Dear Ms. Karoly:
Thank you for your staff's assistance with this project during recent phone and email
correspondence and this morning's office meeting. We are submitting the additional
information requested from written correspondence on July 30, 2008. We are requesting
for NC Division of Water Quality (DWQ) written approval under Section 401, Clean Water
Act, 33 USC 1344 and the Neuse River Buffer Rules. We have addressed your included
written comments in the following paragraphs.
1. In the future, please provide a separate required items checklist for
each proposed level spreader.
Thank you for informing us and we will provide separate checklists for future
projects and their proposed level spreader and other BMP structures.
2. As listed in Item 2 of the required items checklist, you must provide
plan details that show one-foot topographic lines between the level
lip and the top of the stream bank. Please provide this in a legible
manner in your re-submittal.
Please refer to the attached 30-scale pond details. One-foot topographic lines
are shown along with 50 and 100-foot riparian buffers between the streams and
level spreaders.

3. For level spreaders 1 and 4, the bypass device infringes on the filter
strip. Please relocate these bypass devices such that they will not
impede diffuse flow downslope of the level lip.
Please refer to the attached 30-scale pond details. To prevent potential short-
circuiting of the diffuse flow area, the input to the forebay from the bypass structure has
been extended and/or slanted away. This should prevent any potential interference.
4. Please provide a separate high flow bypass for the proposed dry
detention basins so that the level spreaders will not be compromised
during larger storms such as the 10-year storm.
Please refer to the attached 30-scale pond details. To prevent potential short-
circuiting of the diffuse flow area, the input to the forebay from the high flow bypass
structure has been extended and/or slanted away. This should prevent any potential
interference.

Dear Mr. Hausfeld:
On April 4, 2008, the Division of Waiter Quality (DWQ) received your application. dated sprit 3,
2008, to fill or otherwise impact 0.021 acres of 404/wetland, 73 linear feet of perennial stream,
'73 linear feet of intermittent stream and 9,581 square feet of Zone 1 Neuse River basin protected
riparian buffers and 5,225 square feet of Zone 2 Neuse River basin protected riparian buffers to
construct a residential development at the site. On June 20, 2008, the DWQ received additional
information from you. however, the DWQ has determined that your application remains
incomplete and/or provided inaccurate information as discussed below, The DWQ will require
additional inforn-.ation in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive five copies of the additional
information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be
formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
