PROJECT SUMMARY: The applicant proposes to construct a 1-slip private docking facility. Mr. Harry Gross Page Two 9. PROJECT DESCRIPTION: The project site is located at 142 Ocean Greens Lane, adjacent to Piney Point Creek, located in Caswell Beach, Brunswick County. To find the project site travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right at Southport-Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Follow NC-133 to Oak Island and continue straight as it becomes Country Club Drive/Caswell Beach Road. Turn left approximately 1.6 miles after the bridge onto Ocean Greens Lane, which is located before the Progress Energy discharge canal. Travel approximately 0.75 miles to the end of Ocean Greens Lane. The project site will be located at the end of the cul-de-sac. The property consists of a common area owned by Ocean Greens HOA and Lot 142, owned by Mr. Gross, totaling approximately 0.45 acres in area. Mr. Gross obtained a deeded easement from the HOA for the riparian area between his property and the high water line (shown as the hatched area on Sheet 1 of 6). The easement area consists of approximately 650 square feet (0.01 acres), which has an approximate shoreline of 25' in length. The shoreline for the entire common area owned by the HOA is approximately 165' in length; no structures currently exist on the common area. According to the applicant, the average elevation of the entire tract is approximately 7.5' above Normal High Water (NHW). A single-family residence occupies the lot owned by Mr. Gross. Highground vegetation on site consists primarily of lawn grasses, ornamental shrubs, pines, and Wax Myrtle (Myrica cerifera). The wetland boundary begins near the eastern property line of Lot 142 and extends in an easterly direction over the entire easement area. Vegetation is composed primarily Black Needlerush (Juncus roemerianus), Salt Meadow Hay (Spartina patens), Groundsel bush (Baccharus halimifolia) and Marsh Elder (Iva frutescens) and measures approximately 40' in width. Salt Marsh Cordgrass grows from the high water line and extends approximately 200' to the north towards Piney Point Creek. A shallow slough, measuring approximately 80' in width, runs north of this marsh area. Another large expanse of Salt Marsh Cordgrass, measuring approximately 275' in width, then extends north between the slough and the main channel of Piney Point Creek. The Brunswick County Land Use Plan classifies the adjacent waters as Conservation. The waters of the Piney Point Creek are classified SA by the Division of Water Quality. The ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant is requesting to construct a one-slip private docking facility. A pier, measuring 652' in length by 4' in width, is proposed originating from the easement area adjacent to Mr. Gross's property and would extend to the main channel of Piney Point Creek. The height of the pier crossing the slough would be elevated to a height of 5.7' above Mean High Water (MHW) to allow for continued navigation of small vessels. The pier would lead to a 15' in length by 9' in width fixed L-head located at the waterward edge of marsh. A ramp would lead from the end of the pier at the L-head via a small access platform (referred to as a "nub" in the application), measuring 4' in length by 3' in width, onto a floating dock. The floating dock would measure 15' in length by 6' in width, with a 4' in length by 3' in width access platform attached to the float, also for access to/from the ramp (see Sheet 2 of 6). The floating dock would be aligned perpendicular to the pier, parallel to the channel. The water depth at the outer edge of the floating dock is approximately -6' at MLW. (Note: The attached survey performed 3/15/06 by D& S Surveying, labeled Sheet 6 of 6, references NAVD 88, which is approximately +0.8' above MLW.) Mr. Harry Gross Page Three 10. ANTICIPATED IMPACTS The docking facility would incorporate approximately 2,831 sq. ft. of Estuarine Waters and Pubic Trust Area. The pier would shade approximately 2,008 square feet of coastal wetlands and §404 wetlands, 1,928 sq. ft. of which is low marsh (S. alterniflora). The dock, as shown within the proposed riparian corridor, would encroach into the eastern adjacent 15' Riparian Corridor Setback. A waiver has been obtained from Mr. Don Hughes to the east. A waiver has not been obtained from the property owner to the west. The proposed docking facility would extend approximately 21' into Piney Point Creek, which measures approximately 130' across, thus conforming to the I/4 width rule. It does not appear to encroach into the channel and does not exceed the established pier line. The pier would cross over a slough off Piney Point Creek, which is navigable except at low tide. The pier, as proposed, would be elevated to a height of 5.7' above the high water line in this area to allow for the continued navigation of small vessels. Minor increases in turbidity should be expected during construction. The property is located on Caswell Beach, Oak Island in the Ocean Greens Subdivision, Lot number 142 (Parcel ID# 251 HE019) along the south side of Pine Point Creek in Brunswick County, North Carolina. Waters in the vicinity of the property are classified as SA, HQW (High Quality Waters) by the North Carolina Environmental Commission (EMC). The proposed pier and dock structure includes a 652' long 4' wide fixed pier terminating with 9'x 15' open platform, 6'x 15' floating dock with 2 - 3' x 4' ramp °nubsBandings" and an aluminum access ramp. One slip is proposed as "side to" dockage parallel with the floating dock. Water depths at the end of the fixed dock are -6 ft (MLW) and no dredging will be required. The waterward end of the floating dock will meet but not exceed the edge of the channel (most restrictive setback) and is within the % waterbody setback for Piney Point Creek. The proposed platform at the end of the fixed pier will be located entirely over open water. The entire dock system will be privately owned and utilized solely by the applicant and their guests. No commercial activities or services are proposed. No wetlands will be impacted and all structures will be a minimum of 3.0 ft above any wetland vegetation. The proposed project involves water-dependent structures only.
