8. Project Summarv:
The applicant wishes to construct a docking facility, boat ramp, shoreline
stabilization, gravel driveway, elevated boardwalk, three-story workshop with an
apartment, pool, spa, patio, and two retaining walls.
9. Narrative Description:
The property is 3.25 acres at 200 Bennett Place off of Bennett Road and just east of the
Indian Bluff subdivision near Arapahoe, Pamlico County. The parcel has 348' of
shoreline on the Neuse River along the southern property boundary. The applicant
wishes to construct a docking facility, boat ramp, shoreline stabilization, gravel
driveway, elevated boardwalk, three-story workshop with an apartment, pool, spa,
patio, and two retaining walls on the Neuse River.
The existing man-made features on the tract include a single-family residence, garage,
pier (proposed to be removed), bulkhead, riprap, septic system, and a gravel driveway.
The property consists of upland lawn grasses, with a deep ravine of wooded Section 404
wetlands through the middle of the property. There are no coastal wetlands on the
property. The elevation of the tract ranges from +1.0' up to +26.0' msl.
The width of Neuse River at its most constrictive point on the property is greater than 3
miles across. - Water depths in the project area range from -0.5' to -4.5' nwl. The
bottom substrate is firm without shell. None of the project area has submerged aquatic
vegetation. The nearest docking facility adjacent to this property is about 280' to the
west.
The Pamlico County Land Use Plan has classified this area as Rural with Services, with
CAMA AEC's classified as Conservation. These waters of Neuse River are not
designated as Primary Nursery Area and are closed to shellfish harvesting. These
waters carry a water quality classification of SB; Sw, NSW. There is no evidence of a
shellfish resource.
10. Proposed Development:
The request is for a private docking facility, boat ramp, shoreline stabilization,
gravel driveway, elevated boardwalk, three-story workshop with an apartment, pool,
spa, patio, and two retaining walls. The construction of the docking facility and boat
ramp will take place within Neuse River on the southern portion of the property.
The riprap revetment, gravel drive, retaining walls, elevated walkway, workshop,
and patio with a pool and spa will take place landward of the normal water level.
The existing pier is to be demolished as a part of this project. The new fixed pier will
extend south into the Neuse River and will be 145' long and 6' wide. On the west
side towards the end of the pier, there is a 10' by 16' boatlift and 7,500-tbs. capacity

crane. These will be used in conjunction to support a 28' long catamaran. The "T"
section of floating docking platform will be 35' long and 20' wide at the waterward
terminus of the facility. There will be a 12' by 16' section of articulated gangway
that will connect the fixed pier to floating platform. There are no tie pilings
associated with this docking facility. This docking facility will extend 163'
waterward of the nwl and be at least 120' from the adjacent riparian lines. The total
platform area will be 892 square feet along 348' of shoreline. This docking facility
will accommodate one boat, up to 28' long. Neuse River is about 3 miles wide at this
location and the docking facility will be greater than 1 mile from the channel. The
depths at the waterward end of the structure and boatlift area are about -4.0' nwl.
Immediately adjacent to and east of this proposed dock, will be a new boat ramp.
This proposed boat ramp will be 32' long and 12' wide. It will extend 13' below the
normal water level. The water depth at the terminus of this structure is -1.5' nwl.
The existing shoreline stabilization will be reinforced with 315' of granite rip rap.
The base width of this revetment will be 5' wide. This riprap will be located entirely
above nwl. The shoreline stabilization will have a 15' gap so as to not isolate the
steep ravine from Neuse River and maintain the existing connectivity. These
wetlands are located at the base of a ravine that ranges from +1.0' up to +26.0' msl.
At the landward edge of the boat ramp and pier, there is a gravel drive proposed to
connect to the existing upland driveway at the north side of the property. This
gravel drive will parallel the ravine along the +10' msl elevation. This gravel drive
will be 15' wide and 340' long. The portion of gravel drive within the 75' AEC will
cover 825 square feet. This includes 150 square feet within 30' of nwl (Zone 1 of the
Neuse River riparian buffer).
Leaving the steps of the existing residence, an elevated walkway is proposed to access
the proposed three-story workshop & apartment in the ravine, to the proposed patio
area at the southeastern corner of the property. This wooden walkway will be 8'
wide and 185' long.
The proposed building in the ravine includes an 8' wide wrap-around porch. The
total footprint of the structure is 40' wide, 40' long and 36' high. The base of the
structure would be elevated from the bottom of the ravine by treated wood pilings.
The first floor begins at 8' msl and the workshop ceiling is at 23' msl, where the
wrap-around porch is situated. The second floor will contain an apartment at 23'
msl and the ceiling at 33' msl. The third story above that will be a storage area with
the roof at 44' msl. The proposed method of associated sewage disposal is described
as on-site septic.
Adjacent to this building towards the southeastern corner of the property, is a
proposed patio area containing a pool and spa. This patio area will be supported by
two adjacent retaining walls due to the slope of the ravine. The first wall will be at
11' msl and will be 105' long in total. The second retaining wall will be terraced

above just that one at 17' msl and will be 143' in total length. The patio area is
proposed to be at 23' msl and incorporates 3,432 square feet. It will be 44' wide and
78' long. The patio area will contain a swimming pool and spa.
11. Anticipated Impacts:
The docking facility will shade 1,642 square feet of shallow bottom and along with
the adjacent boat ramp fill, will incorporate 5,670 square feet of public trust area.
Water depths in the docking facility project area range from -0.5' to -4.0' nwl. This
area does not have any SAV, coastal wetlands, or shellfish resource. These waters
are not Primary Nursery Area. This docking facility will extend about 163'
waterward of normal water level and should not pose a hazard to navigation. This
docking facility is also well outside of the 15' riparian property setback.
All of the proposed development that is not water dependent will disturb and
incorporate a total upland area of 13,600 square feet. Some of this development is
within the 75' Estuarine Shoreline AEC. There will be 1,720 square feet of shading
in possible Section 404 wetlands. Five percent of the 3.25-acre tract within the
coastal shoreline AEC is to be covered by impervious surface.

The following is my assessment and consequent recommendations of the above
referenced proposal: The project, as proposed, will have minimal environmental
impacts. This proposal is not in conflict with the current usage.of Neuse River, and this
waterbody should not be deleteriously affected. There is no submerged aquatic
vegetation, the waterbody is not a PNA. This area is closed to shellfish harvest.
Assuming that state and federal agencies concur with the proposal, I recommend the
project be authorized as proposed, contingent upon the following conditions:
1) This permit authorizes a maximum of one boat slip at this facility;
2) Existing pier must be removed;
3) No vegetated wetlands will be excavated or filled;
4) The authorized structures and associated activity must not cause an
unacceptable interference with navigation;
5) This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No
non-water dependent uses of structures may be conducted on, in or over public
trust waters without permit modification;
6) The pier and associated structures shall have a minimum setback distance of 15
feet between any parts of the structure and the adjacent property owner's
riparian access corridor, which is determined by drawing a line parallel to the

channel, then drawing a line perpendicular to the channel line that intersects with
the shore at the point where the upland property line meets the water's edge.
7) No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work.
8) The riprap alignment will approximate the normal water level at the time of
construction.
9) The riprap material must be free from loose dirt or any pollutant. It must be of a size
sufficient to prevent its movement from the site by wave or current action.
10) The riprap material must consist of clean rock or masonry materials such as but not
limited to granite or broken concrete.
11) In order to protect water quality, runoff from construction must not visibly increase the
amount of suspended sediments in adjacent waters.
12) Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses
and property (e.g. silt fence, diversion swales or berms, sand fence, etc.).
13) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15
working or 30 calendar days of completion of any phase of grading on cut or filled
slopes.
14) Any development or land disturbing activity that is considered non-water dependent is
not authorized within 50 feet of the normal water level unless specifically exempted by
Environmental Management Commission (EMC) Neuse River buffer regulations in
place at the time of such development.
15) In order to avoid unreasonable danger to life and property, all development shall be
designed and placed so as to minimize damage due to fluctuations in ground elevation
and wave action in a 100 year storm. Cantilevered decks and walkways shall meet this
standard or shall be designed to break-away without structural damage to the main
structure.
16) Any building constructed shall comply with the North Carolina Building Code and the
local flood damage prevention ordinance as required by the National Flood Insurance
Program.
NOTE: The building code or flood damage prevention ordinance may impose additional
more restrictive requirements than the Division's standards for development in
areas of environmental concern (AECs).

NOTE: This permit does not eliminate the need to obtain any additional state, federal or
local permits, approvals or authorizations that may be required.
NOTE: The permittee is advised to contact the local health department regarding
requirements for septic tank installations (as required under 15A NCAC
18A.1900 et. seq.). For information concerning septic tank and other on-site
waste disposal methods, contact the Pamlico County Health Department.

instruction booklet on how to properly prepare the required items below.

Project Narrative
The applicant proposes to construct a pier and dock at his residence with
supporting upland development for the purpose of launching and retrieving test, proto-
type catamarans. The proposed development is located on the north side of the Neuse
River, upstream from Minnesott at a private residence (See Location Map).
The type of vessel to be constructed and tested is a Class A Catamaran
measuring 18 feet in length, 7.5 feet in width with a draft of 4 feet.
The proposed pier is 162 feet in length from the Normal Water Line (NWL) and
includes a 16 -foot ramp leading to a 20-foot wide floating platform which is 35 feet in
width allowing access to the -4.5 foot NWL contour. A recently permitted pier and dock
adjacent and downstream measures 170 feet in length.
Supporting upland new development includes a gravel drive to the pier and a
boat ramp on the shore; a two-story boathouse and workshop with an elevated walkway
from the residence to the pier and workshop. Additional but not related development
includes a pool and spa at the eastern edge of the property.
The pier is proposed to be 6 feet in width in order to accommodate the launch
trailer which will deliver the 7.5 foot wide prototype riding on rails, from the drive to the
launch area located near the end of the pier. The prototype will be launched from the
floating platform and be retrieved along the west side of the pier via a 7,500 pound
capacity rotating crane.
A boat lift to support a boat up to 28 feet in length is proposed along the eastern
portion of the pier. The power vessel will provide support and safety for the testing of
the engineless catamaran and also be available for personal use.
