Dear Kim:
Enclosed are the draft wetland preservation map and Declaration of Restrictive Covenant for a ten-
acre area of wetlands within the Rice Creek Plantation site. As we discussed, you requested a 20:1
preservation to impact ratio for the proposed impacts in the initial phase of development. The applicant
plans to deed a majority of the remaining wetlands on the property to a non-profit organization. He has had
discussions with several organizations about this preservation and this transaction will be finalized in the
coming months.

NOW, THEREFORE, Declarant does hereby declare that the
Property as shown on a plat recorded in Deed Book 1644 at Page
0559 of the Brunswick County Registry shall be held and shall be
subject to the following restrictive covenants which run with
the land, are real covenants and are binding on all parties that
shall have any right, title or interest in said Property now or
in the future.
1. The area shown on the above-referenced map as
Area of Preservation shall be maintained in perpetuity in its
natural or mitigated condition. No person or entity shall
perform any of the following activities on such Conservation
Area:
a. fill, grade, excavate or perform any other
land disturbing activities;
b. cut, mow, burn, remove, or harm any
vegetation;
C. construct or place any roads, trails,
walkways, buildings, mobile homes, signs,
utility poles or towers, or any other
permanent or temporary structures;
d. drain or otherwise disrupt or alter the
hydrology or drainage ways of the
Conservation Area;
e. dump or store soil, trash or other waste; or
f. graze or water animals, or use for any
agricultural or horticultural purposes.
2. The Corps shall have the right to enter the
Property at reasonable times for the purpose of inspecting the
Property to determine if the Declarant or their successors in
interest are in compliance with the terms of this restriction.
3. This restriction can only be amended or
terminated with the express written consent of the Corps or its
successors in interest.
4. The Corps shall have standing to enforce this
restriction and may apply for either legal or equitable relief
in either State or Federal court in the event of a violation.

5. This Declaration does not convey to the public
any right to enter the Property for any purpose whatsoever.
