Dear Ms. Anderson:
On January 16, 2007, the Division of Water Quality (DWQ) received your application dated November 9, 2006 to dredge
1490 square feet (sf) of Shallow Water Bottom, 24 sf of coastal marsh, 641 sf of 404 wetlands and 3125 sf of high ground
for the purpose of creating a two slip docking area as described in your application. The DWQ received your response to
our request for more information letter on March 26, 2007.
This letter is to inform you that the DWQ will continue to keep your project on Hold until we receive clarification from
the Attorney General's Office regarding the legality of permitting your project. Due to the unique design of your project
where the Neuse River Riparian Buffer Regulations 15A NCAC 2B .0233 will be imposed upon your adjacent neighbor's
property and his objection to that project the DWQ is seeking clarification through counsel. The DWQ will notify you as
soon as we hear from our counsel regarding the permitting of the proposed project.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be awaze that any impacts requested within your application are not authorized (at this time) by the DWQ.
