NORTH CAROLINA DIVISION OF WATER QUALITY
PUBLIC NOTICE is hereby given that Duke Energy Carolinas, LLC North Carolina, has applied to the
North Carolina Division of Water Quality for a Water Quality Certification pursuant to Section 401 of the
Federal Clean Water Act and Water Quality Commission rules in 15A NCAC 2H 1300. The activity for
this Certification is sought to relicense the Franklin, Bryson and Mission hydroelectric plants on the Little
Tennessee, Oconaluftee, and Hiwasee Rivers respectively in Macon, Swain and Clay/Cherokee
Counties, respectively. The applications refers to water quality-related provisions of the Tuckaseegee
Settlement Agreement dated December 2003 as proposed conditions of the 401 Water Quality
Certification. The application discusses water quality-related improvements that are planned to the
hydroelectric facilities including minimum flow release, water quality monitoring and compensatory flow
mitigation.
The public is invited to comment on the above-mentioned application to the Division of Water Quality.
Comments shall be in writing and shall be received by the Division no later than September 8, 2008.
