X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Moorman Farms, LLC, 539 Washington St., P.O Box 386, Plymouth, NC 27962 _ Authorizing development in Washington County at adj, to Albemarle Sound, 5319 Mackey 's Rd., Plymouth , as requested in the permittee's letter dated 4/21/08 - including attached workplan drawings (2) both dated "revised 4/16/08" This permit, issued on May 19, 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Groins 1) Unless specifically altered herein, this minor modification authorizes the two 16 ft. x 25 ft. rock groins. located adjacent to the previously authorized boatramp, all as expressly and specifically set forth in the attached letter and workplan drawings. Any proposal to change the alignment or dimensions of the authorized groins shall require a further review and modification of this permit. 2) The height of the permitted groins shall not exceed 1 foot above the normal water level. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. It shall be of a size sufficient to prevent its movement from the apprcved alignment by wave or current action. 4) The groin material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. Docking Facility 5) Unless specifically altered herein, this minor modification authorizes the staging piers and L-head platform, all as expressly and specifically set forth in the attached letter and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this facility without permit further review and modification of this permit. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. 8) This minor modification does not authorize the creation of any formalized boat slips. The installation of any tie-downs, mooring pilings, boat whips, or other formalized moorings are not authorized and any proposal for such structures shall require further review and a modification of this permit. General 9) No vegetated wetlands shall be excavated or filled, even temporarily. 10) This minor modification shall be attached to the original of Permit No. 155-07, which was issued on 10/3/07, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. 11) All conditions and stipulations of the active permit remain in force under this minor modification, unless specifically altered herein. NOTE: This minor modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. N POy 3 x /.
