PROJECT DESCRIPTION: Mill Creek is a tidal creek located in Pender County, west of the Atlantic Intracoastal Waterway (AIWW) and north of Futch Creek. Several man-made and natural canals extend off Mill Creek, nearly all of which have been dredged at one point. The Mill Creek complex is adjacent to four residential subdivisions: Long Point Estates, Washington Acres, Deerfield, and Water's Edge at Deerfield. The project site for this application is Horne Creek located in the Washington Acres subdivision. To access Horne Creek from Wilmington, take US Hwy 17 N. Travel approximately 11 miles to Hughes Road. Turn right onto Hughes Road and travel approximately 1.5 miles to the intersection of Hughes Road and Center Drive. Continue on Hughes Road and he end of Horne Creek will be located around the curve on the left. (You will be driving parallel to the creek for approximately 0.5 miles prior to reaching this point.) The adjacent highground is zoned residential, and a many of the homesites in the project area have already been developed. Several properties adjacent to the creek also have existing boat docks. State Permit # 175-07 was issued to the Community Creek Front POA, Waters Edge at Deerfield, Long Point Estates on December 17, 2007 authorizing the maintenance dredging of Mill Creek, Deep Water Branch, Water's Edge Canal, Short Circle Inlet Drive Canal, Battery Lane Inlet, Grady Scott Canal, Long Point Estates Canal and the first section of Horne Creek. Maintenance dredging of the man-made extension of Horne Creek was originally proposed as part of this application, but shallow water depths in the adjacent natural area (which has never been dredged) rendered it inconsistent with 07H .0208(b)(1), which states, "any canal or boat basin shall be excavated no deeper than the depth of the connecting channels". The applicant chose to withdraw this portion of the proposed project. The original permit did authorize dredging of approximately 2,700 linear feet of Horne Creek and its side channel, located south of the main channel, near the mouth of the creek. Highground vegetation in the vicinity of the project area is primarily composed of lawn grasses, Oak (Quercus spp.) and ornamental plants. Wetland vegetation consists primarily of Smooth Cordgrass (Spartina alterniflora). The following species can also be found landward of the Cordgrass, in the transition area to uplands: Sea Oxeye (Borrichia frutescens,) Grounsel-bush (Baccharus halimifolia), Spike Grass (Distichlis spicata), Glasswort (Salicornia spp.), Sea Lavender (Limonium sp. ), Salt Meadow Grass (Spartina patens). The spoil site approved under the original permit is located approximately 1 '/z miles north of Mill Creek. It is a privately owned island identified as "AIW_U_0205" on USACE Map # "sawgis-06-124". The dike system on the island authorized to contain the spoil material from the previously permitted project is currently under construction. The waters of the Mill Creek adjacent to the project site are classified as SA by the North Carolina Division of Water Quality. They are designated as a Secondary Nursery Area by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. The waters of the AIWW adjacent to the spoil site are also classified as SA-ORW by the North Carolina Division of Water Quality. Again, the natural section has never been dredged. It is approximately 425' in length and measures approximately 20-25' in width as measured from edge of marsh to edge of marsh. Current water "depths" range from +0.1 to +1.6' at Mean Low Water (MLW). The proposed channel would measure 10' in width, excavated to a final project depth of -4' at MLW. The use of either an auger-syle hydraulic dredge or a hydraulic agitation submersible pump-style dredge is proposed within the natural area to reduce indirect impacts to adjacent marsh vegetation associated with conventional dredge equipment. According to the description in the narrative, both types of equipment measure less than 9' in width and 40' in length and can only dig within the beam of the barge. The applicant also proposes to excavate the connecting man-made "extension" of the creek using the more typical cutterhead hydraulic dredge. As proposed, the dimensions of excavation would measure 670 feet in length, 25' in width. It would be dredged to a final project depth of -4' at MLW. According to the applicant, there are physical constraints on the distance the smaller dredge equipment can feasibly pump the dredged material. Therefore, the applicant is proposing that the dredged material within the natural area (be pumped into the suction pipe of the larger dredge (with which it would work concurrently). As proposed, the excavated material would then be transferred to the spoil site through the larger dredge. According to the applicant, the smaller dredge moves approximately 4.0 cfs (cubic feet per second), while the larger dredge handles 9.0 cfs. Therefore, the narrative states the higher suction rate of the larger dredge would preclude the likelihood of spoil leakage from the smaller dredge (Please refer to the narrative for a more detailed explanation of the proposed material transfer.) The same spoil site approved under the original permit would be used for the excavation proposed under this modification request. The volumes identified in the original permit included the material volumes from the Horne Creek extension and also allowed for overage as a buffer. Approximately 900 cubic yards of additional material would be excavated from the dredging of the "natural" section of Horne Creek. It appears that the approved dike design would still accommodate this additional spoil material. As permitted, 1,750 linear feet of levees are currently under construction at the disposal site to an elevation of +15' NGVD and with an internal elevation of +5 feet NGVD (for a dike height of approximately 10 feet). It was estimated that the dike-enclosed area would have a spoil capacity of approximately 33,000 cubic yards. The excavated volume for the previously permitted project totaled an estimated 27, 019 cubic yards. The total estimated excavation volume for the modification would be approximately 3,900 cubic yards. The total project volume including the permitted activity would be 28,609 cubic yards. A maximum fill elevation of +11' NGVD and maximum water level of +13' NGVD is still proposed. (Please note that the spoil site plans labeled DA1-5 of 5 are at half scale.) The applicant states the total volume proposed under this modification still falls within the volume approved by the USACE under their approved consent agreement (see attached email from Justin Arnette of the US Army Corps of Engineers). Additionally, the applicant proposes to transfer the CAMA major permit #175-07 from Community Creek Front POA, Water's Edge at Deerfield, Long Point Estates, to the current applicant, Mill Creek Waterway Restoration Inc. ANTICIPATED IMPACTS The proposed excavation would disturb approximately 21,050 ft.z (0.48 acres) of shallow bottom. The dredging operation would likely result in a temporary increase in turbidity. The spoil disposal would not result in any additional highground disturbance as is would be placed in the previously authorized diked area. Provided the project is timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated on shallow bottom from the dredging activity. Coastal wetlands could potentially be adversely impacted due to the proximity of the excavation to the marsh and resultant sloughing. The channel has shoaled to depths that limit navigation to smaller boats and then only during high tide periods. The channel historically (over 20 yrs) has been used for navigation and currently 6 of the 10 properties on the channel have existing docks. The Horne Creek Extension (HCE) is a channel approximately 1100 feet long. The first 425 feet is a natural 20'-25' wide channel and the upper portion is a manmade basin 670 feet long and approximately 60' wide. Existing depths range from 1.6' to -1.0' mean low water as referenced to the USACE MLW datum plane. Although bottom elevations within the dredge area are above the MLW plane, significant shoaling has reduced the tidal hydraulics and the area currently ponds a minimal amount of water throughout the tide cycle. RECEIVED Mill Creek Dredging Project Description OCM WItrageq 109 NC AUG 1 1 2008 Because the initial application for the Mill Creek Project was for maintenance dredging only, the upper man-made portion of the HCE was included, but the natural channel was not. The permit review process indicated that without dredging the natural connecting channel, dredging the man-made portion of the HCE would result in a violation of the use standards requiring that channels "...be excavated no deeper than the depth of connecting channels." (NCAC T15A 07H.0208(b)(1)(F)). Based on discussions with various regulatory representatives, the HCE was removed from the initial application to prevent possible delay or denial of the permit application for the entire maintenance project. The original plan was to perform the project during the 2007/2008 dredge season and it was thought that the natural channel would likely be considered new work rather than a maintenance activity and could have prevented the permit from being issued in a timely fashion. The Applicants were advised that it would be best, to apply for the HCE area separately or as a modification to the dredging permit once granted. Proposed Activities: This modification request proposes to add approximately 3,900 cubic yards of dredging from 1,100 linear feet channel, to the existing dredging permits obtained by the Mill Creek Waterway Restoration Project Inc. (MCWRI). The channel proposed would be excavated 10 ft wide in the natural channel area and 25 ft wide in the manmade basin area. The channels would be excavated to a depth of 4.0' MLW. The spoils would be conveyed to the USACE Disposal Island DA 205 by hydraulic pipeline. MCWRI has a current and active Consent Agreement with the USACE to restore DA 205 and place approximately 27,000 cubic yards of material in the disposal area. The total of all activities would be in compliance with the CA. The project design is shown in the attached permit drawings. Existing Conditions & Environmental Concerns: As stated earlier the Horne Creek Extension channel is a narrow natural channel and manmade basin, surrounded by old growth spartina alternaflora that has shoaled to depths of less than 1.0 ft MLW in recent years. The shoal material throughout this channel is very soft mud that has a "weight of rod" consistency. The material within the channel does not appear to provide any structural stabilization for the adjacent marsh which has a substantially stiffer substrate. Investigations during the initial planning phase did not indicate significant shellfish resources within the proposed dredge template and during subsequent bathymetric and topographic surveys, no significant shellfish resources were noted. The area is designated a Secondary Nursery Area by NCDMF. Dredging of the HCE appears to fall within both the general and specific use standards for public trust areas (NCAC T15A:07H.208). Both through field evaluation and consultation with the regulatory agencies, the primary environmental concern with this permit modification is the potential for direct impacts on the adjacent marsh due to dredging activities. There is a concern that due to the winding shape of this channel that the length, beam, and swing radius of even the smallest RECEIVED Mill Creek Dredging Project Description DCM WILMINGTON, NC Page 2 of 5 AU G 1 1 2008 conventional hydraulic dredge would resulting unavoidable impacts to the marsh as it dug the natural channel. The smallest cutterhead hydraulic dredges require the channel cut to be a minimum of 16 ft wide in order to operate properly. In order to minimize the potential for impacts to existing marsh, NCDCM and NCDMF typically use a standardized permit condition stating " No excavation shall take place within 10 feet of a coastal marsh." However, within the natural channel portion of the HCE, this condition would preclude any excavation, as the channel is only 20 ft wide in some places. In order avoid impacts to the marsh, while still restoring the channel to navigable conditions, the applicant is proposing the following design and permits conditions. The applicant is proposing to limit the type of dredging equipment the contractor will be allowed to be use in the natural channel area. Specifically, the equipment would be limited to either an auger style hydraulic dredge (Figure 2) or a hydraulic agitation submersible pump (Figure 3). a Figure 3 Agitation Style Dredge RECEIVED M WILMINGTON, NC AUG 1 1 2008 Mill Creek Dredging Project Description Page 3 of 5 Both styles of dredges are extremely compact (Length < 40' and Width < 9'). Both types of dredges are able to dig within a 10' wide channel footprint and are only capable of digging directly under the barge and cannot dig sideways beyond the beam of the barge. This eliminates the possibility of dredging material out from under the marsh root mat. Additionally, both of these types of dredges are designed primarily to dredge soft material. Although they are capable of dredge hard packed sandy material, they do so very inefficiently, making them an environmentally beneficial alternative when working in close quarters with the marsh fringe. Construction Logistics: From a construction standpoint, the main concern with utilizing these smaller machines on this particular project is horsepower. The Horne Creek Extension area is located approximately 14,000 ft from the planned disposal area. In the areas currently permitted, it is expected that a 370 hp dredge pumping though either 10 or 12 in. pipeline will be utilized. This dredge will require at least one, possibly two, 370 hp booster pump(s) in order to move material to the disposal site efficiently. The dredges proposed for the HCE natural area have a maximum of 175 operating horsepower and a maximum discharge line of 8 in. Pumping this distance on 8 in. line would require 3 booster pumps and would result in exceedingly high pressure in the line and an unacceptable risk of pipeline leaks or failure. In order to minimize this risk and make the job as efficient as possible, the applicant proposes that the small dredge digging the natural area place the end of the discharge pipe directly into the suction pipe of the larger dredge. This will allow the larger dredge to pump the dredged slurry and pick up additional water needed to maintain flow velocities within the larger diameter pipe. Although a somewhat open connection, the potential for leakage at this connection is minimal, as the larger 12 inch dredge moves approximately 9.0 cfs (cubic feet per second) of slurry while the smaller dredge is only capable of 4.0 cfs. Essentially the large dredge and its booster pump would both be acting as boosters for the smaller dredge. It is anticipated that activities associated with dredging the HCE natural area would take less than one week to complete. Figure 4 and Figure 5 show rough schematics of the connection between the to dredges. Once the HCE natural area is complete, the smaller dredge would be taken offline. The Main Dredge would then be floated into the manmade portion of the HCE to complete the dredging operations. Total estimated time to complete this area is approximately three to five days.
