Box 7185 Wilson, NC 27896 Subject Property: Wilson Memorial Service DWQ # 03-1419 APPROVAL of Neuse River Buffer Rule (15A NCAC 026 .0233) AUTHORIZATION CERTIFICATE Dear Mr. Shackleford: You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to impact approximately temporarily impact 1529 ft2 of Zone , permanently impact 2316 ft2 and 826 ft2 of Zone 2 of the protected riparian buffers for the purpose of constructing the Wilson Memorial Service project at the subject property as described within your application dated November 11, 2003 as modified on December 5, 2003 (received December 17, 2003). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: 1. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5) as shown on the stormwater management plan in your December 5, 2003 submittal. 2. Certificate of Completion Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 3. On-site buffer restoration shall be conducted as outlined in your December 5, 2003 submittal Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0233. Comment No. 1: Please indicate all buffer impacts on the site plan. The parking area appears to be in Zone 2. Response: The attached Map entitled "Impact and Restoration Map for Wilson Memorial Service "shows all project impacts. We have added finished contour lines to the site plan on a Map entitled " Wilson Memorial Service - Site Plan" to show that there are no fill slopes encroaching into Zones 1 & 2 with the exception of grading associated with the removal of an existing spoil pile shown on the map which is a permitted activity within the buffers. The finished ground slopes downstream of the parking lot are approximately 5%. Comment No.2: Please provide details for stormwater management practices. The cover letter states that sheet flow will be obtained but sloping land will make it difficult. Please provide more detail. Response: The site plan has been revised to show final contour lines. These contours depict the finished grade of the site generally sloping to the south and southeast and the stormwater flow sheeting off of the parking lot onto the ground with gentle slopes (5%) on the ground. Upon completion of construction we will provide an as-built drawing of the parking lot construction showing that sheet flow has been obtained. Approximately 1608 square feet of Zone 1 Neuse River Buffer was impacted by the temporary drive crossing as shown on the attached impact map. Base upon DWQ buffer restoration criteria of 500 trees per acre we are proposing to plant twenty (20) hardwood seedlings consisting of the following three varieties black willows red maple, and river birch. The Zone 2 area will be reseeded and mulched without fertilizer. The permanent cross will be limited to a total length of 40 feet in which we propose to construct 31 feet of 36-inch diameter HPDE pipe, two concrete headwalls, and a 9 foot long energy dissipation pad. The energy dissipation pad design is based upon the NYDOT method of design. In addition to the above it is agreed that the 20 hardwood seedlings will be planted within the next six months. Based upon your letter we offer the following comments and additional information to assist you in your review of this matter: ¦ We are submitting to the U.S. Army Corps of Engineers a 404 Permit application and a copy of the correspondence rolatuzg to this matter will be forwarded to you upon submittal by Kevin Martin. ¦ There is not a formal NCDOT method for design of energy dissipation pads. The accepted methods according to the Sedimentation-Erosion Control Manual are the chart method and the New York DOT method. The Raleigh Regional Office of the Division of Land Quality prefers the use of the New York DOT method in design of energy dissipation pads and therefore we made the judgment decision to use this approved and accepted method. ¦ We have revised the impact map to show two existing spoil pile areas that we desire to remove as part of the overall site construction, but are not part of the current buffer violation issue. These spoil pile areas are indicated on the impact map as Areas "B" and "C". It is my understanding that removal of existing spoil piles is an exempt activity but must be mitigated with plantings. ¦ Attached is an overall site plan of the property showing all property lines and proposed site improvements ¦ The proposed Wilson Memorial Service funeral home is located on a 5.43 acre tract of land. Upon completion of site improvements the total percentage of impervious area will be 19.52% as shown on the attached site plan. ¦ There are no storm water outfalls planned for this project. The area labeled "Areas to be seeded and mulched" is in Zone 2 and therefore grading and revegetation is also exempt. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. During the site visit, the investigator made observations of the impacts associated with the removal of vegetation along approximately 120 feet of the subject stream at a proposed stream/road crossing. Item 1.Neuse River Riparian Buffer Rule The Neuse River Basin is a basin that is subject to riparian (streamside) buffer rules. The purpose of the rule is to protect and preserve riparian buffers within the basin and to maintain the nutrient removal functions of the streamside areas necessary to protect surface waters. The Rule applies to the 50-foot wide riparian buffers directly adjacent to surface waters (intermittent streams, perennial streams, lakes, ponds, and estuaries). The protected riparian buffer has two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetated area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B .0233, and (b) Zone 2 [the outer 20 feet, landward from the outer 30 foot edge of zone I ] shall consist of stable vegetated area that is undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B .0233. Item 2. Failure to-Secure a 401 Water Quality Certification A file review indicates that the U.S. Army Corps of Engineers (COE) has not authorized use of a Nationwide Permit for this activity nor has notification been provided by the Corps of Engineers. The review confirmed that no Pre-construction Notification had been received by the Division of Water Quality for this project and no 401 Water Quality Certification has been issued, nor is the activity covered by a General 401 Water Quality Certification. A 401 Water Quality Certification is required for the above- mentioned impacts pursuant to 15A NCAC 2H .0500. Base upon DWQ buffer restoration criteria of 500 trees per acre we are proposing to plant twenty (20) hardwood seedlings consisting of the following three varieties, black willows, red maple, and river birch. The Zone 2 area will be reseeded and mulched without fertilizer. Any disturbed areas along the stream bank will be seeded and mulched without fertilizer and a straw with net temporary liner will be used to hold the seeding and mulching in place until a vegetated grass stand is established. Restoration of the stream bank and any other seeding will be accomplished in September while the tree planting will be scheduled for December, 2003. The permanent crossing will be limited to a total length of 40 feet in which we propose to construct 31 feet of 36-inch diameter HPDE pipe, two concrete headwalls, and a 9 foot long energy dissipation pad. Approximately 1608 square feet of Zone 1 Neuse River Buffer was impacted by the temporary drive crossing as shown on the attached impact map. Base upon DWQ buffer restoration criteria of 500 trees per acre we are proposing to plant twenty (20) hardwood seedlings consisting of the following three varieties, black willows, red maple, and river birch. The Zone 2 area will be reseeded and mulched without fertilizer. Any disturbed areas along the stream bank will be seeded and mulched without fertilizer and a straw with net temporary liner will be used to hold the seeding and mulching in place until a vegetated grass stand is established. Restoration of the stream bank and any other seeding will be accomplished in September while the tree planting will be scheduled for December, 2003. The permanent crossing will be limited to a total length of 40 feet in which we propose to construct 31 feet of 36-inch diameter HPDE pipe, two concrete headwalls, and a 9 foot long energy dissipation pad. During the site visit. the investigator made observations of the impacts associated with the removal of vegetation along approximately 120 feet of the subject stream at a proposed stream/road crossing. The Rule applies to the 50-toot wioe npartan buffers directly adjacent to surface waters (intermittent streams, perennial streams, lakes, panes. and estuaries). The protected riparian buffer has two zones as follows: (a) Zone 1 (measured from stream bank landward for 30 feet) shall consist of a vegetated area that is undisturoed except for uses provided for In Subparagraph (6) of 15A NCAC 2B .0233, and (b) Zone 2 [the outer 20 feet, landward from the outer 30 foot edge of zone I I shall consist of stable vegetated area that is undisturoed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B .0233.
