
Directional boring of the wetlands with a small diameter pipeline, in order to
eliminate all wetlands impacts, would require a pump station to move the
wastewater over to the existing outfall. The Town of Southern Pines will not
accept the ownership and maintenance of a pump station when such a gravity
sewer line is possible. This proposed roadway and sanitary sewer line crossing of
the wetlands is to occur at the narrowest part of the entire 4500-foot length of
streams and ponds that dissects the property, and thus minimizing wetlands
impacts as much as possible.
