REQUEST FOR ADDITIONAL INFORMATION
Dear Mr. Benjamin:
On June 3, 2008, the Division of Water Quality (DWQ) received your application dated April 29,
2008, to impact 0.039 acres of wetlands and 5,514 square feet (ft) of shallow water impacts to
construct the proposed residential boat dock, bulkhead, boathouse, and pool. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property.
Therefore, unless we receive the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 21-1.0506 and 2B .0233(8) and will
place this project on hold as incomplete until we receive this additional information. Please
provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Neuse River Riparian Buffer Rules
Please note that in accordance with the Neuse Buffer Rules 15A NCAC 02B .0233 (4) (b)
construction of retaining walls within the Neuse buffers is a prohibited activity; therefore,
this Office request a revised set of plans be submitted showing retaining walls located
outside the 50 foot Neuse Riparian Buffer.

Please note that it is required that Zone I of the Neuse Riparian Buffer be restored landward
of the proposed bulkhead. The buffer restoration should start at the southeast corner of the
existing shoreline riprap and continue down stream 135 feet to the southeast corner of the
subject property. It is necessary that a Buffer Restoration Plan be submitted to this Office
for approval. The restoration plan should include the following items:
(i) A map of the proposed restoration site (drawn to scale).
(ii) A vegetation plan. The vegetation plan shall include a minimum of at least two
native hardwood tree species planted at a density sufficient to provide 320 trees per
acre at maturity.
(iii) A grading plan. The site shall be graded in a manner to ensure diffuse flow through
the riparian buffer.
(iv) A fertilization plan.
(v) A schedule of implementation.
(vi) Within one year after the Division had approved the restoration plan, the applicant
shall present proof the Division that the riparian buffer has been restored. If proof is
not presented within this timeframe, then the person shall be in violation of the
State's riparian buffer protection program.
Please respond in writing to the DWQ within four weeks of the date of this letter to with the
requested information. If we do not hear from you within four weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Roberto Scheller of the Washington
