(SEGi) is in receipt of your 14 April 2017 request for addition information (RFAI), which pertains to Hunter's Apartments, LLC's, herein referred to as the "Permittee", request to modify CAMA Major Permit #64-08. This letter serves as a response to that RFAI. Please find your comments (bold font) followed by our response below and on the following pages: 1. The application provides a table of previous regulatory actions on the property including a previous DA authorization for use of NWP 14 and NWP 33 issued on June 9, 2008 under the file number SAW -2001-01253-065. As described in your application table, the impacts authorized consisted of 0.0359 acre of permanent fill to riparian wetlands for constructing two road crossings. The applica- tion also states that the 0.0359 acre of wetland fill has been completed. However, the required mitiga- tion for this fill appears to be only partially completed. Special Condition #2 of the attached permit authorization requires the permittee to execute and record in the New Hanover County Register of Deeds, a Conservation Declaration/Restrictive Covenants for maintaining the remaining 49.25 acres of wetlands as preservation areas. Please provide documentation regarding the recordation of the required Conservation document. Also please provide a methodology, such as deed notifications, to ensure that lot buyers/owners are aware of the restrictions set forth in the Conservation Declaration. We understand that Special Condition #2 has not yet been fulfilled. However, per the DA authorization you referenced, "recordation is to take place prior to the conveyance of any lots and submitted to the USACE within 15 days of recordation." At this time, no lots have been conveyed. Thus, technically, non- compliance of Special Condition #2 has not occurred. At this time, Hunters Apartments, LLC is requesting to remove Special Condition #2 as a requirement of the permit. Based on the fact that the previous Permittee offset the authorized 0.0359 -acre of riparian wetland fill with 0.38 -acre of riparian wetland restoration credit, a 10.6 to 1 mitigation to impact ratio, which is 5 times more than the USACE's standard 2:1 ratio, the previously authorized fill work did not result in a net loss of riparian wetland function, and therefore, those impacts have been sufficiently mitigated. While the previous permittee may have entered into an agreement with the USACE to place the remaining 49.25 -acres of wetland into preservation, this preservation was not part of the compensatory mitigation proposal. The current permittee believes this is an unnecessary and burdensome encumbrance on the 1 Watermark CAMA Major Permit Mod — Response to USACE RFAI 3 F C, i property. Additionally, it has been SEGi's experience that preservation is not recommended by the USACE any longer, as it is difficult to enforce, once the lots have been conveyed. Therefore, the Permittee and SEGi believe that recordation of deed notifications are adequate to ensure that unauthorized work within waters of the US (WOTUS) does not occur after construction has been completed and lots have been sold. The Applicant proposes to record the attached deed notification language (see Attachment 1) for those lots that contain WOTUS (i.e. 5-24 and 39-50) and prior to the conveyance of any lot, at the New Hanover County Register of Deeds. Copies of the recorded deed notifications will be submitted to the USACE within 15 days of recordation. 2. The previous authorizations for this development allowed for the development of the upland por- tions of the tract with minimal impacts to waters of the US. The proposal to impact additional wet- lands for stormwater management, sidewalk installation, causeway installation, and house pad fill appear to be avoidable. Additionally, the proposed impacts from the road crossing, the pump station, the earthen causeway, and the lot fill appear to be located in wetlands that should be under the re- quired Conservation Declaration. NWP General Condition 23(a) states "the activity must be de- signed and constructed to avoid and minimize adverse effects, both temporary and permanent, to waters of the United States (WOUS) to the maximum extent practicable at the project site". Please describe the feasibility of other site plans that would further minimize the impact of your project on aquatic resources. This includes additional information regarding avoiding wetland impacts (e.g. further reviewing the use of bridges over wetland areas and/or alternate road configurations to fur- ther avoid wetlands), removing lots (Lot 24 for example), reducing the size of the associated infra- structure, and/or reconfiguring the location of the proposed infrastructure (e.g., alternate storm - water or pumping facility locations) to avoid aquatic resource impacts. A discussion of construction BMPs should also be included, including measures to conduct the work "in -the -dry". Since the original permit was issued, the property has gone into foreclosure and then purchased from the bank, by the Permittee. Once the Permittee began investigating the approved site plan, it was discovered that the stormwater management measures were not sufficient to perform as intended and the lift station was undersized. That created the need to redesign the site, which created the need to impact additional WOTUS. Proposed Impacts: Road Crossings — Review of the previously permitted wetland impact map revealed an impact to Section 404, at the intersection of Scotia Run and Lanyards End, was overlooked. The impact would have been necessary for the installation of the water line and retaining wall. With the new site plan, the impact will also include a sidewalk, as required by the New Hanover County. Pump Station — With the revision of the site plan and stormwater management plan, an underground infil- tration basin was incorporated into the plan. This created the need to expand the pump station area and im- pact Section 404 wetlands, in the area of the pump station. Earthen Causeway — The Permittee has decided to utilize a bridge to access the four upland lots, avoiding the WOTUS and coastal wetland impacts in this area. The site plan has been revised to reflect this change (see Attachment 2). Lot Fill — The previously proposed 1800 square feet structure would not have been able to be built on Lot 24, without impacts to Section 404 wetlands. This impact was overlooked during the original submittal and subsequent authorizations. The Applicant has reduced the building footprint for this structure to 1500 square feet, but impacts are still necessary. This permit request accounts for the impact. The following table summarizes the revised proposed wetland impacts for the project: 2(5/19/17) Watermark CAMA Major Permit Mod — Response to USACE RFAI 3 F C, i Impact ID 404 Wetland Impact Area (SF/AC) Purpose 404-1 494 SF 10.01 Lot Fill 404-2 981 SF / 0.02 Pump Station 404-3 847 SF / 0.02 Road Crossing Total 2322 SF / 0.05 AC The elimination of the earthen causeway, the Applicant has reduced impacts to Section 404 wetlands by 1482 SF (0.03 AC) and avoided the coastal wetlands impacts (i.e. 1048 SF / 0.024 AC). SEGi and Appli- cant believe the proposed wetland impacts are justifiably necessary to facilitate the completion of the pro- ject and that the proposed plan is the least environmentally damaging, practicable alternative. 3. Once it has been demonstrated that avoidance and minimization measures have been implemented to the maximum extent practicable, an appropriate compensatory mitigation plan will be required to fully offset any unavoidable impacts to waters of the United States in accordance with 33 CFR 332 - Compensatory Mitigation for Losses of Aquatic Resources. The mitigation plan must contain the el- ements described at 33 CFR 332.4(c)(2) through (c)(14). This office has record of the previous Ripar- ian Wetland credit purchase from NC DMS (formerly NCEEP). The purchase of those credits, com- bined with the preservation of the remaining wetlands, was to compensate for the loss of wetlands associated with impacts that have occurred. The application, as submitted, fails to adequately pro- vide offset for additional permanent loss of wetlands. Please revise the mitigation proposal accord- ingly. Unlike Special Condition #1 of the NWP, which begins with "In order to compensate for impacts to 0.0359 acres of riparian wetlands...", Special Condition #2 does not specifically state that the preservation was to compensate for the loss of wetlands. Therefore, SEGi contends that the preservation mechanism was not intended to offset impact to WOTUS. As discussed in the response to item #1, compensatory mitigation for the impact of 0.0359 -acre of riparian wetlands was fulfilled through payment, for 0.38 -acre of riparian wet- land restoration credit, which is more than sufficient to ensure a no net loss of wetland function took place as a result of the past discharge of fill material into wetlands. Additionally, the Applicant intends to restore the 279 SF (0.006 AC) of WOTUS and 444 SF (0.01 AC) of coastal wetlands by removing the existing soil road and culvert that are within the footprint of the proposed bridge. This area will be restored back to its original grade and contour, seeded with a wetland seed mix and allowed to re -vegetate naturally. Monitoring should not be necessary due to the location of the wetland feature to be restored. Please see Attachment 2 for details of the wetland restoration area. The proposed restoration of 0.006 AC of WOTUS and 444 SF of coastal wetlands, in conjunction with the previously fulfilled purchase of 0.38 AC of riparian wetland restoration credit, the deed notifications and the minimal amount of impacts to WOTUS that are being proposed with this site plan, as well as those that have taken place, for a cumulative total of 0.086 AC, the Permittee and SEGi believe the proposed mitiga- tion plan is sufficient to ensure that there is a no net loss of wetland function taking place, as a result of this single and complete project. 4. Please provide updated water depths on the cross sectional drawing for the newly proposed location of the docking facility and also provide information regarding the current and potential future need for dredging based on the location and the type of vessels that would utilize the facility. A cross sectional drawing that denotes the water depth has been incorporated into the site plan (see Attachment 2). The marina structure would be located in an area where water depths average 4.31 feet (51.72"), at mean low water. The proposed marina has been designed to accommodate vessels with lengths from 17' to 45'. A 45', Formula Power Cruiser drafts 39" of water. Unfortunately, SEGi is unable to predict if deposition of sediment will create the need for dredging in the future.
