PROJECT SUMMARY: The applicant proposes to anchor two small skiffs and place the following structures in the shallow waters of the Roanoke Sound: • An 16-foot by 16-foot, eight unit jet-ski rack, • A 54-foot by 12-foot floating kite board ramp, • A 40-foot by 8-foot floating kite board ramp, • A 9.5-foot by 3.2-foot stationary kite board ramp, and • A 25-foot by 0.7-foot stationary kite board slider. Proiect Setting The subject property is a 1.72-acre parcel located at 3900 South Croatan Highway (US 158) in Nags Head, Dare County. The lot is bordered by South Croatan Highway (US 158) on the east side, the Windmill Point restaurant to the south, a large undeveloped lot to the north, and the Roanoke Sound to the west. The upland portion of the subject property contains a long asphalt driveway terminating in a "U-shaped" access to the Turf-Stone parking spaces and a small-elevated wooden building located along the northern property boundary. The elevated building contains the retail operations for the water sports facility (i.e., kite boarding lessons and jet ski rentals) located on- site. Vegetation along the driveway and parking areas is comprised of mowed weeds and grasses. The western shore of the subject property is comprised of a combination of sandy beach areas and Coastal Wetlands 2 - 10 feet wide that are vegetated with Cord grass (Spartina alterniflora). Immediately east of this beach/wetland area is a sandy knoll 10 -20 feet wide that is less than two feet above normal water level (NWL). A shallow depression approximately one-foot deep and 50 - 75 feet wide is located east of the small knoll. The shallow depression, which is routinely flooded by wind-driven tides, contains Coastal Wetlands comprised of Cord Grass (Spartina alterniflora) and Salt Grass (Distichlis spicata). All the Coastal Wetlands located on the property are regularly mowed to facilitate their crossing by patrons of the water sports facility. The 650 feet of shoreline on the subject property and the shorelines of the nearby properties have not been hardened. Coastal Wetlands located on the shorelines of the properties both north and south of the subject property contain Cord Grass (Spartina alterniflora), Black Needle Rush (Juncus roemerianus), Salt Meadow Grass (Spartina patens), Salt Reed Grass (Spartina Cynosuroides) and Salt Grass (Distichlis spicata). Elevations across the subject property range from zero along the shore of the Roanoke Sound, to less than three feet near the elevated retail building, to five or more feet at the property's eastern boundary along the South Croatan Highway (US 158). Field Investigation Report Kitty Hawk Kites - Nags Head, Dare County Page 3 The waters of the Roanoke Sound adjacent to the subject property are very shallow. They range in depth from one-foot deep approximately 50 feet beyond normal water level to approximately 2 feet deep 200 feet beyond normal water level. The water depths and approximate location of SAV depicted on the attached large plat were field verified on April 29, 2008. The large near-shore area void of SAV contains a hard sand bottom covering a layer of fine muck. Proiect Description The applicant proposes to anchor two small skiffs and place the following structures in the shallow waters of the Roanoke Sound: • An 16-foot by 16-foot, eight unit jet-ski rack, • A 54-foot by 12-foot floating kite board ramp, • A 40-foot by 8-foot floating kite board ramp, • A 9.5-foot by 3.2-foot stationary kite board ramp, and • A 25-foot by 0.7-foot stationary kite board slider. The applicant proposes to install the structures in mid-May and remove them in mid- November. Patrons of the water sports facility will utilize the structures to perform jumps, tricks, and stunts similar to the way skate boarders utilize these same types of structures to perform tricks and stunts on land. The 54-foot by 12-foot ramp and the 40-foot by 8-foot ramp will be suspended in the shallow water by sections of plastic floating docks and anchored with small boat anchors. The 16-foot by 16-foot jet-ski rack, 9.5-foot by 3.2-foot ramp, and 25-foot by 0.7-foot slider will rest on the bottom of the Roanoke Sound, but will also be anchored with small boat anchors. The applicant proposes no upland development, only the in-water structures listed above. 9. ANTICIPATED IMPACTS It is anticipated that the proposed project will cause the following impacts. • The proposed structures will shade 708 SF of Estuarine Waters / Public Trust Area AECs located in the shallow waters of the Roanoke Sound. • The proposed structures will disturb 304 SF of shallow bottom of Estuarine Waters / Public Trust Area AECs located in the shallow waters of the Roanoke Sound. • A review of available maps indicates that no archaeological resources are located on the subject property. The applicant leases the site from the landowner (Sarah Forbes) for these commercial uses. The site has two existing walking paths that traverse the wetlands to the sand beach area. All proposed anchoring of structures is temporary and all will removed at the end of the rental/training season. PROPOSED ACTIVITIES: • Temporary mooring of 54L X 12'W X 5'H floating kiteboarding ramp • Temporary mooring of 401 X 8'W X 3' H floating kiteboading ramp • Temporary mooring of 25' L X 0.7' W X 6.6 'H kiteboarding slider. • Temporary mooring of 9.5' L X 3.2' W X 4.1' H kiteboarding ramp • Temporary mooring of jet ski rack (Accommodates 8 jet skis) • Temporary anchoring of rescue/safety skiffs 0 1 (all structures and the vessel w II be anchored to the substrate with a Danforth style boat anchor) No permanent mooring anchors will be installed KITEBOARDING ACTIVITIES: Applicant proposes to seasonally moor floating kiteboarding ramps and a slider rail for recreational/training purposes and also for use during any kiteboarding contests and demonstrations. Location of the mooring shall be determined at the beginning of each season avoid impacts to SAV areas. TWO Arsupport/rescue boar' a shallow draft skiffi will be anchored just offshore of the roo shoreline in order to provide safety measure in case of any kiteboarding equipment malfunction, operator error or inclement weather conditions. The floating kiteboarding ramps and the slider el?alt have been redesigned this year and will be built in sections in order to be transportable by manpower from the highground to the water, at which point the structures can be placed in the water, reassembled and floated into place and anchored. At which time the kiteboarding season has concluded, approximately early to mid November, (or in the event of a potential tropical weather threat) the structures will be floated back to the shoreline, disassembled and carried (in sections) by manpower to highground The exact location of the floating ramp, sliders and jet ski rack will have to be determined at the beginning of each kiteboarding season to avoid areas of submerged aquatic vegetation (SAV). Jet Ski Rack and rental: The eight slip jet ski rack will be temporarily anchored in shallow water close to the shore to allow for ease of client access and orderly accounting of the rental units by the operator. The wooden structure will be anchored with small Danforth style boat anchors and the weight of the jet skis will aid in weighting the rack to the bottom. The jet ski rack is proposed to be installed on the north side of the property in an area devoid of SAVs. The rack primarily rests on two floating dock floats aligned so that they allow for the rack to angle upwards out of the water. An alternate location is proposed on the south side of the property if water depths in the primary location limit the ability of the jet skis to access the rack. HIGHGROUND ACTIVITIES: Commercial use of the property for kiteboard training, rental and use and also as a jet ski rental facility. Daily operations of the rental are the only highground activity proposed by the application. After the end of each kiteboarding and rental season the structures will be removed from the water and returned to the water each spring. Because SAV areas tend to shift with yearly environmental influxes (salinity, seed dispersal, germination failures storms, waves, etc.) the specific ramp location within the water shall be re-assessed and re-selected every spring in order to place it an area devoid of SAVs. . c.
